Finding this subreddit has been so therapeutic and validating for me. I’m 26, married to the love of my life (32M) with the most amazing 5yo stepdaughter.
Reading all of your stories has inspired me to sit down and type out my own. I must warn you, there are times when I am the villain. Buckle up. This is a small novel.
If we start at the very beginning, my DH began dating HCBM (33) when they were very young in their early 20s. Shortly into their relationship it became clear to DH that she was struggling with very severe alcoholism. I cannot even begin to write out all of the stories I have heard from DH about her alcoholism. He was very young, didn’t have a positive model for a healthy relationship as a child. He believed he could help HCBM. They were extremely on and off together for almost 7 years. Every time he’d try to break up with her she would weasel her way back in. She would go as far as showing up at his family events because she had his family wrapped around her finger (don’t worry, that changed. Read on.) She almost drank herself to death several times. The police in her town know her by name and recognize her car because her family has had to call in for welfare checks so many times. She’s had bits where she’s gone missing for several hours. Been listed as a missing person. Had the police ping her phone. I’ve read the police reports myself.
Where do I even begin with her family? Her parents are extremely proud. They own two businesses in their small town. They’re the kind of people who are very obsessed with image and making people think they’re wealthy. HCBM started drinking when she was 16. Her parents would deal with her problem by sweeping it under the rug and hiding it. They cared more about their pride than getting her the help she needed. When they were together, my DH was often the one who would drive her to AA meetings. HCBM didn’t like AA because she felt she was above the other people there. Her family now despises my DH, and weaves a narrative that she drank because of her toxic relationship with him. Though her drinking problems existed long before and after their relationship.
I’ll share a few stores in particular with the goal of establishing the absolute delusion that HCBM feeds to anyone who will listen about my DH.
There was one evening where they were at my DH’s uncle’s house in the city. The thing about HCBM is that you never saw her drink until she was drunk. She’d sneak in a bathroom or what have you to drink. DH and HCBM got into some kind of argument and she ran off into the city late at night. DH spent several hours driving around the city searching for her until he finally found her in a bar, making out with a random guy. He said “you can take her home tonight” and left. Several hours later in the wee hours of the morning, HCBM stumbled back to the uncle’s house, wasted and crying.
Another occasion, DH was at work and HCBM was at his apartment (she did not live there) and went to hang out with his upstairs neighbors who were girls. She got drunk with them. When DH got home, he tried to explain to his neighbors that she had a problem and shouldn’t be drinking…. They said “don’t control her! That’s manipulative”. DH went back downstairs, HCBM followed, and they fought. She ran back to the neighbors crying and the girls stormed down into his apartment saying “What did you do to her? What did you do to her?!”
A different time HCBM was drunk she had locked herself in DH’s roommate’s room. He was trying to explain to her that she needed to come out, that it wasn't his room and she couldn’t be in there. HCBM called DH’s mom (now my MIL) and began wailing “he’s doing it again, he’s being crazy again!” God knows what she was talking about. Eventually DH called HCBM’s dad who came to pick her up. HCBM’s dad dragged her by her arm down the stairs rather roughly, and DH got upset, like “hey I get that she is drunk and being a problem but you can’t manhandle her like that” so HCBM’s dad responded my shoving DH up against a wall and holding his arm to his throat.
Shall I go on? There are dozens more. The worst is yet to come.
Anyways, about four years into their relationship, after multiple incidents of infidelity on her part, DH started chatting with other women sporadically. He says he knew it was wrong, but he thought if he could show himself there were other women out there who could make him happy, other stable relationships he could be in, he might be able to get away from HCBM. It was about five years into their relationship that DH actually cheated. And so begins HCBM’s favorite narrative, that DH was an awful, unsupportive unfaithful partner who drove her to drinking because he was so shady. She will never, ever consider the fact that my DH to this day is traumatized from their relationship. He’s been in therapy several times and every single therapist identifies her as a narcissist.
Several years ago when DH and I met I was in college. We had an on and off fling for a while on the coattails of him trying to end it with HCBM once and for all after over six years stuck in a cycle. I think my DH made poor decisions, dumb even. But I sympathize with the trauma bond he was stuck in with this woman, and how difficult it was for him to cut ties with someone who would go to great lengths to insert herself in his life, and with the pressure of his family saying he should be with her. He cut things off with me and fell back in with HCBM. Lo and behold… HCBM gets pregnant. This may be shocking…. But it was not a good situation to be bringing a baby into. HCBM was 28 at the time. She was (and still is) working for her mom at the business she owns because she had gotten fired from every other job for showing up drunk. A side note, her mom owns a gymnastics center where she is a teacher. My DH has told me about several times her mother would text him to come pick her up because she’d shown up drunk. Her mom would get her out of there and just sub in another instructor to cover her ass. Anyways, DH was terrified. However, DH grew up without a father, so there was no way he wasn’t going to be involved in his child’s life. It is an impossible thing to talk about in hindsight because I love my SD so dearly, she turns mine and DH’s world. But DH told HCBM to terminate initially. And to be fair, he was right. It was not a stable situation to bring a child into. Would I reverse time and change anything? Never in a million years.
As you may have guessed, HCBM decided to keep the baby. She repeatedly told DH that if he left, he would not see his child. DH was stuck and miserable. During her pregnancy, while HDBM was parading about as if they were this cute happy couple, DH began to miss me. He realized he had real feelings for me, and he reached out. I loved him the moment I met him, so I was thrilled. I’ll keep this part concise; DH began cheating on HCBM with me, and I knew. It was an ugly decision on both of our parts. Despite how much I loathe HCBM, she is a person. She did not deserve that. DH and I are both pretty ashamed about our choices back then. I’ll go into detail later about how both DH and I have tried to atone for our actions.
When she was about 7 months pregnant, HCBM caught on and contacted me. Those conversations are forever burned in my mind. She said some of the most disconnected, ridiculous shit I’ve ever seen. She was obsessed with the image she was trying to portray to everyone about her life. I’ll never forget one conversation where we were discussing their daughter’s impending arrival… I had said something along the lines of “do you think it’s wise to bring a child into this situation,” and she said “I have lots of help. I’m old enough.”
“I’m old enough.”
Like she’s a kid trying to convince her parents to let her stay out past midnight.
DH and I broke things off before SD arrived. I was heartbroken, but let’s be real, that was a mess. An entire mess.
Still, HCBM thought it was just a brilliant idea for her and DH to move in together. So her parent’s rented them a house in their small town…. DH kept paying the rent on his apartment the city about 45 minutes away. DH has told me how miserable their relationship was, and HCBM knew all about his affair with me. But like I said, she was desperately trying to create this pretend life for herself.
SD arrives, a day I am so glad to celebrate each year. She is truly the joy of my life. DH cried more than she did. He was instantly in love with his baby girl.
About three weeks later, HCBM is back on the bottle.
DH told me about how he’d come home from work and find her drunk. She’d grab the baby and lock herself in a bedroom and cry. DH feared for his child’s safety.
HCBM was only able to breastfeed for a month or so because she stopped producing milk due to heinous dieting. She was obsessed with getting back to her pre-pregnancy weight. She would eat only miso soup for days on end. This poor relationship to food comes into play later. HCBM’s mother was always over at the house. Cleaning up, buying them things. Contributing to the facade.
DH was severely depressed. He continued to stay with HCBM to monitor her drinking and watch out for his daughter. They got to a point where DH would sleep on the couch. One night DH came home and HCBM was drunk again with SD in her care. DH called her parents who came rushing over to remedy the situation as they always do. Shortly after they arrived, HCBM had slumped over on the couch and became unresponsive. An ambulance was called. DH says it was one of his most traumatic memories holding his baby daughter watching the EMT’s resuscitate her mother wondering how he would raise this girl on his own.
After a hospital stay, HCBM returned home and her parents ordered pizza and put on a movie and pretended as if nothing had happened. That was the routine. When DH expressed his anger, his justifiable concern for what was going on, HCBM’s parents treated him as though he was the problem, he was an asshole for bringing it up and blaming her.
It wasn’t long after this, SD must’ve been around eight months old that HCBM was on a binge and DH returned home from work to find the house empty. He frantically began calling people to locate SD when HCBM’s parents informed him that she was with them, and that HCBM had crawled out a window and was missing. A missing person’s report was filed. HCBM’s father told police to check ditches and park benches, as she could often be found there. She turned out to be at some random man’s house, and was located about 36 hours later.
DH was at the end of his ropes. He took the police report and lawyered up secretly.
Here’s a fun new component to the story, remember how I said that DH had began sleeping on the couch? In said police report, it is documented that DH and HCBM were not in a relationship and were merely roommates. Because that was the situation. Behind the scenes, HCBM had met the man of her dreams. Let’s call him PF….. for psycho fiance. Yes, they’re engaged now. We’ll get to that part. PF randomly messaged HCBM on facebook and they began talking. PF was a recovering alcoholic in his 30s with no driver’s license due to a DUI.
Now, recall when HCBM was missing? Her parents searched through her facebook accounts to try and locate her and found her messages with PF, they explained their daughter’s drinking problem and asked PF if she may be with him. She was not. They had not even met yet. But PF thinks this woman who clearly has severe personal issues is just the cream of the crop. He decides to take her out to lunch. By the end of their lunch date, he is love-bombing the daylights out of her. Calling her his wife, his galaxy, all of this grandiose crap.
Two weeks after they met, PF got HCBM’s name tattooed on him. While DH was trying to sort out a plan of action with his lawyer…. HCBM informs him that he has to move out so that PF can move in because he will soon be without a place to live. She wants to invite this man she’s known for three weeks to live with her and her baby daughter. I’ve seen the message she sent to DH, it reads, “I know it seems fast but I know in my heart that he is so good.” HCBM’s parents are thrilled.
Less than a week after PF had moved in and DH was out, the ex parte motion was filed. DH was granted full emergency custody of SD until a hearing could be held. HCBM did not see SD for nine days… and of course, DH was the villain for this.
At the hearing. DH was awarded majority custody, with HCBM being allowed one overnight a week. PF was not permitted to be present when SD was there for overnights until CPS could investigate.
Now, HCBM’s parents funneled money for lawyers, rent, utilities, basically any adult expense HCBM needs is taken care of by her parents. DH did not have the same luxury. He was working himself to death as a single dad trying to pay for his lawyer while the court battle ensued. Almost two months later, DH contacted me. We hadn’t spoken in close to a year. I was off living my own life almost halfway through college. DH just needed someone to talk to about it, and still had very strong feelings for me. I was a shoulder for him to lean on.
We began hooking up, with no real intention to enter into a relationship. I met SD and would watch her while he was at work. There was an obvious deep love between DH and me, but the circumstances were just so insane. Plus, HCBM despised me, and was weaving stories to the court about how DH was an emotionally abusive partner, a narcissist and the reason for all her drinking.
DH and I did not want the drama of HCBM knowing I was around. Since we were operating under the guise that this was just an indulgence and would end at some point, we kept our interactions a secret.
Then, the universe must’ve thought we were owed some karma for what we did during HCBM’s pregnancy. I was diagnosed with ADHD at age five and have had a prescription for stimulants since a very young age.
One morning I awoke and heard what sounded like tiny wretching from the other room. My medication had spilled out in the bottom of my purse as the safety cap was screwed on crooked. SD was playing on the floor and digging around in my purse. DH noticed her putting something in her mouth, realized it was my medication and immediately ran into the bathroom and began making her puke.
I called poison control who instructed us to bring her to the hospital. She seemed relatively normal, a bit dazed maybe. We called the ER to let them know we’d be arriving. We got there and they stuck charcoal down her throat, drew blood, the whole ordeal.
I brought my medication bottle with me to give to the nurses so they knew what she had ingested and to prove it was a legally obtained prescription. I was frantic and bawling, a nurse comforted me and told me that ingestions are extremely common and we had done the right thing by bringing her in.
SD had an elevated heart rate, was fussy and stressed. She was administered medication to help lower her heart rate and as a result had to be admitted to be monitored. The blood tests came back with extremely minimal amounts of my meds in her system, but it was protocol that she be monitored after the medication was given to regulate her heart. If you’re feeling anxious, I’ll add that SD is perfectly healthy and happy, she fully recovered and did not suffer any seizures or damage to her brain/liver etc. which were the primary concerns with this ingestion.
Since she was being admitted, HD had to inform HCBM. I had told him he should tell her immediately, but he did not want to deal with her reaction or her family arriving. I think this was a poor decision on his part. As flawed a person as she is, I do know that HCBM loves SD very much, and I can sympathize with her wanting to be informed if her daughter was being seen at the hospital.
HCBM and her family arrived, I had left to avoid the fallout and gather some things for DH to drop off while he stayed at the hospital with SD. Naturally, HCBM was in a blind rage that she had not been contacted immediately. She demanded that the CPS worker who was mandated to check in because of the ingestion file a report of negligence. The CPS worker declined, saying that there was no negligence to report. That evening, security was called to remove HCBM from the hospital because she was screaming at DH in the pediatric wing. She was told she could return on her custody day.
I went to visit DH and SD the next day, she was back to her old self and able to go home. We were nowhere near prepared for what was about to ensue.
HCBM had weaved a story that I was addicted to drugs, and that whatever I was doing had to have been in a plastic bag in my purse or how else would SD have gotten into it? HCBM and her lawyer filed an ex parte motion. Now I’m sure most of you are familiar with the workings of family court, but for those of you who aren’t; and ex parte motion is an emergency motion. It is a piece of paper laid in front of a judge. The details can be as vague or exaggerated as the writer pleases them to be, and it is not until a hearing is scheduled can anything be disputed.
HCBM and her lawyer claimed that SD had ‘overdosed’ on stimulant drugs and conveniently failed to mention that they were a legal prescription. More than that, ‘overdose’ was a completely sensationalized description of what had occurred, and not a term used at all by any of the medical professionals nor was it included anywhere in her chart of the incident. SD never lost consciousness. There was never a point where doctors were in fear for her life. But the judge sees what is put before them and signs off with the limited information they are given.
When HD filed an ex parte motion against HCBM, the hearing was scheduled for nine days later. When HCBM filed an ex parte motion against DH, the hearing was scheduled over two months later.
This was the worst time period in DH’s life. He attempted suicide. He lost an insane amount of weight. He sold beloved possessions to pay his lawyer. He did not have custody of his daughter and HCBM allowed him rare visits in public places once or twice a week.
But ah, how the tables turn.
A month before the hearing on the ex parte motion, HCBM got a DUI with SD in the car. Her driving was so ballistic, someone had called in her car. She was arrested. I could go into detail about the bullshit-ery of her and her family I read in the police report from that, but there is still so much ground to cover.
CPS notified DH of the DUI. HCBM and her lawyer told DH’s lawyer they wanted to settle custody outside of court before the ex parte hearing.
DH was exhausted. He was broke. He just wanted his daughter back. He settled with HCBM on 50/50 custody. This is perhaps the greatest regret of his life. The GAL at the meeting even told DH he didn’t have to do this, that he could fight her and probably get more custody. But DH was a shell of a person at this point. He was in debt. He was exhausted.
Mere days after they settled he checked himself into an inpatient mental health facility for treatment. He and I were in touch every once in a while throughout that entire time, but had ended our romantic relations after the ex parte was filed. I was more of a confidant and friend, but he had drifted apart from everyone in his life and I was focused on school.
The day that DH left inpatient, PF messaged him to tell him that HCBM had slipped up and drank again. Saying, “she just has such a big heart, this is so difficult for her.” DH suspects that she had gotten herself into another nearly lethal situation or gone missing and PF was hoping to do damage control by contacting him rather than him finding out another way.
So 50/50 custody it was. Nine months later, HCBM gave birth to her and PF’s son. I’m not sure of any exact dates but judging by the date of that message and the birth of the baby there is a high change HCBM was drinking while unknowingly pregnant.
For the DUI, HCBM was sentenced to 40 days in jail while pregnant with her son. It was a work release program. Since she worked for her mom, she worked as many hours as she possibly could. Her mom would pick her up from prison with her phone and her makeup so she could hide what was going on from her coworkers and the community. DH would bring SD to the gymnastics center to visit her. She had an IED put into her car when she was released, meaning she had to blow into a breathalyzer to get her car to start.
DH and I would check in every once in a while over the course of the next year. We both dated other people. HCBM of course had issues with DH’s girlfriend he was with for a few months. But things had relatively settled save for the tension and resentment between HCBM and DH.
More than a year had passed since everything transpired and since DH and I were last romantically involved. We began talking more frequently during COVID lockdown and DH admitted he was hopelessly in love with me and wanted to be together. We had a major problem though.
When HCBM and DH were settling on their custody agreement, HCBM insisted I was not to be around SD. If you recall, HD was broke, exhausted, and severely struggling with his mental health. He and I hadn’t seen each other in person in several months, we talked but very infrequently and never of rekindling our relationship in any capacity. So he gave in. As long as he could be done with the nightmare and have his daughter back.
A single sentence in a five-page custody agreement meant that I couldn’t be around SD. I want to specify, this was not a restraining order. I was never served any papers, I would not be punished in any capacity were I to see SD, there was no court record of any kind indicating that I was restricted from seeing a child or was a dangerous individual. DH wouldn’t even lose custody or face any legal ramifications were he to violate that single sentence, it would just mean an official would have to intervene to investigate and ensure the stipulation be adhered to. Still, it would’ve prevented us from having any sort of real relationship. So we filed a motion to have the line removed. I had not seen SD in well over a year and we abided by the order which was exceedingly painful.
The first hearing was before a court commissioner. We came armed with letters of recommendation from friends and family, from the families I had nannied for during college. DH’s family had finally seen the light and turned against HCBM and attended the court hearing, filing the seats.
The court commissioner spent about ten minutes reviewing our plea, and decided this was not a matter of my character or whether I was a threat to SD, but that this was a communication issue between DH and HCBM, and since DH had agreed to this, they needed to work it out between the two of them.
Ha. Like that would ever happen. DH and HCBM began communicating through a court monitored app and attending co parenting counseling while our lawyer filed a motion to bring the issue before a judge and have a GAL and Family Court Worker appointed. As we all know with family court, things move slowly and this we had to wait months to make progress on our case.
Co parenting counseling was fruitless. HCBM is not capable of accountability. She insisted DH was a narcissist because she’d read about narcissism on the internet and she believed she deserved full custody of SD.
A judge appointed a GAL and Family Court Worker to our case. I’ll never forget the relief that day as the judge told HCBM that me being in SD’s life was inevitable at this point. There was no evidence that I was a dangerous person. At one point, our lawyer brought up the language used in HCBM’s ex parte motion all that time ago, pointing out the sensational language used, specifically the term “overdose”. I was shaking when HCBM’s lawyer admitted to the judge that “there was no overdose.” I’ll never forget the sheepish look on that lawyer’s face, or how HCBM’s jaw tightened as she refused to look even a millimeter in my direction.
Everyone met with the GAL and Family Court Worker. Of course HCBM got the earliest appointment possible so she could try to sell her story. When I sat down with the GAL he said “I don’t know why you’re here, to be honest.” But that’s the ridiculous thing about family court, people can just spew this insane shit and it has to be looked into.
Both the GAL and Family Court Worker recommended the line be removed entirely. We still had to wait another month for our hearing for these recommendations to be made to the judge. Over the course of these proceedings, DH and his lawyer (with my consent) had been urging HCBM to attend a co parenting counseling session with me to address her concerns. HCBM of course vehemently refused, actually speaking to me would destroy the picture she had painted and deluded herself into believing about me.
We continued to press the issue though. After the GAL and Family Court Worker’s recommendations were passed on to everyone’s lawyers, it was clear this was not going to go in HCBM’s favor. It could’ve easily been settled outside of court, saved everyone time and money. But that was never going to happen, HCBM was going to go down swinging. Less than two weeks from our final hearing before the judge, HCBM agreed to attend co parenting counseling with me. Both parties signed NDA’s before going into these sessions, they were meant to be mediation for parents to work out their issues and not dig up fodder to toss around in court. A safe place, if you will. DH and I suspected she’d want to attend a session with me so she could fabricate some story about me being awful, or make it seem like she was being reasonable since she’d refused any and all attempts to mediate this issue civilly.
We were correct, but her feeble attempts at control were fruitless and the line was removed. I could see my girl again. Since then, DH and I got married and have been in absolute bliss as a family of three. But of course, the mess with HCBM does not stop there.
DH and I have no idea it HCBM has been drinking or not. We have no proof. She claims she got sober, but she never received any professional help or rehab so that seems doubtful to me. There are a few red flags. She now shares a car with her mother, claiming her car has “been in the shop” for well over a year now. DH explained that when she would go on drinking binges, her parents would take her car away so they could control where she went and monitor her.
We’ve also had the issue of SD not wanting to go to her mom’s house. I have ring video footage of HCBM coming to pick up SD. SD was in hysterics, she ran back in our house several times while HCBM stands annoyed in the driveway. DH sits with her and consoles her, encouraging her and telling her she will have so much fun with her mom and brother. On this particular occasion, it took 45 minutes to get SD to go with her mom. This happened numerous times. DH eventually brought this up to HCBM, expressing his concerns and saying that he wished she would participate in co-parenting their daughter in these situations rather than hiding behind her car. HCBM dismissed him, saying she was a great parent and he was obviously making SD act this way. Give SD an oscar at this point. I can’t even fathom what DH would say to make a five year old act that way.
Eventually, HCBM stopped picking SD up and instead sent her mom to get her. SD has no issue going with her grandmother. A bit suspicious to me that it was specifically her mom that caused such an upset for her.
HCBM is very obsessed with image. She dresses SD in expensive outfits with intricate hairstyles. I should add, expensive outfits that are purchased for her by HCBM’s mother. She has told DH that she is not pleased with how he sends SD to school and has concerns about his ability to parent. He sends her… a 5 year old… to school in leggings and t-shirts like the rest of the 5 year olds in her class. Don’t get me wrong, I love to dress SD up when she’ll let me and I have indulged in Rylee and Cru outfits and what not, but the majority of the time SD wears normal kid clothes. She runs and jumps and plays and likes pink and sparkles and tops with her favorite characters on them. We let her pick her crazy mismatched outfits and throw her hair up in a quick bun or braid so it is out of her face. She bathes almost excessively because she loves the bath and is a very well looked after child.
Now, HCBM lost a significant amount of weight after she got together with PF. Her mother is also extremely thin. DH has told me about how they were always doing fad diets, they’d call themselves fat and critique their appearances constantly and clearly did not have a healthy relationship to their bodies or food.
At our home, SD is fed a balanced diet but I try to encourage a positive relationship to her body and food. No food is “good” or “bad,” they simply serve different purposes. For example, carbs give us energy, protein helps us grow, sugar makes us happy, etc. Creating guilt around eating certain types of food can lead to eating disorders, body image issues, I know because I had a poor relationship to food and my body for so long. SD loves fruits and veggies. She also loves chips and candy. She is allowed to indulge in sugar within reason and without guilt. I don’t think it's rocket science, and for us it has had fantastic results. We'll be at a gas station and ask SD if she wants a snack and the kid will want celery. I follow the instagram page “kids eat in color” very closely and when we prepare SD’s meals, the “treat” component is served together with the rest and not withheld until later. This is so SD doesn’t view certain foods as special or more desirable than others, and won’t associate treat foods with this rush of excitement and overwhelming positivity moreso than say chicken nuggets or carrots. When DH sets down her plate to eat, SD rarely if ever reaches for her treat food first. She eats everything on her plate until her body tells her she’s full.
HCBM constantly berates DH about SD eating “healthy.” She criticizes him for getting candy at the movies. Goes off about her having a cup of sugar-free pudding at 11 a.m. On Halloween, SD is allowed two pieces of candy from her trick or treat pile at her mom’s house.
Last Halloween at our house, we dumped all of our candy out in a huge pile and watched a movie. SD ate, I kid you not, four pieces of candy. She didn’t feel the need to binge on all this candy because she knew it wouldn’t be withheld if she asked for more in our home. There is still halloween candy in a bucket in our pantry and we weren’t even out trick or treating for an hour.
HCBM accuses us of “competing” with her. This. Is. Rich. SD loves visiting my parent’s and sometime last fall took a liking to playing my dad’s drumset. Later that week, HCBM bought her a kid-sized drumset. We adopted a kitten, HCBM adopted a kitten. We started playing barbies as a family, HCBM buys a barbie dreamhouse. We planned a weekend trip to a big city a few hours away, HCBM and PF take SD and their son to that city the week before we’re supposed to go. My husband is a Dungeons and Dragons fanatic, and recently he has been making kid friendly campaigns for the three of us to play as a family. SD loves playing dungeons and dragons with her daddy. It has become our family’s thing. The dungeons and dragons movie came out recently and DH and I got tickets for an early screening on a day we didn’t have SD. Who do you think we saw there while we were waiting in line to get popcorn? Their family does not play dungeons and dragons. You’ll be pleased to know that SD came down to sit with us for the last half hour of the movie, PF who had taken her had to give in because they were seated a row behind us and she kept leaning forward to excitedly whisper to DH about the movie.
I have suffered extreme emotional issues due to the abuse from HCBM. I’ve attended therapy specifically to address it. I developed severe social anxiety because HCBM will tell anyone who listens these fictions about me and DH. We live in a small community, one that HCBM and her family have been a part of for a long time and I am constantly afraid people I meet will know them and have these crazy ideas about who I am as a person. The flipside of this is that their family’s reputation is not as positive as they like to think it is, particularly to police in the area. In addition to HCBM’s drunk escapades involving police, her father has a court record pages long for tax fraud.
Thankfully, I work in the city 30 minutes from where we live and that has allowed me to build my own village and have a life untainted by HCBM and her crap. Through lots of work I have been able to establish firm boundaries. I’ve had to restrict HCBM and her friends from my social media accounts after being watched obsessively. HCBM’s mother even went as far as messaging my mother on Facebook to try and say DH is a narcissist and she should be concerned for me. DH and my mom are very close, and my mom was mainly worried about how far these people were going to go to untether my life.
HCBM doesn’t seem to understand the concept of equal guardianship. She views herself as the primary parent and believes she should have access to everything in our lives. This is legally not the case so luckily we’re just able to ignore those demands but it gets taxing.
HCBM’s parents pay for SD’s health insurance so HCBM makes all of her doctor and dentist appointments and acts as though that’s because DH is an uninvolved parent, despite the fact that he has asked to make appointments on his custody days so he could go. I have excellent benefits at my job and could take SD on as a dependent since she resides with us 50% of the time. We haven’t even proposed this idea to HCBM because god knows she would never agree despite the fact that this would probably save her parents a ton of money.
HCBM has SD involved in several activities on her custody days. A bit too many for a five year old in my opinion. Multiple gymnastics and dance classes and soccer. Since HCBM’s parents are always funneling her money and paying her bills they are constantly going out to do expensive activities, weekend trips, shows, you name it. HCBM thinks these things make her a good parent, but I personally don’t think that SD feels as emotionally attached to HCBM as she does DH. DH and I spend a ton of one on one time with SD. We play with her with her toys, we do crafts, we watch movies together. HCBM thinks dropping her off at some expensive activity makes her this stellar mom, but she doesn’t engage in the same level of connection with SD that DH does. HCBM’s parents of course bought them a trip to Disney World last year, and the day they came to pick up SD to leave for the airport she did not want to go. She began crying and insisting she wanted her dad to take her, and that she would miss him too much. What five year old objects to effing Disney World??
We have issues on the horizon with SD attending kindergarten next year. I know a battle will ensue about where she attends. The custody schedule does not give us any weekend time because when it was written, SD was one and DH was working weekends and the days they agreed on coincided with his schedule. This means that when SD attends school in the fall five days a week, we will not get a full day together as a family. DH and I are very nervous about addressing this. We don’t have any desire to change the 50/50 custody, just to adjust the days so that we can have some weekend time with SD. It is likely this issue will end up in court and cost us thousands.
I have had to come to the hard acceptance that this is just how our relationship with HCBM will be, likely forever. I hold on to selfish hope that she may screw up drinking again, but at the end of the day I want what is best for SD which is a healthy and stable mother and I will do whatever I can to encourage a positive relationship for them. At this point we have no proof of her drinking for the past few years. Either she miraculously stopped or her family’s response is just so calculated to protect her from getting into any shit and jeopardizing her custody. If that is the case, that can only go on for so long before SD is old enough to tell us what is happening.
I think that HCBM is deeply insecure and ashamed. I think she needs to make DH and I the villains so she feels better about herself. I think her upbringing has allowed her to shirk any and all accountability, she is surrounded by people who tell her she’s never wrong and she’s this great person and great parent.
I don’t know what the resolution is here. If you have read this far, thank you sincerely. Though I confide in my mom and friends about the situation with HCBM, I keep my venting to a minimum so as not to let her live rent free in my life. I am not going to spend all this energy being pissed at her and her immaturity. I’m not going to give her the satisfaction of getting on my nerves, being the subject of my conversations. I’m not even going to let her think I care enough to trash her to people. But it feels extremely therapeutic to get this all out to a group of people who understand.

I just want people to know that the Sonoma County government is corrupt. They spent 186 million dollars on a "new courthouse" that is 163k square feet, which works out to $1,100 per square foot, which is over double the second most expensive building I could find was, and over four times the average price per square foot of palaces and museums. And it's just going to look like a giant portable. This is to house some of the most corrupt people in this County, who all make $200-350+k per year (I am including their benefits in that, but not their pension). The entire DA's Office has a vendetta against Civil Rights in general, and will literally knowingly commit criminal violations of laws for the purpose of covering up serious criminal misconduct on the part of Sonoma County employees.
Lynda Hopkins took money from the law enforcement unions, and turns a willfully blind eye to it.
The County Office of Legal Counsel is literally a crime syndicate.
In 2015, the Sheriff's Office had a veritable torture ring in the jail.

This is just the tip of the iceberg. They lied about the existence of these videos, and "lost" the one where they gave one of the inmates internal bleeding, with a knee to their back.
There was a lawsuit about it. It was called the "Yard Counseling Case". There are news articles about it.
There was an official, written policy, called "Yard Counseling", later its name was changed to "Behavior Counseling" which dictated that for arbitrary punitive measures, Sheriff's Office personnel should extract inmates from their cells individually (which meant slamming their heads onto the door frames on the way out and other abuse), and isolate them, and putting them into "pain compliance" techniques (literally, by definition, torture) for extended periods of time while "counseling" them, which meant wearing no name tags, ski masks and riot gear, carrying a shotgun with them, and insulting them in explicit language for over 20 minutes.
This official written policy was acknowledged by Rob Giordano in a video, where he lies that no inmates where injured, uploaded to YouTube in 2018, when they finally addressed this official written policy, and the practice of torturing inmates without reasonable cause (leading exercise routines, for example).
In 2021, they saw one of the victims of this torture ring, who had sued them and had won, at a peaceful protest, and shot him with a grenade launcher while hiding on a rooftop in the face with a crowd control grenade, which exploded on impact and caused horrific injury that I don't care to describe.
In 2017, I was almost killed by application of a "carotid hold" / lateral vascular neck restraint, by a sheriff's deputy, for literally no reason. A knee was placed on my lower back while I was on the ground on my stomach as well, which caused a serious injury to my kidney, which was the worst injury of my life. I have also been diagnosed with an organic brain injury and cognitive impairment. I was tested for the same type of cognitive impairment before the incident and there is a marked difference, and I have about 30 pages describing the differences I've noticed / troubles I've had in my cognitive functioning. There was no probable cause to arrest me, and I was polite and compliant with all the instructions given to me, and this was confirmed by witnesses. I was punished for invoking my right to remain silent, then my arm was grabbed and yanked up behind me, and then a carotid hold was applied because my body pivoted after the deputy grabbed and yanked my arm.
This occurred UNDER A CAMERA and IN FRONT OF WITNESSES. I called the Sheriff's Office the next day said I want to "make an official complaint in writing". I was transferred to Captain of Internal Affairs, Captain Mark Essick. I repeated my request, verbatim. He responded, verbatim: "We don't do that. Why don't you tell me what happened." I did. I told him it happened right under a camera. He said "The camera can't record." I asked for confirmation. He said the cameras "Don't have recording technology installed."
I asked the County for a claim form. They ignored my request, and instructed me to report the incident to IOLERO. IOLERO requested I meet with Internal Affairs, and I said fine.
Sgt. Andy Cash called me and scheduled me for a meeting at the Sheriff's den. I was made to walk first and guided upstairs to a meeting room, and then patted down for weapons, and the interview was recorded. For 75 minutes I was deposed about happened. He asked me repeatedly about my mental state after the incident. I admitted that I was upset after the incident, and he acted like that justified the whole incident. He explicitly promised to interview the 4 deputies who witnessed the event in addition to the 2 deputies who participated, as well as the arresting officer (who I told him would confirm that I was polite and cooperative), which he agreed "would confirm [my] demeanor", and a bystander witness I told him about.
I complained to IOLERO director Jerry Threet. Mr. Threet agreed that that was inappropriate, then resigned without reviewing the investigation.
For about 4 years review of the investigation was put on hold because IOLERO staff quit, and when more staff was hired, they complained of being understaffed. They had a budget of over a million dollars but only had 2 employees. They only reviewed one case per four months. And they put off "backlogged" cases and focused on new cases. My complaint was finally reviewed by Interim Director Garrick Byers who clearly stated that the investigation was not conducted appropriately. I have the letter from him. That still has never been made public.
After the interview with Internal Affairs, I corresponded with Lynda Hopkins, and she refused to give her opinion on the matter. I specifically complained that the carotid hold was being used recklessly, and it is a dangerous technique. This was in 2018. She forwarded me to Janell Crane, who then had me meet with Kristi Schultz.
I contacted the DA's Office and spoke to Richard Celli (who made $346k in 2017, and has gunned down two unarmed people, and was convicted by a jury in one of the civil cases brought against him by one of the victim's family, but the sentence was overturned by a judge, while working for the SRPD). The first time I spoke to Mr. Celli, he told me that another law enforcement agency should take my case. After that first time, him and the rest of the DA's Office openly refused to comply with the Victims' Rights Laws (CA Con Art. 1 S. 28), and the "policies" (which are legally binding under CA Con Art 5 S. 13) of the Attorney General stating clearly that they are to take complaints from victims if it can't be resolved with the department.
After the first talk with Mr. Celli, I called Rohnert Park Police as I was instructed, and they 3-way called the Sheriff's office and then transferred me. I spent about 30 minutes reporting the incident to a deputy, and he asked me questions in a fair manner. I called RPPD back and talked to the arresting officer and he positively clearly confirmed that I was "polite, calm, compliant, and cooperative" (or something nearly verbatim, I can't remember exactly any more).
Andrew Cash called me the next day, at precisely 7:00 AM. He told me he was driving. He was extremely confrontational with me. He said "There were 6 deputies [referring to the two who used excessive force on me, and 4 witness deputies]. You were combative." This was false. He had only interviewed one of the 4 witness deputies, and the other 3 had provided written statements. They said that they had witnessed force being used, that they had not participated in the use of force to the best of their memory, and that I "did not appear to be resisting". But again, he had promised explicitly to interview the 4 deputy witnesses, and the arresting officer
Internal Affairs exonerated the officers. The letter was signed by Eddie Engram, captain of Internal Affairs. I called Mr. Engram, and had an hour long conversation with him, and he told me to contact Sgt. Cash after April 1st.
I filed a federal claim on the last day that it was due.
Mr. Cash referred me to Legal Counselor, Kara Abelson.
Ms. Abelson spent a year and a half refusing to comply with the Public Records Act, the Rules of Procedure, and the Rules of Professional Conduct. She refused to provide me documents that I was entitled to under law, including the incident report written by Deputies Jacquelin Fazzio and Virgil Smith, and the recorded interviews that he promised he would conduct, and stated pretty clearly that he had conducted.
Kara Abelson spent a year and a half trying to claim that my federal complaint was time barred by 1 day when it wasn't. The judge (Yvonne Gonzalez Rogers) entertained this and forced me to respond SEVEN TIMES, before she finally admitted that the "law wouldn't allow [her] to dismiss my complaint".
After a year and a half, Kara Abelson finally withdrew from the case after I started citing the Rules of Professional Conduct to her that require her to resign or withdraw from the case rather than defend a civil case where defense isn't warranted. Nobody had disputed any of the allegations I had made. In fact, Eddie Engram had confirmed that what I said happened was not disputed by the evidence.
At some point around this time, either before or after Ms. Abelson withdrew, the 2 incident reports written by the two deputies, the written statements by 3 of the 4 witness deputies, and the recorded interviews with me, the 2 deputies who assaulted me, and 1 of the eye witness deputies, were provided, along with various other records from the facility. In the recorded interview, and the incident report, the deputies admitted that Virgil Smith had applied the carotid hold.
I had also reported the incident to the State Attorney General Public Inquiry Unite (Lupe Zinzin). She had told me, over and over and over, that the local DA's are required to take complaints from civilians in these situations. She refused to call the DA's Office, though. The DA's Office (Richard Celli, Mark Azzouni, David Kahl) refused to take a complaint from me. They (including the receptionists) hung up on me every time I called after no more than 2 minutes, for no reason, transferred me to dead lines, never returned any voicemails I managed to leave, told me explicitly that if I send a complaint, they will throw it away, and didn't care, at all, what the laws were. The receptionists also refuse to provide their names. The Attorney General's Office told me to send them a complaint, so I did. The DA's Office acknowledged receiving the complaint. But later said that they did not have a record of it, meaning they threw it away.
The Attorney General's Office finally agreed to take a complaint from me. It sat on their desk for a year. I finally called them, concerned that evidence was being destroyed, and left a voicemail for Casey Hallinan requesting that they request copies of the physical evidence from the Sheriff's Office. Literally 2 days after that voicemail, a letter was sent to me signed by Sharon Loughner with Casey Hallinan CC'ed on the letter, stating that they would "take no action", and blamed the incident on me. I had not received the letter though, and called and spoke to Ms. Hallinan, who was extremely rude. After that, the Attorney General's Office hang up on me as soon as they find out it's me, for no reason. There has since been a bystander witness who saw the whole thing, and it has come to light that the cameras did record, that no upgrades were ever performed like Ms. Abelson alleged, the cameras do continuously record (as of 2019), and they just lied through their teeth about the camera for 4 straight years. The Attorney General's Office does not care. They violate the laws, and do not care what the laws are.
Sonoma County Office of Legal Counsel attorney Michael King took over after Ms. Abelson withdrew. Right off the bat, Mr. King told me that my motions were deficient - a contention he has repeated frequently, since then. I asked him how. He changed the subject, and to this day has NEVER given any explanation as to how any of my motions are deficient.
He continued to claim that my claim was time barred, filing frivolous motions, in blatant violation of the rules of professional conduct, after I cited the rules to him, constituting explicit legal misconduct.
As I said, the judge finally agreed to open Discovery after a year and a half of full time work trying to fight for my right to not be nearly murdered for no reason.
Lawyers do not take these cases unless there is undeniable proof of blatant guilt, along with undeniable proof of catastrophic injury. Multiple law firms have confirmed that it takes over a million dollars worth of legal work to get these cases to trial.
The judge also promised me a pro bono attorney "if you make it past summary judgment".
The judge scheduled us for Alternative Dispute Resolution hearing with a magistrate judge. Mr. King elicited an offer from me, which I spent about 2 weeks working on, trying to make it as agreeable as possible. But then for the hearing, his written offer was to waive charging me his attorneys fees. The judge confirmed that there was no legal basis for him to do that - it would be illegal. He had been ordered to participate in this hearing, and there was a legal obligation under the Rules of Procedure to try in good faith to settle the case. He violated the order and the rule of procedure (26 (f)).
All of my motions were completely ignored for no reason.
Mr. King / Defendant Virgil Smith lied about the cameras. They said "Denies the existence of cameras capable of recording in the vicinity", in writing, under oath. They never disputed that he put his knee on top of my back with all his weight on it.
Mr. King refused to comply with his Discovery obligations. I had to file about 4 different motions pertaining to their refusal to comply with the laws regarding disclosure of evidence.
Upon receiving an official Discovery request for records of camera equipment, I received a letter signed under by Mr. King (nearly 4 years after the incident) stating that the cameras CAN RECORD. But stating "tasks must be performed" to start the recording function, and stating that all records pertaining to the equipment that was installed at the time HAD BEEN DESTROYED (literally a federal and state crime, a civil tort violation, and a sanctionable act of legal misconduct).
Mr. King refused to schedule any of the witnesses for deposition, demanded MY deposition BEFORE he would even schedule the two deputies who assaulted me, even though I had been requesting depositions with other witnesses for over a month, and refused to schedule anyone else, he refused to answer interrogatories, he refused to provide copies of the policies from the time of the incident. He tried to pass off a weird spreadsheet with the word camera on it as proof that upgrades had been done to the cameras. He refused to provide complete training records for the deputies. He refused to provide details about the training. He refused to provide blueprints of the facility, refused to provide photos of the cameras at the location, refused to provide still images showing which direction the cameras were pointing, refused to provide photos of the deputies so I could schedule depositions efficiently.
The judge erroneously dismissed my Equal Protection claims, construing them as Due Process and Employment Discrimination claims, which are different types of claims than Equal Protection claims against a government actor. The government cannot arbitrarily treat anyone disparately. The Court also dismissed my "Monell" claim against the municipality for their "policies, customs, or practices", but left me leave to amend that claim. And she waited until Discovery opened over 1.5 years into litigation, to do this, forcing me to amend the complaint DURING DISCOVERY which was only open for a limited amount of time, instead of any point in the 1.5 years prior to that.
In the recorded interview with Andrew Cash and one of the witness deputies, she spontaneously states that Mr. Cash instructed her to review the written statements made by the two deputies who assaulted me prior to the interview. Another deputy witness confirmed that Mr. Cash had instructed her to review the written reports by the two deputies who assaulted me prior to her providing Mr. Cash with a written statement as well.
The judge finally retaliated against me, without rational basis, for filing motions, which I had filed because I was being illegally obstructed from preserving evidence, by withdrawing leave to amend regarding the "Monell" claim (I had stated a clear Monell claim to begin with, but the judge literally has an aversion to reading, and relies on guessing, and is biased against pro se litigants; I am summarizing well over 100 pages, if not well over double that, of motions, objections, and replies and the judge's responsive orders).
She did however, finally schedule a hearing with a Discovery referee magistrate. All my motions (and the months of work I was required to do dictated by the various rules) was completely disregarded, and both me and Mr. King were given 2 pages each (double spaced) to go over discovery issues, even though I had filed about 4 different motions about various issues, and he hadn't filed ANY, at that time.
During conference I was required to do in accordance with the Rules, Mr. King repeatedly tried to establish that I had committed crimes during the course of conferring which was my legal obligation, without having any rational basis to believe what he was trying to establish. He demanded evidence that would exist, and he kept repeating every lie he could come up with to the judge. The judge would either get annoyed at me if I addressed any of Mr. King's baseless accusations, or take his statements at face value for being 100% true.
Mr. King finally "compromised" and agreed to schedule depositions with me (as long as Mr. King wanted to) and the two deputies who had assaulted me (for 25 minutes each or something) all simultaneously, but refused to schedule anyone else, even though this was grossly advantageous to him. One of the eye witness deputies later confirmed that he had "consulted" her over 4 times prior to the trial. During this deposition, Mr. King asked me where a family member of mine works. He had spent about 30-40 minutes trying to convince me that I can tell him anything, that the entire record was designated confidential, that I had nothing to worry about - and at a deposition, you are obligated to answer the questions unless they are harassing. Mr. King also requested contact information for counselors from over 10 years ago, and that was the only question I didn't answer - I told him to provide the request in writing. At some point after that, I told Mr. King to not contact my family member at her workplace, and Mr. King responded "unless you fully and completely cooperate" with his request for contact information for counselors from 10 years+ ago.
At the hearing, the Discovery Magistrate (Donna M. Ryu) discussed matters only with Mr. King, without including me. He told her that the 4 eye witness deputies "saw nothing" and "weren't there" (verbatim) trying to get her to deny me my request to take their deposition. She asked him if he would get them to sign fresh "sworn declarations", "under oath" (Judge Ryu's words, verbatim) stating this. Mr. King said yes, absolutely, he would. Judge Ryu asked me "Would that be okay?" I said "No." She started laughing, and asked me why, and I explained that I had explicitly described various interactions with them that had taken place while the carotid hold was still being applied to me, and that they had stated in their written statements that they had witnessed force being used, and that was "not resisting". She confirmed that this was all true with Mr. King and that he already knew all of this, and ordered him to cooperate with scheduling them for deposition.
After that, they went back to discussing matters only with eachother, and I was excluded from discussion. This was an hour long hearing, and at about the 45 minute mark, Mr. King was again lying to the magistrate judge, and when he had finished, I interjected, "That's not true". Judge Ryu shouted "Stop! Stop stop stop stop stop!" And then very assertively explained to me the importance of not interrupting people for the convenience of the court reporter / transcriber. I was excluded from the rest of the hearing.
At some point at either this hearing or the next one, I cited the legal requirement for the parties to disclose contact information for witnesses. I cited the rule of procedure. Judge Ryu responded, "Mr. King is a lawyer!" as if that alone justified his refusal to provide me contact information for witnesses.
Mr. King refused to provide both written statements from the eye witness deputies, and to schedule them for deposition, and stated that if he provided written statements, they would be copied and pasted versions of the same statements previously provided, signed under oath (nowhere saying that they "saw nothing" or "weren't there").
Mr. King kept threatening to go to my family member's workplace unless I provided him contact information for counselors from 10+ years ago, DURING a DEPOSITION, without him providing any written request for the information.
He also interfered with scheduling the witnesses for deposition, with the Court reporter that I had hired, disregarded the schedule that I had set, and set them each for 30 minutes, which raised the cost of deposition from an estimated about $700 to about $4,000, and said this was my one and only chance.
The Federal Pro Bono Project / the Justice & Diversity Center is an organization that receives seven million dollars a year in public funding and is under contract with the Federal District Court to work with the Court to provide legal consultation to pro se litigants. I had about 19 appointments with them, about 18 with Abby Herzberg, and 1 with Rosemarie Maliekel. Ms. Herzberg was precisely 15 minutes late to every single appointment, repeatedly gave me horrible advice ("just wait", do nothing, "don't file this", despite admitting that the entire motion was valid, directly causing excessive delay and the spoliation of crucial evidence). She also yelled at me aggressively on two occasions because I had brought up state laws, which were being currently violated against me, because the Court had dismissed my "state claims" because Sonoma County refused to supply with a state tort claim form when I first asked, reasoning that was not relevant to the state laws being currently violated against me. After Ms. Herzberg yelled at me the second time, I requested an appointment with Ms. Maliekel. Ms. Maliekel spent the entire appointment ranting at me about irrelevant issues, and kept talking over me and interrupting me. I was polite but eventually asked "can I finish what I was saying?" She responded "No!" and kept ranting at me.
I had repeatedly asked about how to properly get medical evidence, and about expert witnesses. Ms. Herzberg ignored my questions and spent nearly the entirety of almost every single appointment reading through the rules, without letting me speak at all, even to summarize the relevant sections of the rules that I had read.
On a video on their webpage (on the Court's website, because they are a "partner project" with the Court), Abby Herzberg explicitly demonstrates a clear understanding of the fact that the Court provides funding for expert witnesses, despite ignoring my questions about and spending nearly the entirety of almost every single appointment either reading rules or pretending to.
Discovery was closed.
Mr. King rehashed the legally baseless and frivolous "time barred" claim in a Motion for Summary Judgment. I was required to respond to it twice. I was required to answer all his "undisputed material facts" under threat of terminating my entire case, but he refused to answer mine. He lied over and over to the judges. As I said, the judge ruled that the laws "wouldn't allow her to" dismiss my entire case and rejected his Motion for Summary Judgement.
The Court ordered the Federal Pro Bono Project (FPBP) to put me on a list for attorneys seeking clients. Ms. Herzberg told me that if I filed any motions, that the FPBP would not cooperate with the Court's order, until 1 month before my trial, instead of 6 months before. She also said that a law firm had reached out to them about my case over a month prior to that, and that the staff at the FPBP had not followed up. My filing privileges were then revoked by the Court.
An attorney, David Ratner, reached out to me, and scheduled an initial consultation, over Zoom, at which he stated he "hates cops", and gave a showing of being enthusiastic. I explicitly told him that I wanted to make sure we were on the same page as far as what to "aim for". I told him that I had been working for FIVE YEARS, that I had almost died, that I had suffered two different extremely serious injuries. I told him that what I asked for was consistent with the most similar case (the Esa Wroth case of 2013) that I knew of (an ask of three million dollars). This was coincidental. I was not aware of the Esa Wroth case when I came up with that number. I agonized over that, and spent a lot of time trying to come up with a fair amount, and described the methods I used to come up with that number in detail in court documents. Mr. Ratner explicitly agreed to aim for that.
Mr. Ratner, and his partner, Shelley Mollineaux, who was set to represent me at trial under Mr. Ratner's supervision, then both went dark for over a month. They ignored my emails, voicemails, and messages that I left with their receptionists. There was a hearing, and then Mr. Ratner emailed me demanding "all the documents" that I had. I had over 50 gb of files across thousands of files, and spent about a month working with his paralegals sending them batches of files, and providing all the information they asked me for. Mr. Ratner forwarded me an email from Mr. King where King accused me of violating a court order regarding providing medical providers and the physical addresses of my entire family and my friends, which was false -- the Court had ordered me to provide him CONTACT information, at a second hearing, which wasn't significant, and I had fully and completely complied in good faith with all the Court's orders. Mr. Ratner accused me of not sending him "anything", after I had spent at least several weeks with his paralegals sending them batches of files and information, and he simultaneously threatened to ask the judge for leave to withdraw.
There had been major delays with medical evaluation due in large part to Covid, as well as delayed discovery of brain injury, which is very common, and other factors.
With trial set, Mr. Ratner forwarded me an offer from Defendants for $5,000. Upon discussion (which was 100% in email because he refused to talk over the phone and Ms. Mollineaux completely ignored me), he accused me of not doing Discovery right. I pointed him to the video I referred to earlier, which I had found since Mr. Ratner took my case, but wasn't aware of when I was interacting with the FPBP, where the FPBP (Abby Herzberg), and various District Judges from the Court I was litigating in, state that it is general policy (and it is official policy under the Court's General Order 25) to REOPEN DISCOVERY when a pro bono attorney comes onto the case, and to FUND DEPOSITION AND EXPERT WITNESS FEES.
Mr. Ratner stated he "won't file any motions" and ultimately elected to withdraw from the case over fulfill his legal obligations under the Rules of Professional Conduct. The Court thanked him and granted him permission to withdraw. The FPBP refused to put me back on the list. I was forced into trial BY MYSELF, at 1-2 months prior to trial, after 2-3 months of my time being completely wasted by Mr. Ratner and his law firm.
I went through the appropriate legal process to submit an expert witness. The Court, as usual, completely ignored my motions, but allowed me to use him after I went through the entire legal process, and paid him thousands of dollars without knowing if I would be granted permission or not, and provided the Court a report stating that the carotid hold was ILLEGAL unless the subject exhibited "assaultive behavior" and that Defendants had never alleged any behavior of mine that constituted "assaultive behavior" (under POST Basic). The expert was a Master level instructor at a police academy and former SWAT.
Mr. King provided his pre-trial disclosures, and it contained a document from Rohnert Park police department which had been extensively redacted on the copy that they had provided to me. The new copy contained the contact information for the bystander witness. I called him, and he confirmed that he saw the entire thing, that I had never yelled at the deputies before the first deputy grabbed my arm, and that I was not resisting at any point in time. I told the judge this. She had me call him at a hearing, and both me and Mr. King were allowed a couple of minutes to ask him questions, where he refused to admit that I was even "wiggling" when Mr. King badgered him.
The judge then refused to allow him to appear over Zoom, and refused to summon him to the trial.
At the trial, the Judge accused me falsely of firing my attorney, and explicitly prohibited me from telling the jury that the Defendants had LIED about the camera's ability to record. She explicitly prohibited me from submitting scientific evidence about the carotid hold. She allowed Mr. King to make extremely defamatory false remarks about me and my past which had a huge impact on the jury's perception of things. At a pretrial hearing, we had gone over about 110 documents that I wanted to present at the trial. She vetted about 40 as admissible at the hearing, but at the trial she only let me submit about 5. Defendants were allowed to submit a SECOND expert witness, both of whom worked for the Sonoma County Sheriff's Office. The first was Andrew Cash. The second was James Naugle who had been disclosed literally a week before trial, without a report, and without allowing me to take his deposition. She refused to allow me to ask Mr. Naugle about case laws, or about information pertaining to the carotid hold. The Court refused to summon any of my treating physicians, whom I had provided the names and contact information for in my disclosures at the end of Discovery and some in my initial disclosures, and I had complied with Mr. King's written requests for information or objected within the boundaries of the law, in good faith, and complied with the Court's orders, in good faith.
I had informed the Court that I was scheduled for medical evaluations for brain injury AFTER THE TRIAL. The Court completely ignored this.
So it was my word against theirs. 5 years, at the time of the mistrial, to get a mockery of a trial, and have the jurors' time completely wasted. The jury wrote me a letter thanking me or something, but awarded me nothing.
I was diagnosed with organic brain injury after the trial. I had a similar test prior to the incident and had absolutely no problems and answered every question with no trouble. I now score in the FOURTH PERCENTILE on those areas.
Despite its length, this has been a short summary of all the events over the past 6 years. Much has been summarized, and much has been left out. I tried my best to balance completeness with leaving out irrelevant details.
There is no record of any misconduct on the part of anyone involved in this that is available to any law enforcement agencies or to the public. Nobody has been disciplined. No investigation was ever conducted. I was almost killed and was seriously injured, under a camera, and in front of witnesses, and spent 6 years working with the government. The government has done precisely NOTHING.
The County now routinely retaliates against me whenever we interact, in blatant violation of various laws.

I just want people to know that the Sonoma County government is corrupt. They spent 186 million dollars on a "new courthouse" that is 163k square feet, which works out to $1,100 per square foot, which is over double the second most expensive building I could find was, and over four times the average price per square foot of palaces and museums. And it's just going to look like a giant portable. This is to house some of the most corrupt people in this County, who all make $200-350+k per year (I am including their benefits in that, but not their pension). The entire DA's Office has a vendetta against Civil Rights in general, and will literally knowingly commit criminal violations of laws for the purpose of covering up serious criminal misconduct on the part of Sonoma County employees.
Lynda Hopkins took money from the law enforcement unions, and turns a willfully blind eye to it.
The County Office of Legal Counsel is literally a crime syndicate.
In 2015, the Sheriff's Office had a veritable torture ring in the jail.

This is just the tip of the iceberg. They lied about the existence of these videos, and "lost" the one where they gave one of the inmates internal bleeding, with a knee to their back.
There was a lawsuit about it. It was called the "Yard Counseling Case". There are news articles about it.
There was an official, written policy, called "Yard Counseling", later its name was changed to "Behavior Counseling" which dictated that for arbitrary punitive measures, Sheriff's Office personnel should extract inmates from their cells individually (which meant slamming their heads onto the door frames on the way out and other abuse), and isolate them, and putting them into "pain compliance" techniques (literally, by definition, torture) for extended periods of time while "counseling" them, which meant wearing no name tags, ski masks and riot gear, carrying a shotgun with them, and insulting them in explicit language for over 20 minutes.
This official written policy was acknowledged by Rob Giordano in a video, where he lies that no inmates where injured, uploaded to YouTube in 2018, when they finally addressed this official written policy, and the practice of torturing inmates without reasonable cause (leading exercise routines, for example).
In 2021, they saw one of the victims of this torture ring, who had sued them and had won, at a peaceful protest, and shot him with a grenade launcher while hiding on a rooftop in the face with a crowd control grenade, which exploded on impact and caused horrific injury that I don't care to describe.
In 2017, I was almost killed by application of a "carotid hold" / lateral vascular neck restraint, by a sheriff's deputy, for literally no reason. A knee was placed on my lower back while I was on the ground on my stomach as well, which caused a serious injury to my kidney, which was the worst injury of my life. I have also been diagnosed with an organic brain injury and cognitive impairment. I was tested for the same type of cognitive impairment before the incident and there is a marked difference, and I have about 30 pages describing the differences I've noticed / troubles I've had in my cognitive functioning. There was no probable cause to arrest me, and I was polite and compliant with all the instructions given to me, and this was confirmed by witnesses. I was punished for invoking my right to remain silent, then my arm was grabbed and yanked up behind me, and then a carotid hold was applied because my body pivoted after the deputy grabbed and yanked my arm.
This occurred UNDER A CAMERA and IN FRONT OF WITNESSES. I called the Sheriff's Office the next day said I want to "make an official complaint in writing". I was transferred to Captain of Internal Affairs, Captain Mark Essick. I repeated my request, verbatim. He responded, verbatim: "We don't do that. Why don't you tell me what happened." I did. I told him it happened right under a camera. He said "The camera can't record." I asked for confirmation. He said the cameras "Don't have recording technology installed."
I asked the County for a claim form. They ignored my request, and instructed me to report the incident to IOLERO. IOLERO requested I meet with Internal Affairs, and I said fine.
Sgt. Andy Cash called me and scheduled me for a meeting at the Sheriff's den. I was made to walk first and guided upstairs to a meeting room, and then patted down for weapons, and the interview was recorded. For 75 minutes I was deposed about happened. He asked me repeatedly about my mental state after the incident. I admitted that I was upset after the incident, and he acted like that justified the whole incident. He explicitly promised to interview the 4 deputies who witnessed the event in addition to the 2 deputies who participated, as well as the arresting officer (who I told him would confirm that I was polite and cooperative), which he agreed "would confirm [my] demeanor", and a bystander witness I told him about.
I complained to IOLERO director Jerry Threet. Mr. Threet agreed that that was inappropriate, then resigned without reviewing the investigation.
For about 4 years review of the investigation was put on hold because IOLERO staff quit, and when more staff was hired, they complained of being understaffed. They had a budget of over a million dollars but only had 2 employees. They only reviewed one case per four months. And they put off "backlogged" cases and focused on new cases. My complaint was finally reviewed by Interim Director Garrick Byers who clearly stated that the investigation was not conducted appropriately. I have the letter from him. That still has never been made public.
After the interview with Internal Affairs, I corresponded with Lynda Hopkins, and she refused to give her opinion on the matter. I specifically complained that the carotid hold was being used recklessly, and it is a dangerous technique. This was in 2018. She forwarded me to Janell Crane, who then had me meet with Kristi Schultz.
I contacted the DA's Office and spoke to Richard Celli (who made $346k in 2017, and has gunned down two unarmed people, and was convicted by a jury in one of the civil cases brought against him by one of the victim's family, but the sentence was overturned by a judge, while working for the SRPD). The first time I spoke to Mr. Celli, he told me that another law enforcement agency should take my case. After that first time, him and the rest of the DA's Office openly refused to comply with the Victims' Rights Laws (CA Con Art. 1 S. 28), and the "policies" (which are legally binding under CA Con Art 5 S. 13) of the Attorney General stating clearly that they are to take complaints from victims if it can't be resolved with the department.
After the first talk with Mr. Celli, I called Rohnert Park Police as I was instructed, and they 3-way called the Sheriff's office and then transferred me. I spent about 30 minutes reporting the incident to a deputy, and he asked me questions in a fair manner. I called RPPD back and talked to the arresting officer and he positively clearly confirmed that I was "polite, calm, compliant, and cooperative" (or something nearly verbatim, I can't remember exactly any more).
Andrew Cash called me the next day, at precisely 7:00 AM. He told me he was driving. He was extremely confrontational with me. He said "There were 6 deputies [referring to the two who used excessive force on me, and 4 witness deputies]. You were combative." This was false. He had only interviewed one of the 4 witness deputies, and the other 3 had provided written statements. They said that they had witnessed force being used, that they had not participated in the use of force to the best of their memory, and that I "did not appear to be resisting". But again, he had promised explicitly to interview the 4 deputy witnesses, and the arresting officer
Internal Affairs exonerated the officers. The letter was signed by Eddie Engram, captain of Internal Affairs. I called Mr. Engram, and had an hour long conversation with him, and he told me to contact Sgt. Cash after April 1st.
I filed a federal claim on the last day that it was due.
Mr. Cash referred me to Legal Counselor, Kara Abelson.
Ms. Abelson spent a year and a half refusing to comply with the Public Records Act, the Rules of Procedure, and the Rules of Professional Conduct. She refused to provide me documents that I was entitled to under law, including the incident report written by Deputies Jacquelin Fazzio and Virgil Smith, and the recorded interviews that he promised he would conduct, and stated pretty clearly that he had conducted.
Kara Abelson spent a year and a half trying to claim that my federal complaint was time barred by 1 day when it wasn't. The judge (Yvonne Gonzalez Rogers) entertained this and forced me to respond SEVEN TIMES, before she finally admitted that the "law wouldn't allow [her] to dismiss my complaint".
After a year and a half, Kara Abelson finally withdrew from the case after I started citing the Rules of Professional Conduct to her that require her to resign or withdraw from the case rather than defend a civil case where defense isn't warranted. Nobody had disputed any of the allegations I had made. In fact, Eddie Engram had confirmed that what I said happened was not disputed by the evidence.
At some point around this time, either before or after Ms. Abelson withdrew, the 2 incident reports written by the two deputies, the written statements by 3 of the 4 witness deputies, and the recorded interviews with me, the 2 deputies who assaulted me, and 1 of the eye witness deputies, were provided, along with various other records from the facility. In the recorded interview, and the incident report, the deputies admitted that Virgil Smith had applied the carotid hold.
I had also reported the incident to the State Attorney General Public Inquiry Unite (Lupe Zinzin). She had told me, over and over and over, that the local DA's are required to take complaints from civilians in these situations. She refused to call the DA's Office, though. The DA's Office (Richard Celli, Mark Azzouni, David Kahl) refused to take a complaint from me. They (including the receptionists) hung up on me every time I called after no more than 2 minutes, for no reason, transferred me to dead lines, never returned any voicemails I managed to leave, told me explicitly that if I send a complaint, they will throw it away, and didn't care, at all, what the laws were. The receptionists also refuse to provide their names. The Attorney General's Office told me to send them a complaint, so I did. The DA's Office acknowledged receiving the complaint. But later said that they did not have a record of it, meaning they threw it away.
The Attorney General's Office finally agreed to take a complaint from me. It sat on their desk for a year. I finally called them, concerned that evidence was being destroyed, and left a voicemail for Casey Hallinan requesting that they request copies of the physical evidence from the Sheriff's Office. Literally 2 days after that voicemail, a letter was sent to me signed by Sharon Loughner with Casey Hallinan CC'ed on the letter, stating that they would "take no action", and blamed the incident on me. I had not received the letter though, and called and spoke to Ms. Hallinan, who was extremely rude. After that, the Attorney General's Office hang up on me as soon as they find out it's me, for no reason. There has since been a bystander witness who saw the whole thing, and it has come to light that the cameras did record, that no upgrades were ever performed like Ms. Abelson alleged, the cameras do continuously record (as of 2019), and they just lied through their teeth about the camera for 4 straight years. The Attorney General's Office does not care. They violate the laws, and do not care what the laws are.
Sonoma County Office of Legal Counsel attorney Michael King took over after Ms. Abelson withdrew. Right off the bat, Mr. King told me that my motions were deficient - a contention he has repeated frequently, since then. I asked him how. He changed the subject, and to this day has NEVER given any explanation as to how any of my motions are deficient.
He continued to claim that my claim was time barred, filing frivolous motions, in blatant violation of the rules of professional conduct, after I cited the rules to him, constituting explicit legal misconduct.
As I said, the judge finally agreed to open Discovery after a year and a half of full time work trying to fight for my right to not be nearly murdered for no reason.
Lawyers do not take these cases unless there is undeniable proof of blatant guilt, along with undeniable proof of catastrophic injury. Multiple law firms have confirmed that it takes over a million dollars worth of legal work to get these cases to trial.
The judge also promised me a pro bono attorney "if you make it past summary judgment".
The judge scheduled us for Alternative Dispute Resolution hearing with a magistrate judge. Mr. King elicited an offer from me, which I spent about 2 weeks working on, trying to make it as agreeable as possible. But then for the hearing, his written offer was to waive charging me his attorneys fees. The judge confirmed that there was no legal basis for him to do that - it would be illegal. He had been ordered to participate in this hearing, and there was a legal obligation under the Rules of Procedure to try in good faith to settle the case. He violated the order and the rule of procedure (26 (f)).
All of my motions were completely ignored for no reason.
Mr. King / Defendant Virgil Smith lied about the cameras. They said "Denies the existence of cameras capable of recording in the vicinity", in writing, under oath. They never disputed that he put his knee on top of my back with all his weight on it.
Mr. King refused to comply with his Discovery obligations. I had to file about 4 different motions pertaining to their refusal to comply with the laws regarding disclosure of evidence.
Upon receiving an official Discovery request for records of camera equipment, I received a letter signed under by Mr. King (nearly 4 years after the incident) stating that the cameras CAN RECORD. But stating "tasks must be performed" to start the recording function, and stating that all records pertaining to the equipment that was installed at the time HAD BEEN DESTROYED (literally a federal and state crime, a civil tort violation, and a sanctionable act of legal misconduct).
Mr. King refused to schedule any of the witnesses for deposition, demanded MY deposition BEFORE he would even schedule the two deputies who assaulted me, even though I had been requesting depositions with other witnesses for over a month, and refused to schedule anyone else, he refused to answer interrogatories, he refused to provide copies of the policies from the time of the incident. He tried to pass off a weird spreadsheet with the word camera on it as proof that upgrades had been done to the cameras. He refused to provide complete training records for the deputies. He refused to provide details about the training. He refused to provide blueprints of the facility, refused to provide photos of the cameras at the location, refused to provide still images showing which direction the cameras were pointing, refused to provide photos of the deputies so I could schedule depositions efficiently.
The judge erroneously dismissed my Equal Protection claims, construing them as Due Process and Employment Discrimination claims, which are different types of claims than Equal Protection claims against a government actor. The government cannot arbitrarily treat anyone disparately. The Court also dismissed my "Monell" claim against the municipality for their "policies, customs, or practices", but left me leave to amend that claim. And she waited until Discovery opened over 1.5 years into litigation, to do this, forcing me to amend the complaint DURING DISCOVERY which was only open for a limited amount of time, instead of any point in the 1.5 years prior to that.
In the recorded interview with Andrew Cash and one of the witness deputies, she spontaneously states that Mr. Cash instructed her to review the written statements made by the two deputies who assaulted me prior to the interview. Another deputy witness confirmed that Mr. Cash had instructed her to review the written reports by the two deputies who assaulted me prior to her providing Mr. Cash with a written statement as well.
The judge finally retaliated against me, without rational basis, for filing motions, which I had filed because I was being illegally obstructed from preserving evidence, by withdrawing leave to amend regarding the "Monell" claim (I had stated a clear Monell claim to begin with, but the judge literally has an aversion to reading, and relies on guessing, and is biased against pro se litigants; I am summarizing well over 100 pages, if not well over double that, of motions, objections, and replies and the judge's responsive orders).
She did however, finally schedule a hearing with a Discovery referee magistrate. All my motions (and the months of work I was required to do dictated by the various rules) was completely disregarded, and both me and Mr. King were given 2 pages each (double spaced) to go over discovery issues, even though I had filed about 4 different motions about various issues, and he hadn't filed ANY, at that time.
During conference I was required to do in accordance with the Rules, Mr. King repeatedly tried to establish that I had committed crimes during the course of conferring which was my legal obligation, without having any rational basis to believe what he was trying to establish. He demanded evidence that would exist, and he kept repeating every lie he could come up with to the judge. The judge would either get annoyed at me if I addressed any of Mr. King's baseless accusations, or take his statements at face value for being 100% true.
Mr. King finally "compromised" and agreed to schedule depositions with me (as long as Mr. King wanted to) and the two deputies who had assaulted me (for 25 minutes each or something) all simultaneously, but refused to schedule anyone else, even though this was grossly advantageous to him. One of the eye witness deputies later confirmed that he had "consulted" her over 4 times prior to the trial. During this deposition, Mr. King asked me where a family member of mine works. He had spent about 30-40 minutes trying to convince me that I can tell him anything, that the entire record was designated confidential, that I had nothing to worry about - and at a deposition, you are obligated to answer the questions unless they are harassing. Mr. King also requested contact information for counselors from over 10 years ago, and that was the only question I didn't answer - I told him to provide the request in writing. At some point after that, I told Mr. King to not contact my family member at her workplace, and Mr. King responded "unless you fully and completely cooperate" with his request for contact information for counselors from 10 years+ ago.
At the hearing, the Discovery Magistrate (Donna M. Ryu) discussed matters only with Mr. King, without including me. He told her that the 4 eye witness deputies "saw nothing" and "weren't there" (verbatim) trying to get her to deny me my request to take their deposition. She asked him if he would get them to sign fresh "sworn declarations", "under oath" (Judge Ryu's words, verbatim) stating this. Mr. King said yes, absolutely, he would. Judge Ryu asked me "Would that be okay?" I said "No." She started laughing, and asked me why, and I explained that I had explicitly described various interactions with them that had taken place while the carotid hold was still being applied to me, and that they had stated in their written statements that they had witnessed force being used, and that was "not resisting". She confirmed that this was all true with Mr. King and that he already knew all of this, and ordered him to cooperate with scheduling them for deposition.
After that, they went back to discussing matters only with eachother, and I was excluded from discussion. This was an hour long hearing, and at about the 45 minute mark, Mr. King was again lying to the magistrate judge, and when he had finished, I interjected, "That's not true". Judge Ryu shouted "Stop! Stop stop stop stop stop!" And then very assertively explained to me the importance of not interrupting people for the convenience of the court reporter / transcriber. I was excluded from the rest of the hearing.
At some point at either this hearing or the next one, I cited the legal requirement for the parties to disclose contact information for witnesses. I cited the rule of procedure. Judge Ryu responded, "Mr. King is a lawyer!" as if that alone justified his refusal to provide me contact information for witnesses.
Mr. King refused to provide both written statements from the eye witness deputies, and to schedule them for deposition, and stated that if he provided written statements, they would be copied and pasted versions of the same statements previously provided, signed under oath (nowhere saying that they "saw nothing" or "weren't there").
Mr. King kept threatening to go to my family member's workplace unless I provided him contact information for counselors from 10+ years ago, DURING a DEPOSITION, without him providing any written request for the information.
He also interfered with scheduling the witnesses for deposition, with the Court reporter that I had hired, disregarded the schedule that I had set, and set them each for 30 minutes, which raised the cost of deposition from an estimated about $700 to about $4,000, and said this was my one and only chance.
The Federal Pro Bono Project / the Justice & Diversity Center is an organization that receives seven million dollars a year in public funding and is under contract with the Federal District Court to work with the Court to provide legal consultation to pro se litigants. I had about 19 appointments with them, about 18 with Abby Herzberg, and 1 with Rosemarie Maliekel. Ms. Herzberg was precisely 15 minutes late to every single appointment, repeatedly gave me horrible advice ("just wait", do nothing, "don't file this", despite admitting that the entire motion was valid, directly causing excessive delay and the spoliation of crucial evidence). She also yelled at me aggressively on two occasions because I had brought up state laws, which were being currently violated against me, because the Court had dismissed my "state claims" because Sonoma County refused to supply with a state tort claim form when I first asked, reasoning that was not relevant to the state laws being currently violated against me. After Ms. Herzberg yelled at me the second time, I requested an appointment with Ms. Maliekel. Ms. Maliekel spent the entire appointment ranting at me about irrelevant issues, and kept talking over me and interrupting me. I was polite but eventually asked "can I finish what I was saying?" She responded "No!" and kept ranting at me.
I had repeatedly asked about how to properly get medical evidence, and about expert witnesses. Ms. Herzberg ignored my questions and spent nearly the entirety of almost every single appointment reading through the rules, without letting me speak at all, even to summarize the relevant sections of the rules that I had read.
On a video on their webpage (on the Court's website, because they are a "partner project" with the Court), Abby Herzberg explicitly demonstrates a clear understanding of the fact that the Court provides funding for expert witnesses, despite ignoring my questions about and spending nearly the entirety of almost every single appointment either reading rules or pretending to.
Discovery was closed.
Mr. King rehashed the legally baseless and frivolous "time barred" claim in a Motion for Summary Judgment. I was required to respond to it twice. I was required to answer all his "undisputed material facts" under threat of terminating my entire case, but he refused to answer mine. He lied over and over to the judges. As I said, the judge ruled that the laws "wouldn't allow her to" dismiss my entire case and rejected his Motion for Summary Judgement.
The Court ordered the Federal Pro Bono Project (FPBP) to put me on a list for attorneys seeking clients. Ms. Herzberg told me that if I filed any motions, that the FPBP would not cooperate with the Court's order, until 1 month before my trial, instead of 6 months before. She also said that a law firm had reached out to them about my case over a month prior to that, and that the staff at the FPBP had not followed up. My filing privileges were then revoked by the Court.
An attorney, David Ratner, reached out to me, and scheduled an initial consultation, over Zoom, at which he stated he "hates cops", and gave a showing of being enthusiastic. I explicitly told him that I wanted to make sure we were on the same page as far as what to "aim for". I told him that I had been working for FIVE YEARS, that I had almost died, that I had suffered two different extremely serious injuries. I told him that what I asked for was consistent with the most similar case (the Esa Wroth case of 2013) that I knew of (an ask of three million dollars). This was coincidental. I was not aware of the Esa Wroth case when I came up with that number. I agonized over that, and spent a lot of time trying to come up with a fair amount, and described the methods I used to come up with that number in detail in court documents. Mr. Ratner explicitly agreed to aim for that.
Mr. Ratner, and his partner, Shelley Mollineaux, who was set to represent me at trial under Mr. Ratner's supervision, then both went dark for over a month. They ignored my emails, voicemails, and messages that I left with their receptionists. There was a hearing, and then Mr. Ratner emailed me demanding "all the documents" that I had. I had over 50 gb of files across thousands of files, and spent about a month working with his paralegals sending them batches of files, and providing all the information they asked me for. Mr. Ratner forwarded me an email from Mr. King where King accused me of violating a court order regarding providing medical providers and the physical addresses of my entire family and my friends, which was false -- the Court had ordered me to provide him CONTACT information, at a second hearing, which wasn't significant, and I had fully and completely complied in good faith with all the Court's orders. Mr. Ratner accused me of not sending him "anything", after I had spent at least several weeks with his paralegals sending them batches of files and information, and he simultaneously threatened to ask the judge for leave to withdraw.
There had been major delays with medical evaluation due in large part to Covid, as well as delayed discovery of brain injury, which is very common, and other factors.
With trial set, Mr. Ratner forwarded me an offer from Defendants for $5,000. Upon discussion (which was 100% in email because he refused to talk over the phone and Ms. Mollineaux completely ignored me), he accused me of not doing Discovery right. I pointed him to the video I referred to earlier, which I had found since Mr. Ratner took my case, but wasn't aware of when I was interacting with the FPBP, where the FPBP (Abby Herzberg), and various District Judges from the Court I was litigating in, state that it is general policy (and it is official policy under the Court's General Order 25) to REOPEN DISCOVERY when a pro bono attorney comes onto the case, and to FUND DEPOSITION AND EXPERT WITNESS FEES.
Mr. Ratner stated he "won't file any motions" and ultimately elected to withdraw from the case over fulfill his legal obligations under the Rules of Professional Conduct. The Court thanked him and granted him permission to withdraw. The FPBP refused to put me back on the list. I was forced into trial BY MYSELF, at 1-2 months prior to trial, after 2-3 months of my time being completely wasted by Mr. Ratner and his law firm.
I went through the appropriate legal process to submit an expert witness. The Court, as usual, completely ignored my motions, but allowed me to use him after I went through the entire legal process, and paid him thousands of dollars without knowing if I would be granted permission or not, and provided the Court a report stating that the carotid hold was ILLEGAL unless the subject exhibited "assaultive behavior" and that Defendants had never alleged any behavior of mine that constituted "assaultive behavior" (under POST Basic). The expert was a Master level instructor at a police academy and former SWAT.
Mr. King provided his pre-trial disclosures, and it contained a document from Rohnert Park police department which had been extensively redacted on the copy that they had provided to me. The new copy contained the contact information for the bystander witness. I called him, and he confirmed that he saw the entire thing, that I had never yelled at the deputies before the first deputy grabbed my arm, and that I was not resisting at any point in time. I told the judge this. She had me call him at a hearing, and both me and Mr. King were allowed a couple of minutes to ask him questions, where he refused to admit that I was even "wiggling" when Mr. King badgered him.
The judge then refused to allow him to appear over Zoom, and refused to summon him to the trial.
At the trial, the Judge accused me falsely of firing my attorney, and explicitly prohibited me from telling the jury that the Defendants had LIED about the camera's ability to record. She explicitly prohibited me from submitting scientific evidence about the carotid hold. She allowed Mr. King to make extremely defamatory false remarks about me and my past which had a huge impact on the jury's perception of things. At a pretrial hearing, we had gone over about 110 documents that I wanted to present at the trial. She vetted about 40 as admissible at the hearing, but at the trial she only let me submit about 5. Defendants were allowed to submit a SECOND expert witness, both of whom worked for the Sonoma County Sheriff's Office. The first was Andrew Cash. The second was James Naugle who had been disclosed literally a week before trial, without a report, and without allowing me to take his deposition. She refused to allow me to ask Mr. Naugle about case laws, or about information pertaining to the carotid hold. The Court refused to summon any of my treating physicians, whom I had provided the names and contact information for in my disclosures at the end of Discovery and some in my initial disclosures, and I had complied with Mr. King's written requests for information or objected within the boundaries of the law, in good faith, and complied with the Court's orders, in good faith.
I had informed the Court that I was scheduled for medical evaluations for brain injury AFTER THE TRIAL. The Court completely ignored this.
So it was my word against theirs. 5 years, at the time of the mistrial, to get a mockery of a trial, and have the jurors' time completely wasted. The jury wrote me a letter thanking me or something, but awarded me nothing.
I was diagnosed with organic brain injury after the trial. I had a similar test prior to the incident and had absolutely no problems and answered every question with no trouble. I now score in the FOURTH PERCENTILE on those areas.
Despite its length, this has been a short summary of all the events over the past 6 years. Much has been summarized, and much has been left out. I tried my best to balance completeness with leaving out irrelevant details.
There is no record of any misconduct on the part of anyone involved in this that is available to any law enforcement agencies or to the public. Nobody has been disciplined. No investigation was ever conducted. I was almost killed and was seriously injured, under a camera, and in front of witnesses, and spent 6 years working with the government. The government has done precisely NOTHING.
The County now routinely retaliates against me whenever we interact, in blatant violation of various laws.

In my opinion, Marvel Phase 4 was not this giant disaster as some people (mainly racists, homophobes, grifters and sexists) made it out to be.
However, the fact that Secret Wars is happening this early, and The X-Men won't be introduced until after Phase 6, made me decide to make my very own MCU canon, and plus, if I was in charge, I'd heavily change some of the movies and Disney+ shows and save Secret Wars for five years later in my timeline (2031), when The X-Men and many other characters from the comics are already introduced like,
Wolverine, The X-Men, Cyclops, Emma Frost, Magneto, Doctor Doom, Venom, Miles Morales, Black Cat, Inhumans, Nova, Silver Surfer, Galactus, Blue Marvel, Ghost Rider, Sentry, Tigra, Brother Voodoo, X-Force, Spider Woman (Jessica Drew), Beta Ray Bill, Hyperion, The New Mutants, X-Factor, Captain Britain, Psylocke, Iron Lad, Alpha Flight, etc.
My MCU canon functions extremely similarly to Star-Wars Legends, but if the canon version wasn't utter garbage, compared to it, in my opinion, anyway.
Also, in my continuity, Phase 4 would last four (hehe) years like the previous phases did, and if we got 18 movies and shows combined, in two years, it will be a long four years of content. (Hypothetically, anyway)
I'm completely rebooting Ghost Rider, Blade, The Fantastic Four, Hellstrom, Inhumans and especially The X-Men. However, the previous versions still exist and appear in films involving the multiverse.
The FOX Universe is a separate universe, and I'd completely reboot The X-Men. However, Deadpool and his supporting cast, like Vennessa, Colossus, Domino, Cable, Negasonic Teenage Warhead, Yukio, Weasel, etc, would transport to The MCU through the multiverse.
As for SONY and their horrible Spider-Man Universe. In my ideal universe, SONY and Disney deal extends to other Spider-Man characters like Venom, Kraven, Morbius, The Black Cat, Silver Sable, Silk, Miles Morales, Ben Reilly, and Gwen Stacy (Spider-Gwen), it's not just Peter Parker himself that the deal extends to.
I'd do my own MCU versions of Eddie Brock, Morbius, Kraven, Black Cat, Silver Sable, Silk, Man Wolf, Prowler, Miles Morales, Gwen Stacy, Scarlet Spider, etc.
While SONY can make live action films about all the alternate versions of Spidey, such as, Spider-Man 2099, Spider-Man Noir, Spider-Ham, Spider-Punk, Sam Raimi's Spider-Man 4, and The Amazing Spider-Man 3, after the events of No Way Home. This can build up to a live action adaptation of Spider-Verse.
(Don't worry, the animated version would still happen in my ideal universe)
That would be done, in my timeline, instead of making villain films that don't even mention Spider-Man.
Also, regarding Marvel Television, before Disney+. Most of these shows are canon in My MCU Continuity, and this includes,

Without further ado, let's begin my Post-Endgame Universe with...

WandaVision:

The Plot: I liked the show, it was slow, but the last 2-3 episodes really saved it for me. However, Wanda turning evil after this is way too soon to me, and it's done in the most poorly written way possible in Multiverse of Madness. Also, references to sitcoms are reduced.
Episode 1: Filmed before a Live Studio Audience: We start at a S.W.O.R.D facility, where we see S.W.O.R.D scientists breaking down Vision's corpse from Infinity War, and taking his vital components and implementing them into a new pale white vibranium body. Meanwhile, we see Wanda Maximoff from a window, watching in horror, as Vision's body is being broken down instead of a proper funeral or burial.

Wanda, stealthily takes out the guards by putting them to sleep, hypnotically, then she busts into the main lab, angrily, with furious red eyes and she attacks the scientists using her telekinesis. But the scientists explain themselves and calm Wanda down and explain that they are trying to revive Vision, but they are stuck on how to get Vision's memories back, but it's revealed that Wanda has the memories.
Wanda uses some of her hex abilities to insert Vision's memories into his brain module. Vision activates and appears to remember and recognize Wanda, but something's off about him, he has his emotions removed from him, but Wanda doesn't mind or even notice at first.
Wanda and the newly revived Vision, head to the neighborhood of Westview, which is where the original Vision wanted to settle down with Wanda before The Infinity War happened. Wanda creates a bubble around the area with magic that she didn't even know she had and Wanda turns the color around her and Vision into black and white.
Episode 2: Don't Touch That Dial: Wanda and Vision are enjoying their time in this black and white, sitcom-like, world and their haunted looking house. This is where we can make references to several sitcoms, and Quicksilver even gets revived and Wanda eventually has kids, Billy and Tommy, but they grow up fast into their teens like in the actual show.
Sparky is created as a pet for Billy and Tommy, like in the actual show. Meanwhile, The Hex’s amount of energy and magic catches the attention of S.W.O.R.D, Jimmy Woo, General Hayward, Darcy and Monica Rambeau.
We keep the scene where Monica was snapped and when she came back, her mother, Maria, died five years ago. S.W.O.R.D is curious as to what Wanda did with the Vision body they created, since they checked the security footage and they see that Wanda just walked out with it and why there is a bubble of magical energy and many people in the middle of a known ghost town, so they send a transmission to Wanda.
Meanwhile, Wanda tries to leave the hex to make sure she actually revived her brother and creates children out of pure magic. Quicksilver goes along with her sister but when he tries to leave The Hex, he glitches out and almost dies, but Wanda telikenicly pushes Pietro back into The Hex. Panicked, Wanda returns to The Hex and realizes that her own magic alone cannot create life, let alone bring back the dead. But she finds a book underground and it’s a copy of The Darkhold, The book of the damned.
(Note: Calling this Darkhold "a copy", keeps Agents of S.H.I.E.L.D. canon since Robbie Reyes took the original Darkhold to Hell to prevent it from being in the wrong hands, and this also writes off The Darkhold that Morgan Le Fay has in Runaways as a copy)
She tries to find some spell that will work to allow Quicksilver and her children to survive outside The Hex, but she also has to deal with Vision, he might have his memories back, but he lacks his emotions and his colors, since his body is just pale white, regardless on what world he’s in, Hex or otherwise. He often acts cold and takes things literally, So Wanda has to fix that as well.
However, Wanda is slowly being corrupted by The Darkhold, and she even is more aggressive and overall, has a more violent and sadistic demeanor. She hears the S.W.O.R.D transmission and she tells Vision, Quicksilver and the kids to stay inside The Hex, as she exits the area.
Wanda confronts the SWORD agents, who are right outside The Hex’s location. The SWORD agents ask Wanda about The Hex and the Vision body that was taken and Monica tries to reason with Wanda, and Wanda just screams “Leave me and my family alone'' and a huge action scene happens.
Wanda starts by blowing up the Armored SWORD vehicles with her hex bolts, when they attempt to open fire on her. The agents try to shoot Wanda with their energy weapons, but she blocks it with her energy shields.
Wanda brutally kills many of the S.W.O.R.D. agents by snapping their necks, burning them alive with her hex blasts, telekinetically ripping them apart or choking them to death. It's the most brutal that my version of The MCU has gotten up to this point.
Monica, Jimmy Woo, Darcy and General Hayward retreat to make sure they don't get killed by Wanda. After all the S.W.O.R.D agents are dead, Wanda walks menacingly back into The Hex with her eyes bloodshot red.
Episode 3: Now in Color: The S.W.O.R.D team formulates a plan to disable The Hex and apprehend or kill Wanda, if necessary. Much to Monica's protest and dismay. Meanwhile, back in The Hex, which is now colored, Wanda is still trying to find that spell that will allow her brother and two children to survive outside The Hex. But then, Wanda is approached by a mysterious person named Agnes.
Agnes teaches and manipulates Wanda about The Darkhold and Wanda is succumbing more and more to The Darkhold's influence. Meanwhile, S.W.O.R.D. Forces are surrounding The Hex and they are about to launch an assault on Wanda, they plan to take her in, but they'll kill her if they see it as necessary.
They send Monica to see where Wanda is located from the inside, and as Monica enters The Hex, her body begins mutating as she hauls through the extra-dimensional energy field, but she ultimately makes it through. Wanda manages to perform the right spell to allow Quicksilver and her two kids to survive outside The Hex, but Agnes just grins in a sinister manner.
Monica spies on Agnes and Wanda and Monica sees The Darkhold and she realizes what's happening to her. Monica tries to warn Wanda of what The Darkhold is doing to her mind and overall sanity.
Unfortunately, Wanda sees no harm, especially because she was successful in bringing her brother back and having two kids. Wanda, cheered on by Agnes, telekinetically throws Monica out of The Hex, and back into the real world. The SWORD agents retrieve Monica, who is barely conscious, we see her body and eyes are glowing yellow.
Episode 4: Breaking The Fourth Wall: Vision, after seeing Monica being violently thrown out of The Hex, begins to question Wanda's ethics and what are Agnes's true intentions, since she did cheer Wanda on to do this but she claims that she wants to help.
Vision talks to Wanda about this and the two begin getting aggressive and arguing with each other like in Episode 5 of the show that we actually got.
Meanwhile, General Hayward is fed up with Wanda's violent demeanor and devises a plan to execute her and Monica immediately protests this plan, since she knows that Wanda is being manipulated by Agnes and The Darkhold, but the S.W.O.R.D scientists and personnel don't believe her.
Darcy also stands with Monica. The S.W.O.R.D soldiers immediately point their guns at Monica, after noticing her eyes glowing yellow. They fire at her, but the bullets just phase through her torso, like they are shooting at air. Monica runs away and she instinctively energy blasts a chunk through a brick wall in the S.W.O.R.D facility to escape along with Darcy.
Monica and Darcy are hiding in a house in The Hex, Monica is extremely shocked to learn that she has superhuman abilities.She tests her energy blasts, which can blast through concrete and solid steel. Her energy form, which allows her to be superhumanly fast and phase through physical objects and Darcy does some energy tests and it's also revealed that Rambeau can transform herself into any form of energy within the electromagnetic spectrum.
Among the many energy forms she has assumed and is able to control are visible light, cosmic rays, gamma rays, X-rays, ultraviolet radiation, electricity, infrared radiation, microwaves, radio waves, and neutrinos. By assuming an energy-form, she gains all of that energy's properties. She can bend the light around her to camouflage and seem invisible.
However, she does have limitations with her abilities, Rambeau is only able to retain her energy form for an hour at a time, before having to recharge herself and she can only transform herself into one wavelength of energy at a time.
They later bump into Vision, who is investigating The Hex's properties and trying to find any dirt on Agnes. Vision also states that he's not amused with how suspicious Agnes seems. Vision agrees to help Monica and Darcy to bring Wanda back to her normal self. Meanwhile, back at the S.W.O.R.D. facility, General Hayward reveals that the S.W.O.R.D scientists still have Vision's schematics and they build another Vision, which they intend to use on Wanda and to detain Monica Rambeau.
Episode 5: This is Halloween: Vision briefly returns to Wanda, but he will check on Monica and Darcy, to spend some time with his wife. Which subtly shows that some of his emotion is returning. It's basically the Halloween episode we got, from here on out. Just without the Vision and Agnes interaction, since we already saw her prior, in this rewrite.
Agnes still kills Sparky behind Wanda's back. Quicksilver is very protective of Wanda like in the comics, Pietro got encouragement from Agnes. Vision is still investigating what is going on with Wanda's behavior and what are Agnes's intentions. The Comic Accurate costumes still show up as Halloween costumes and as a reference to comic fans.
Episode 6: Previously On: General Hayward, Jimmy Woo, White Vision and the S.W.O.R.D. forces begin to make their way toward The Hex. Vision, who is scouting the area, sees the S.W.O.R.D forces making their way to Wanda's location, so he warns Monica and Darcy.
Meanwhile, Wanda discovers Agnes's basement and this is where Agnes reveals herself to Wanda, Billy and Tommy, as Agatha Harkness and a witch. She enthralled Maximoff, projecting visions into her mind that revealed herself to have manipulated the recent events, which included, lying to Vision to further distance him from Maximoff, killing Sparky, and manipulating Pietro to watch over Maximoff.
Agatha also states that she came to Westview because she sensed the immense power involved in all the magic and was impressed.
She wanted to know what had allowed Wanda to have such immense power and how she could cast so many high level spells all at once and even have them self perpetuating without Wanda's direct involvement, Agatha is an experienced witch and knows how difficult that is. She wants that kind of power herself.
Wanda attempts to read Harkness' mind, but this proved ineffective as Harkness had placed a protection spell around the room with runic symbols and in turn bound Maximoff in magical bonds. She then demonstrated her magical powers to Maximoff including transmutation and mind control and explained to Maximoff that she is capable of performing such magic but on a grander scale.
Harkness then demanded to know how Maximoff created the Hex in the first place, but Maximoff was unable to recall how she pulled it off.
Harkness plucked a hair from Maximoff's head and used it to open a gateway into Maximoff's memories and to ensure Maximoff would follow her. Harkness revealed she was still holding Tommy and Billy somewhere in her dungeon, and having no other choice Maximoff followed Harkness through the door.
Agatha then goes into Wanda's memories, which puts Wanda in a lot of pain, on top of being mind raped. We see that Wanda was in reality, was really born to Erik Lehnsherr and Magda England, which shocks Wanda, since she remembers being raised in Sokovia. We also see Pietro and a second sister, who is in a green blanket. (This will set up Magneto and Polaris, appearing in later movies)
We then see Magda screaming and dying in a house fire due to an angry mob forming, and they are chasing Erik out along with the three kids. Erik put up Wanda and Pietro for adoption in Sokovia.
We then see her childhood in Sokovia, the Stark Industries missile blowing up her parents, but Wanda used her probability powers to save herself and her brother, which is the first display of her powers, and Vision comforting Wanda and watching sitcoms shortly after Quicksilver's death, back in Age of Ultron.
Having seen all she needed to put the pieces together, Harkness applauded Wanda Maximoff's display of Magic, before teleporting Wanda and herself outside, where she held Tommy and Billy Maximoff with magical nooses around their throats, Harkness then revealed to Maximoff that she was a being long thought to be a myth, a being capable of creating something from nothing with the great power of Chaos Magic, and Maximoff was in fact the Scarlet Witch.
Her mother, Magda, also had magical potential, but her child would always be 100-times more powerful. Maximoff attacks Harkness to release her hold on her children, before ordering them both inside of the Vision Residence to shield themselves. Attempting a second attack, Maximoff soon discovered that Harkness was able to not only absorb her chaos magic, but take a portion of her life force as well.
Harkness attempted to strike a bargain with Maximoff, She would be able to maintain the Westview Anomaly and her reclusiveness, but she would have to give up the chaos powers. However, Wanda declines, flies up towards Agatha and the two begin to fight. Vision, Monica and Darcy show up to help. Darcy gives Monica a suit, and she even nicknames Monica, Photon. General Hayward, White Vision and the S.W.O.R.D. military forces show up on the ground and begin to open fire on Wanda and Agatha.
Wanda, who has had enough of General Hayward, brutally burns him and most of the agents alive using her hex energy wave, with a smile on her face. Vision tells Monica and Darcy that he'll deal with the White Vision, who had his target on Wanda, and the two living synthezoids fly towards each other and start shooting beams at each other. Monica, despite her disdain for Hayward, calls Wanda out for her actions.
But Monica knows the pain of suddenly losing a loved one, she tells Wanda that she can connect and empathize with her, despite Wanda being sadistic, brutally killing many S.W.O.R.D soldiers, scientists and General Hayward, and Monica was attacked by her on two separate occasions, although those were merely fits of rage from a grieving Avenger who couldn't let go of a life she almost never had, and she was manipulated by Agatha and under the control of The Darkhold, which fuels her anger and aggression, so Wanda is not exactly irredeemable ether.
Wanda, using Monica's words and her own willpower, manages to break free of The Darkhold's influence, despite Agatha taunting Wanda about her failures and blurred morality, as they are in a standoff, levitating in the red sky. Wanda epically transforms into The powerful Scarlet Witch to fight Agatha and to end this madness.
Episode 7: The Series Finale: Wanda fights Agatha, just like in the show that we got. Vision and White Vision have the same fight as they did in the actual show and Vision gives his memories to White Vision. I'd keep the "I am Vision" line, and like in the show we got, White Vision flies away, which is setting up his own series.
After Wanda defeats Agatha and destroys The Darkhold, she breaks down in tears after realizing what she's done, as she sees the burned skeleton of General Hayward and the many S.W.O.R.D soldiers that she has slaughtered during her Darkhold rampage. However, Monica comforts Wanda and congratulates her on overcoming her dark side and doing the right thing in the end, but the S.W.O.R.D. forces are about to arrive to take her in and Wanda flies away with Quicksilver, Billy and Tommy.
Wanda is not completely off the hook for her actions. Though she is hiding in a haunted house, raising her two sons and reconnecting with Quicksilver, trying to redeem herself.
Post Credit Scenes: Doctor Strange and Wong, senses The Scarlet Witch's presence, which sets up the Multiverse of Madness, with Wanda's redemption, instead of ruining her character further.
Magneto, in shadow, with only his helmet visible, sees footage of Wanda on the news, and he immediately knows that one of his children is alive and well. This sets up The X-Men, and Wanda meeting her biological father in the future.
S.W.O.R.D, Nick Fury, Maria Hill, Quake, Coulson, Jimmy Woo and Monica, now known as Photon, discuss Wanda's actions and Fury decides to let Wanda off the hook, for now, since she did stop Agatha, felt extremely remorseful about her actions and she did destroy The Darkhold, which especially after the events of Agents Of S.H.I.E.L.D, they know it is a dangerous artifact.
But they will execute Wanda, if she shows any aggression. So, Wanda is now a controversial figure among the superhuman community, going forward.

The Falcon and The Winter Soldier:

The Plot: Most of The Falcon and The Winter Soldier would stay the same, except for Sharon Carter, who is a spy for S.H.I.E.L.D. against The Power Broker, who I'd later reveal in the Echo series, to be The Kingpin.
It's revealed that Sharon is working with Fisk, for S.H.I.E.L.D. to get information for an eventual sting operation. She doesn't enjoy selling superhuman enhancements and dangerous weapons, but she sees it as necessary. Sharon Carter still shoots and kills Karli, and Sam Wilson is not fine with this.
Sharon would reveal to Sam what she's doing and her intentions, this will cause some extreme tension between Sam Wilson and S.H.I.E.L.D. in the future.
This isn't the last time that S.H.I.E.L.D. would do some shady things in My MCU Continuity. This also makes Sharon Carter way less evil, and more in character for her. She'd seem like the type of person that does what she thinks is the right thing, even if you do some very questionable things in the process, kinda like a more extreme Steve Rogers.
Other Changes: Battlestar doesn't die, but he is, however, in a coma. I think it's extremely hypocritical that Marvel wants to push a black man as Captain America, when in the same series this happens in, they use the racist "The Black Guy Dies First" trope.
They could have easily just said that Battlestar was badly injured or in a comatose state and that could have pushed John Walker to cross the line and take the life of that Flag Smasher, which causes him to be stripped of being Captain America.
Also, I think Battlestar could be a good member for The Thunderbolts and be another positive role model for black boys. There was some wasted potential with this character.
Steve Rogers' status of being dead or alive is way more clear in my rewrite. I'd have Bucky say that Steve is retired and the serum prevents the user from dying of old age. That could be a backdoor for Steve Rogers to return in the future.

LOKI:

The Plot: LOKI would stay exactly the same, but Sylvie has Lady Loki as her codename, instead of it being ambiguous. Enchantress would be later saved for my version of Love and Thunder.

What If…?:

The Plot: Most of What If would stay the exact same in My MCU. However, Natasha from Earth-29929, or the Earth that Infinity Ultron completely annihilated and took over. After Infinity Ultron is killed, instead of being sent to an Earth that Loki took over, The Watcher sends Natasha to The MCU, where The Prime Earth Natasha is already deceased.
I think Natasha had some wasted character potential, so a variant taking her place would be a compromise. It wouldn't necessarily ruin her sacrifice in Avengers Endgame, since the variant is a separate character. They also did this with Loki and Gamora, so this would make the most sense.
This would set up a Black Widow sequel, where the variant Natasha would have to loosen up and adjust, since the Earth that she's displaced in, is not a complete apocalyptic hellhole.

Hawkeye:

The Plot: Hawkeye would stay mostly the same. My rewrite is very similar to TheMan5991's small rewrite. The link is placed here.

The only real change I'd make is during the final battle with The Kingpin and Kate Bishop in Episode 6. My main problem with Kingpin in the Hawkeye series is that he is both too weak and too strong at the same time.
Fisk is too strong because he is able to completely rip a door off its hinges and later gets full speed rammed by a car which, rather than killing him, cartoonishly knocks him through a window where he gets up with barely a scratch. In the Daredevil Netflix series, Kingpin was very strong, but he was still just a normal human being.
His main power came from the fact that he controlled everyone and everything around him. On the other hand, he is too weak in that he is able to be beaten by a college student with like a week of superhero experience. Yes, I know that Kate trained growing up, but up until the show started, she had never fought someone in a life-or-death situation. Especially not someone as dangerous as Wilson Fisk.
The fact that Kate Bishop beat him is supposed to be impressive (Clint says as much later on), but the action sequence felt less like a compliment to Kate’s abilities and more like an insult to Fisk’s threat level.
I want to fix these issues. So, here is my version of the events of Kate Bishop's fight with The Kingpin.
Eleanor gets in the car, tells the driver they need to find Kate, then realizes the driver has had his head crushed and he died. Fisk appears and calmly opens the door. Fisk still wears his Hawaiian suit. Kingpin tries one last time to convince Eleanor to continue her services for him. She refuses, knowing that continuing to work for Fisk would endanger her daughter.
(One of my favorite things about Netflix Kingpin was his simmering anger. He felt like he was moments away from decapitating a guy with a car door. I never felt that from his reappearance. I want that to come across in this conversation between Eleanor and Fisk)
While Eleanor is denying his offer, we see him slowly getting angrier until he finally breaks and grabs her by the throat, dragging her out of the car. He is holding her up by her neck when Kate arrives. As Eleanor struggles, Kate aims her bow at Fisk and yells "Get away from my mother", but he doesn’t even glance in her direction. She shoots him in the chest with an arrow, but as we learned in the Netflix series, all his suits are armored, so it doesn’t penetrate through. He looks over at her and Eleanor chokes out to Kate telling her to "run" before Kingpin snaps her neck, killing her.
Kate, in her rage, fires an explosive arrow directly at Kingpin, and Fisk immediately gets caught in the explosion, and gets sent flying through the building wall. Bishop entered the building through the wall, and tried to stop Fisk from leaving. Bishop shot a trap arrow at the gap in the building, causing electric wires to form over the hole, preventing Fisk's escape.
Kingpin became aggravated and began tossing Bishop around the room and pulverized her with his punches, leaving her bloodied, several broken ribs and defeated. Fisk pulled her quiver off of her back, pulling her arrows out, snapping them in half, and tossing them on the ground.
Kate, refusing to give up, and wanting revenge for what Fisk did to her mother, gets up, lunges towards Kingpin and tries to kick him. However, Fisk easily punched her in midair, sending her crashing into a window, cracking it. As Bishop sat on the ground, cornered by Fisk, she used his cufflink that she had picked up to flick and activate the head of one of her magnet arrows on the floor. The magnet arrows activate the nearby explosive arrows, causing an explosion that blows up the store, and Kate smashes and jumps out of the window that is behind her and she survives the blast.
(Now, obviously, Eleanor does not die in the actual series, but I told you there was an exception and I think this works better for two reasons. First, it gives Fisk the threatening presence that everyone has been talking about throughout the series with their comments about “the big guy”. This level of terror makes Clint’s comment about Kate surviving an encounter with him meaningful. Second, Eleanor dies in the comics as well and is later brought back as a vampire. With the Blade franchise coming up for the MCU, this leaves open the possibility of a return if they wanted to bring her character back. It also gives more character development for Kate, to overcome her grief of a loved one, similar to Spider-Man, or The Flash)
Still wounded and burned following the explosion, Fisk painfully made his way through the streets of New York City, until his path was blocked by a car. As the car pulled up in front of him, Kingpin had then realized that the driver was Maya Lopez, as he breathed a sigh of relief, only for Lopez to grab her gun and point it directly at his head.
Fisk soon realized that Lopez had indeed learnt that Fisk had been responsible for her father's death at the hands of Ronin. Fisk then told Lopez that they were family, and that families did not always see eye to eye. Lopez responded by shooting him, causing Fisk to fall down, knocked out.
Kate eventually makes it back to Clint and the rest of the episode plays pretty much as is. It is, perhaps, a little more somber as Kate’s mother was murdered instead of simply going to jail, but that just gives her even more reason to go with Clint back to his farm. His family welcomes her in and their love for each other spreads to her and helps her recover.
Post Credit Scene: Laura Barton received her SHIELD watch from Clint, with her name and Agent 19 being engraved on it. However, Laura gets a call from Bobbi Morse, with a hologram of her picture.
Yes, the only addition I'd make is to have Clint and his wife have a mystery third woman, who Clint has been extremely close friends with in the past, and he still is intimate with both her and Laura. I'd reveal that woman to be Bobbi Morse, Mockingbird. The same character from Agents Of SHIELD.
This sets up Mockingbird returning as Hawkeye's new love interest in his hero-life, while his home life with Laura, and both women are friends and are more than alright with that.
They are literally sharing Hawkeye. Then again, Hawkeye was always a ladiesman or womanizer in the comics. Clint is still happily married to only two people. Bobbi is even an aunt to Clint and Laura's children, similar to how Black Widow was in that role, before she passed away in Endgame.
Not to mention, Agents Of SHIELD Season 2 mentioned that Hawkeye and Bobbi went on a few missions together, so it's implied that the two agents have some romantic history. Don't worry AoS fans, Lance and Bobbi are still really close friends and an iconic duo, just not lovers anymore.
Also, Lance Hunter will show up in a future SHIELD movie or Disney+ series. Along with Bobbi and Clint, I can also see a lot of jealousy ensuing.

Patricia Schneider was a 25-year-old waitress that disappeared from an unincorporated part of Riverside County called Pedley. She got off work from the Palamino Station in the early morning hours of Sunday August 1, 1982. Having car problems, she stopped at a Circle K mini market near the cross streets of Limonite and Van Buren. She was seen talking with two men with Sandy hair who were apparently assisting her with her car. She called her boyfriend twice while at the mini mart with the last call being around 3 am. She has never been seen since. However, her car was found about 2 miles away from the mini-market near Van Buren and Dolittle in the city of Riverside. It had been set ablaze. Police found her purse in the car.
Patricia was survived by her mother who lived in Banning California and did not have a phone and her aunt who lived in Laguna Hills California.
Patricia’s disappearance has at times been associated with the Disappearance and murder of Dorothy Jane Scott (1980, Orange California). The primary reasons for this is that the cars of both women were found burning hours after their disappearance. Additionally, a story about Patricia showed up in the Orange County register, due to her aunt and friends living in Laguna Hills.
What I have not previously seen noted is that Patricia was not the only disappearance on Limonite Avenue on that weekend in 1982.
On Friday, July 30, 1982, at around 4 pm, two miles from the mini market Patricia was last seen at ten-year-old April Irene Lamont was kidnapped while riding her bike to the Stater Brothers grocery store on the corner of Limonite and Etiwanda in the unincorporated part of Riverside County called Mira Loma. A search would be conducted for April and her bicycle would be found four miles North near Etiwanda and the 60 freeway in an industrial area called the Mira Loma Space Center. The following morning her body would be found dumped behind a Mobil gas station on Valley Blvd and the 60 Freeway in the unincorporated part of Riverside County called Rubidoux. The cause of death was believed to be asphyxia and their reports were in contradictory as to whether she had been sexually assaulted.
Media reports of April’s murder quickly disappear with only a blurb appearing the San Bernardino Sun a few articles in the Press Enterprise and a couple of articles in The Record a small newspaper published in the area.
Despite many search efforts, I have never been able to find any stories regarding a resolution to April’s murder in the media. I have also been unable to locate any court records regarding anyone being charged with the murder of April. However, April’s does not appear on any of the unsolved sites.
At first, I thought this may have been because of the father’s attitude as portrayed by an interesting quote in one of the articles. The only quote one I found. A report apparently caught him on his lawn within a day or two of the murder. He was quoted as saying, “I had three children. Now I have two.” I can only interpret this as being the words of a broken man. There was no doubt based on witnesses statements that April was abducted, so the father would not have been under suspicion. He did not appeal for the perpetrator to be caught and hanged or have any other cries for justice. He seemed to simply have accepted nothing would return his daughter to him.
Reading through the articles of the time in that area, it seems that the unincorporate areas of Riverside County known as Rubidoux, Indian Hills, Glen Avon, Pedley, and Mira Loma were striving to become a striving blossom into a booming city. However, those efforts seemed to be foiled by a scandal called the Stringfellow Acid Pits, which involved the dumping of toxic materials in the Jurupa Mountains which was found to have leaked into the Pyrite Creek and ran down to the Santa Ana River. Today, all of those communities are known as the City of Jurupa Valley.
So, the question remains, why is April’s murder not a cold case listed like that of Patricia’s?
I believe the reason is because they know who killed April and it is highly likely that the same person killed Patricia as well.
In 1982, there was a child rapist abducting and sexually assaulting young girls in Los Angeles, Orange, and San Diego counties. He was known as the Lost Dog Rapist, because he would ask children to help him look for his lost dog, snatching them. He would take them for a long ride in his car and then sexual assault them in the car or a motel room. Later releasing them by dropping them off at some other location.
Though he had been preying on girls for some time in the area, as things seemed to heat up in Los Angeles and Orange counties, he moved to San Diego County. There he picked up a girl and kept her overnight in a motel. However, he slipped up as the girl was able to lead the police back to the motel, he had taken her.
Within a couple of month’s Los Angeles Police Investigator would fly to Kansas and working with Investigators there, discovered that the address used to register at the Mission Valley Hotel in the San Diego area was one that had been frequented by a man who had been arrested for indecent exposure and then jumped bail. Shortly after that arrest in 1977, a series of rapes occurred in the Kansas City area. They involve home brake-ins as well as at least one rape on the streets. Most of the victims were girls around 9 to 12 years old, but one was 17 and another 20 years old. Victim identified the photo of the man who had skipped bail as their attacker. The name he was known as was Roscoe James Short.
Soon, a connection was made to an incident in Albuquerque New Mexico in 1974. There a man identified as James Henry Ginn Jr. also known as Patrick James Kerwin was arrested after being pulled over for a traffic infraction. As the officer was speaking with Kerwin, two women approached them and indicated that the man had just attempted to abduct one of them. One of the women said that she was leaving her place of work when Kerwin grabbed her and put a knife to her thought. He forced her into her car, but she was able to escape when the car would not start. The second woman came to her rescue as she screamed and the man fled to another car where he screech out of the parking lot. Investigators connected Ginn with a number of other attack on girls aged 14 to 16 years old. Eventually, Ginn would be charged with seven counts of aggravated assault, five of sodomy, and one count of kidnapping for crimes he was identified to have committed in the area. According to media reports, Kerwin would escape prosecution after unwittingly being released from a psychiatric hospital.
Between his activities in Kansas City and Alburquerque in 1976, Ginn would be arrested in Azusa California under the name Patrick Kerwin as part of a part of a drug bust involving 4,400 pounds of marijuana. The drugs were found when police responded to reports of a burglary. There they found 400 crates of onions each of which contained 11 pounds of marijuana underneath them in a truck at the house. The marijuana had a street value of more than $250,000 Ginn was arrested with two other accomplices at the time.
In 1979, Ginn was active in Corpus Chirsti, Texas where a 10 year old girl was raped. In that case, a man and a woman lured the girl to the car telling her they needed her help looking for a lost dog. They then took the girl to a motel in Victoria where she was tied to a bed, blind folded and gagged. The man then raped and sodomized her as the woman took photograph of the act. The girl was then dropped off at a restaurant in Corpus Christi.
In the late 70’s and early 80’s, Ginn would be active in Denver Colorado, where he was known as the Baby sitter rapist. Twenty-two attacks on girls ranging from age 4 to 15 would be attacked. In these attacks he would force his way into a home at assault babysitters and the children they were watching.
In May of 1982, Chief Darryl Gates would announce that they had identified the Lost Dog Rapist as Roscoe James Short. At the time they list a series of aliases that the man was known to use and stated that did not know what his true name was, but that the were sure who was committing the rapes. They also indicated that the individual was a known drug trafficker. Within a couple of weeks, the LAPD would indicate that the man’s true identity was James Henry Ginn Jr.
Attacks had gone quiet in Los Angeles, Orange and Sand Diego Counties after the March 1982 abduction of the girl in the San Diego area. That same month a 9-year-old girl named Jenny Kao was murdered at a Pasadena Mall while selling candy and the Lost Dog Rapist was considered a suspect. Another girl was attacked in Venice, a Beach area of Los Angeles, but some of the details of the attack were different, so police were skeptical.
After the May announcement of Short being the suspect and the clarification that his real name was James Henry Ginn Jr. things were quiet in Los Angeles, Orange, and San Diego Counties in the months of June and July. However, in Riverside County April would be murdered on July 30th and Patricia would disappear on August 1st.
On August 18, 1982, Ginn would be arrested by the FBI in a restaurant in Denver Colorado. By October, Ginn would be charged with 37 counts in four states and in a plea bargain be sentenced to 83 ½ years to be served in Colorado.
So, recapping what we know about Ginn:
- He is a rapist that has been active since at least 1961.
- He committed a series of rapes in multiple cities.
- He used different methods of operation, including abducting children from the street and forcing women into their own car.
- Has attacked waitresses as they left their jobs.
- He known to have attached girls and young women.
- He is known to have had accomplices in abductions.
- Possibly involved in child pornography.
- Involved in drug trafficking.
- Skipped bail repeatedly.
- Used over 10 aliases.
- On a couple of occasions, he was described as having blonde hair.
When investigating the Dorothy Scott murder, I uncovered four men who were involved in a kidnapping and rape spree in Orange County at the time of her abduction in 1980. Those four men were involved in sexually assaulting seven young women, mostly teenagers, raping them and releasing them. Four their crimes they were sentenced to 400 years in prison. It is curious to me that a man involved in the molestation of so many children, with a knack for escaping justice would get such a sweet deal that has him on the streets today after serving forty years of his sentence. I tend to wonder if some additional information came along with Ginn’s confession as he was clearly involved in organized crime of some fashion.
Interestingly, enough a little over a week before Ginn’s plea bargain would be announced, four agencies would raid a property in the unincorporated part of Riverside County called Glen Avon where they would find over $100,000 in stolen cars. According to media reports, they uncovered the location where a truck load of soap bound for Burbank (neighbors Van Nuys), was stolen. When the incident was reported to the Riverside FBI office, an agent there remembered the truck as being one he had seen at a Glen Avon address. It does not say why the Special Agent had been checking out the address.
It is my belief that the murder of April and the disappearance of Patricia may likely be the work of Ginn. Although Ginn had not been identified a murderer, it is very possible that with the heat on him he could have opted to kill April rather than leave a witness in the area he was hiding out. It is also possible that he involved accomplices that preferred that no witnesses remain. April also could have accidentally been asphyxiated as part of the act. As for Patricia, it is likely that her remains are somewhere between Riverside and Denver Colorado.

I have struggled my entire life with my mental health. Typical extremely fucked childhood, though when I share some with folks I get extra," Wow, all of that is extremely fucked." And they could typically agree whenever I've said," Its a miracle I'm here/alive." Toxic relationships, substance abuse and eating disorders and bouts of years long depressive episodes.
After I exited a very toxic relationship at 32, I dove into therapy for real and promised myself I wouldnt get into one until I did a shit ton of work around my codependency issues. While I've led a reckless life filled with risky behavior and binge drinking issues (lessened a lot over the past 3-4 years), I was always thankfully able to hold down a job from 19-35; so 15 years of solid employment at my job...but even that was rocky in certain seasons due to my trauma. I left home at 18 to escape a toxic/abusive household and have essentially been on my own my whole life. Classic middle child independance and lack of checking in bc of that from my parents; I've been the one theyve never "had to worry about". They obviously never knew the extent of my issues until recently.

Anyway, from late 2019-fall of 2021 was in therapy and doing a lot of work. I had never entertained using prescription meds bc I took a class on big pharma a long time ago and it just deterred me completely; but at the end of 2020 when certain symptoms just wouldnt subside- I gave them a chance (adderral for ADHD and was put on Wellbutrin for depression)
I'm just going to skip a lot. I essentially began experiencing what I still believe a spontaneous Kundalini awakening. I had already been having insomnia issues from my meds, and no, didnt fix it as I should have; mostly bc I was finally insanely productive overall and leading the healthiest lifestyle I have ever led. I was so so excited about the possibility of functioning like a real human being, and existing in and finding success where I've only had limitations and blocks in life due to the ups and downs (mostly down).
I ended up quitting my job suddenly due to feeling like I was being led to other things. Cashed out my retirement. Around this time things began slipping into mania/psychosis (kundalini can do "dark" and I was worried about this initially). I had a full blown psychotic episode that nearly killed me/easily couldve gotten myself killed. Thankfully, I made it out of it alive. But between rent and literally manic spending- I spent it all (though for 15 years I promise its not even close to how much you may be imagining) and in the process incurred debt due to not paying rent for a few months during it. I blew it all during the episode.
I was feeling the best I had as far as my healing goes, and I publicly ruined my reputation (or at least I view it this way, I was acting like a grandiose asshole all summer). Tried to kill myself when I was jailed during it (overseas too).
I have NEVER in my life experienced something like that. I am still grappling with accepting it. Being so angry about it. But at who?
It feels like theres nowhere to direct this pain and angry and confusion. I went from people telling me how much of an inspiration I was to them (I am a huge mental health advocate and shared a lot of my journey prior to this online)- to people now suddenly wondering why I made a crazy show on IG then disappeared for the last two years. I feel so humiliated. Broken.
I've barely been able to hold down a job since. I was making 25 an hr, and now have to start all over again at 36 in the middle of this recession at 15? I've been relying on my parents to pay my rent for months, and am moving in with family next month in the city I've been hoping to move to for a long time; and I am so ashamed. I feel like a fucking loser. Sabotaged a connection I had with a guy I thought could be really serious (and now its out of the question)
I am 100% bitter. I am tired and depressed and confused. I've experienced suicide ideation heavily during this time and though I got back on Wellbutrin, am feeling no help from it like I was before.
My self talk is horrible/the worst its ever been, my "Freeze" response from the experience has me couch ridden since, obsessively into astrology/spiritual/psych stuff to make sense of everything. Terrified I'll have another episode if I get on meds. Terrified life will go back to me being frozen, anti social couch potato like I'd been up until I got on meds. But until I had the episode, everyone was seeing the positive changes in me and my life was really looking up. I feel angry every day. Consumed. Easily sob thinking of it, like now. I have no idea how to pick myself up again from this, and still think of killing myself often.
I dont know what I'm looking for here. I just had to get it off my chest a bit today.

This is becoming a federal case. Thoughts on firms that can handle this in Chicago? My best guess is Michael Oppenheimer Chicago Civil Rights Attorney any other idea post it here for consideration and why.

The police arive I go out and change my destroyed clothes to the only par of clothes I had stashed let for my get away so that I wasnt completely naked as The Man intend and The Man angry with that informs 911 that I was doing so. I couldnt leave them on or the police would have been like WTF and forced me to go to the hospital and arest the guy and not what I want.
He was cleared of any injuries by medical on scene.
Westfield
The City of Westfield Indiana and WPD covered up what they believed to be Human Traffiking going on at 319 Park Westfield neighbor to the Sherrifs house who in 2019 list his house for 5 x its value at $1.2 Million because the YMCA was deciding to put a $35 Million facility there and would make everyone's house values go up and westfield has been trying to get the YMCA to build that 2018 to 2022 recently they offered YMCA $5 Million to build it the police kno that so WPD manufactured false evidence against me on camera pretending to be authentic and valid and coached a Intoxicate witness who was on parole for DUI to change his written statement to say he witness me battery a guy in a domestic dispute and it wasnt enough so she actualy changed the witnesses statement herself and signed her name to it and completely lied about everything that happened on scene including talking to another officer who told her he recently responded to a Human Traffiking call there less than a month prior.

WPD also edited many of the cam videos silence parts and removed some completely including when she use their ID's and found out both were ex cons and removed completely the human trafiking video portion of her bodycam but they forgot about this officers video and left it in so you have the evidence.
She denied on reports that the conversation ever happened under felony perjury charges and that both felon ex con's statements acording backgrond on their ID were both and their statements credible and that she had no evidence or say so otherwise and that no other officer told her anything that would lead to believe otherwise. The Lawsuit
If anyone knows a Civil Rights atorney let me know I have contact the ACLU but they are too busy with other sht I guese and dont care about me. The YMCA still hasnt decide whether to put a facility there and in 2022 the City of Westfield offered $5 Million to them to get it going. The county also tried to murder me negligently at the jail and by forcing me to wheeler mission and hering judge after getting angry that I didnt asnwer yes or no to him gave me a lawyer who was practically disbarred for trying to have sex with his clients and his wife worked against me for the diversion part of the prosecutor's office who then voice mailed me and extorted me saying that she listened to my voice mails and emails to her husband and it didn't sound like I was too interested in pleading guilty to divert my case and if I did not hurry up and pay her $400 to divert my case that I could be convict of a crime.
I am going to sue the sht out of them all for this some guys in this group are from wheelers mission in Indianapolis that witnessed me being raped and abused in person in front of them and 250 other guys where the police forcibly drop me of at during a pandemic with no phone or trnsport or ID or job 45 miles from court. Step 1 for the pimp is to find a girl to work for him. Pimps usually have good social skills so they meet a lot of people and go to a lot of parties and things like that. They also meet girls on social media. They also steal girls from other pimps and target girls who are already prostitutes, but don’t have pimps.
​
Certain characteristics of girls make them more susceptible to becoming victimized by a pimp. They usually have little to no family support. Many are runaways. Many have mental health problems. Many are homeless. The pimp offers attention and stability to girls in these types of situations.
​
Pimps don’t usually pay their girls. During one of my first investigations, I asked one of the girls about the percentage of her earnings she got to keep. The question confused her. I had to ask it several different ways before I got an answer. And her answer was, “Nothing.” So I asked her why she had a pimp. What did he do for her? She replied that he bought the dress she was wearing and paid for her hairdo.
​
I was shocked. The girl did all that work and got no cut of the profits. But I came to find out that the pimp uses this as a form of control. He doesn’t let his girls keep any money. Instead, he will pay for all their needs: apartment, food, clothing, makeup, transportation, and so on. In this way, the girl becomes dependent on the pimp, and it will be harder to escape him.
​
Speaking of control. A pimp who controls his prostitute is keeping her “in pocket.” Pimps use various methods to control their girls. Some pimps use physical violence to keep them in line. Some use various levels of affection. No two pimps are the same and all have their own style and level of control. Some hold much tighter control than others. Some pimps will threaten to kill their girls if they try to escape. Some have actually done it. Some will let them go without a fight.
​
Some pimps have a monetary quota for their girls every night. A common quota is $1000 per night. I spoke to one girl who told me that if she didn’t meet her quota for the night, her pimp would drive her to a “day track” and she would have to keep working until she met the quota.
​
A pimp with multiple girls usually has a main girl. This girl is called the “bottom bitch.” I hate all the terminology involved in pimping, but I probably hate that term most of all. I’m hesitant to write down these terms because they’re so vulgar, but I think it’s important to not shy away from the truth of this industry. The more people who know about how despicable it all is, the better.
​
Anyway, the main girl is sometimes the pimp’s girlfriend. Or at least he tells her that’s what she is. He’ll have sex with her and treat her better than the other girls. The main girl will train new girls and help the pimp manage all the girls. The girls often all live together in one house or apartment, so there is all sorts of drama that the main girl helps control.
​
I’ve come across two main girls who were so involved in the process of managing and controlling the other girls, that they got arrested as well as the pimp. I arrested one girl for pandering. In my state, pandering is a felony and it’s basically assisting with the act of prostitution. The other main girl was arrested for human trafficking. That case wasn’t mine, but it involved a victim who was kidnapped and forced to be a prostitute at gunpoint. And the main girl was so involved, she was almost as guilty as the pimp. The pimp in that case got over 200 years in prison. The main girl took a deal and got 5 years if I remember correctly.

The pimp usually drives the girls to the track himself. Remember, he likes to keep tight control of his girls, so he doesn’t like them to have access to a car. So he drives them there, drops them off, and usually waits somewhere nearby in the car. The girls walk the track and try to attract customers (Johns).
​
While the girls are walking the track, they will update the pimp on their activities. They may have a certain timeframe in which they are required to check in (every 15 minutes, half-hour, or whatever). They’ll usually update their pimp through a messaging application or with a call. They’ll almost certainly update their pimp whenever they have a “date.”
​
When a John picks up a prostitute, he will drive her somewhere away from the track to a more secluded spot. I use the term secluded loosely here. They may still be in a residential neighborhood. The girl and the John exchange money for sex. That is called a “date.” The John then drives the girl back to the track and she looks for another date.
​
Girls charge varying amounts of money for their services. I’ve seen prices range from $40 to $200. I’d say about $100 to $120 is probably more common. Prices are based on the specific service provided as well as how appealing the girl is to the John. Girls almost always make their customers wear a condom. If somehow the customer gets the girl to agree to not use a condom, that will drive the price up significantly.
​
When the girl is finished with a date, she will probably notify her pimp. Pimps will usually collect the proceeds throughout the night. Sometimes they will collect the money after every date. They collect the money periodically because they don’t want the girl to get robbed and they also want to limit the girl’s access to money. Every time the pimp contacts the prostitute, it’s a risk for him. He’s exposing himself to identification as a pimp.
​
Pimps will take their girls to different tracks. I’ve arrested pimps who lived thousands of miles away from my city.
​
When the night is over, the pimp will pick up the girls and take them back home or back to their motel. Like I said, the pimp could be thousands of miles away from home. In this case, he’ll probably work that particular track for a few days while staying in a motel. Special events that attract large numbers of people to a particular city (sporting events, car conventions, ect.) sometimes dictate a pimp’s choice of a particular time and location to set up shop.
​
How to Arrest a Pimp
Several years ago, I was assigned to the section of my city that contained the area where the prostitutes congregated. Like I said earlier, this area is known as, “The Track.” The other terms I’ve heard are “The Blade” and “The Ho Stroll.”
​
I knew nothing about pimping or prostitution at the time and I had little interest in it. I also worked the day shift so I never thought I’d be enforcing pimping or prostitution. But my partner and I were pretty proactive. We shook the bushes and turned over rocks at every opportunity.
​
Like most cops, we used the pretext stop as the primary tool of our observation arrests. That is, we stopped people for minor violations in search of more serious criminal behavior. And we were always looking for ways to improve our odds.
​
One day, I noticed that there were still several prostitutes walking around at the beginning of my shift. I figured that stopping a car who picked up a prostitute would be a good stop. I wasn’t really interested in arresting a John because that crime is just a misdemeanor in my state, and I was mainly interested in felonies. However, I figured that stopping guys who picked up prostitutes would improve our chances of finding guys with dope or guns or whatever.
​
So I picked out one of the girls and I went inside a restaurant and watched her through the window. After a few minutes, a car pulled up and picked her up. I notified my partner of the activity and he made a traffic stop on the car.
​
The occupants of the car weren’t what I expected. Instead of one guy, there were two. And upon a search of the car, we found several items that belonged to the girl, including her ID, which was in the driver’s door pocket. These guys definitely weren’t customers. We also found a gun in the glove box.
​
So that’s how we made our first pimping arrest. Of course, we had little idea of how to put the case together. We had to call an experienced vice officer (in the early morning hours on the weekend) to figure it out, but we did figure it out eventually. The pimp’s name was “Magic” (pimps always have nicknames like that) and he ended up pleading to a 5-year suspended sentence.
​
After that first stop, we devised a system. Here it is:
​

1. Identify a prostitute on the track. They can be identified by their clothing (provocative, especially if it’s in contrast to the weather), lack of destination (they just walk around from one corner to another and back again), and interest in passing vehicles (especially vehicles with a solo male occupant).

​

1. Build a prostitution case against the girl. Watch her for a bit. Build reasonable suspicion for an investigatory detention based on the indicators in step 1. Check your local statutes. At the time, we had a statute for loitering with the intent to conduct prostitution.

​

1. Detain the girl. Get her information. Try to get her to admit she’s there for the purposes of prostitution. Tell her you’re going to let her off with a warning, but tell her it’s time for her to go home.

​

1. Let the girl go and conduct surveillance on her. It’s not easy to do in full uniform while driving a marked police car, but it can be done. The next car to pick her up will probably be her pimp, especially if it’s 5 or 6 in the morning. The pimp is going to know that you’ve identified his girl as a prostitute, and he doesn’t want her getting arrested. If it’s late in their shift, they are probably ready to call it a night anyway.

​

1. Stop the next car that picks her up. If you can get a traffic violation or equipment violation on the car, that’s good, but not necessary. If your observations in step 1 are solid and your conversation in step 3 went well, you already have reasonable suspicion to make the stop. Remember, pimps must keep tight control of their girls. They take them to and from the track. So logically, who is going to pick them up when their shift is over? My partner and I made 10 traffic stops over 4 months using this method. We made 9 arrests for either pimping or human trafficking. The pimps picked them up 90% of the time. Only one girl got picked up by an Uber. Not one girl had the keys to her own car.

1. Detain all the occupants of the car in separate patrol cars. Move the pimp out of eyesight of the girls.

​

1. Talk to the girls separately. Have a speech prepared. It should start with something like, “My name is Officer SoandSo. I care about you. You do not deserve to be treated like this…” Try to get the girl to admit that she is a prostitute, and the guy is her pimp. This is not easy to do, but it can be done. Social interactions with suspects are not my strongest area as a cop, but I got about 50% of the girls to cooperate.

​

1. Try to get the girl to consent to a search of her phone. Search the calls and text messages and see if she’s been communicating with her pimp all night. Do not let her have control of her phone. I learned this lesson the hard way when I let a girl unlock her phone for me. She unlocked it alright. She proceeded to delete the entire text message thread between her and her pimp before I could snatch the phone back.

​

1. Collect your evidence. Evidence of pimping will consist of cell phones, condoms, motel keycards, clothing, victim’s ID (Where the ID is located is key. Pimps will usually control the victim’s ID to frustrate cops and control the victim), money, and firearms.

​

1. Interview your suspect. I didn’t get a single confession from a pimp. They are notoriously difficult to deal with. However, they are going to give you some BS story about how the girl is his friend and she called him to pick her up because she got stranded somehow. If you can show that their story is BS through your investigation, it will help.

​

1. Make an arrest decision. The two most important pieces of evidence in pimping cases are the victim’s cooperation and cell phone text messages. All of my arrests had at least one of those two pieces of evidence. I had to let one guy go because in that case, I had neither.

Notes
When searching the victim’s phone, I would set both the victim’s phone and the suspect’s phone on the hood of my car, side by side. I would use the victim’s phone to call the suspect’s phone. When the victim’s caller ID popped up on the suspect’s phone, this would prove that the pimp was in possession of the phone that had been communicating with the prostitute all night.
​
“Daddy,” or some variation thereof, is a common name a prostitute will use for her pimp. The contact in her phone will sometimes contain this terminology.
​
Pimps will sometimes require their girls to get tattoos with the pimp’s nickname. This is another form of control. It also demonstrates ownership of the girl to stop other pimps from stealing her.
​
See if your city or county offers resources for the victims. Sometimes they can provide cell phones, bus tickets, food, lodging, ect, for the girls. The cell phone is key because the girls get very upset when you confiscate their phones as evidence.
​
Treat the girls with dignity and respect. Don’t sit them on the curb. Have them stand or put them in the back seat of a patrol car. They don’t need another male asshole in their life talking down to them.
​
Almost all street prostitutes have a pimp. Like I said, I conducted surveillance on 10 girls and only one got into an Uber. I suspect she had a pimp as well, but he was more savvy than the others. That being said, a prostitute without a pimp is called a “renegade.”
​
If you detain a prostitute who is under 18, don’t let her go. My state has a statute in which we can detain her for her own safety and transport her to a county facility for resources. Try to get her cooperation to identify her pimp and confiscate her phone as evidence. You probably won’t be able to make this arrest as a patrol officer, but your vice unit should work up a case like that right away. In my state, pimping a girl under 18 is human trafficking, a crime punishable by up to life in prison.
​
Check the girls for bruises. I made a traffic stop once and both girls were all beat up. They initially told me they got into a fight with each other. Eventually they admitted their pimp was beating them up. Pimping through force or violence is also human trafficking in my state.
​
Ask the girl about how and when she met the pimp. Just because she’s over 18 now, doesn’t mean she was 18 when she started being pimped out. If she was under 18 when it started, then you have a human trafficking case.
​
When searching the phones, look for text messages demonstrating that the girl is updating the pimp on her dates. They usually have to text after every date. I remember one girl just texted, “Date” like every 20 minutes for a while. Then the texts became just, “D”. Texts containing dollar amounts are also good. The girls will tell the pimps how much they just charged or how much they have on them, ect.
​
Like I said earlier, condoms are a good piece of evidence. I opened a glove box once and like 200 condoms just poured out. I’m pretty sure a girl out simply for a night on the town doesn’t need that many.
​
I also mentioned clothing earlier as sources of evidence. I often found that the pimp’s car was full of women’s clothing. It’s certainly not the smoking gun, but it’s another piece of evidence. You don’t need to book it all. Just take some photos or record it on your BWC.
​
There are internet sites where prostitutes advertise. When I was making these arrests, the site was called “Backpage.” I believe that site got shut down, but there’s probably another that’s take its place. I think the new one may be called “spotlight” or something like that. If you google the girl’s phone number, sometimes their ad will pop up. Just another piece of evidence.
​
Find out if the pimp is having a sexual relationship with the girl. In one of my human trafficking cases, the pimp was having sex with an underage girl. Obviously, this added additional charges.
​
Obviously, use caution when dealing with the pimps. Two pimps I arrested had guns. One led me on a pretty crazy pursuit. After he crashed, he kept reaching under his seat. Later, when we searched his car, we found a gun under the seat. I believe he wanted to have a shootout, but he just couldn’t find the gun under the seat. It had probably shifted due to the crash.
​
Pimps often have rental cars. Like I said earlier, sometimes they fly into the area for a few days, then go back home.
​
Like the title says, this post only covers street pimping. There are other facets to pimping/prostitution such as hotel pimping/prostitution. In such cases, girls work out of a hotel room and customers come to the room, exchange money for sex, and then leave.
​
Remember, if you are trying to arrest a pimp, the prostitutes are victims. Treat them accordingly.
​
Be prepared to have some patience when dealing with the girls. They are not easy to deal with and they will not appreciate your efforts.
​
I did not learn the information in this post by reading a book or watching a documentary. I didn’t even learn this stuff by going to training. All of the above information was gained through experience on the street. Almost all my reddit posts contain information that I have learned from experience, rather than in a classroom. That’s why my posts do not contain fluff or irrelevant information.

TW: Mention of child abu*e. It's not too graphic, but it's there.
I tried posting this on AITA through a different account a couple days ago, but it didn't work out. Given the trigger warning, I'm not surprised. I have since concluded my wife and I did the right thing, so this will be my last attempt to post this story. I tried to add some info and change the wording a little. All names are fake.
My (28M) stepmother (49F) is a wannabe party planner. She has taken it upon herself to plan and host every party and holiday my dad's family has thrown since she married him. I never loved those occasions growing up (she’s controlling and gets upset if people complain about anything), but humored her for my dad’s sake. According to him, this helps her feel included.
I’m getting married to my fiancée Jane (26F) in July. We got engaged in early 2021, but Jane ended up getting pregnant a couple months after that, and we decided to postpone the wedding to focus on our son for a while. So we’ve had a long engagement.
My stepmother has tried to hijack our wedding plans from day 1 (complaining, contacting our planner, showing up unannounced to Jane’s dress appointments, etc.), and we have repeatedly asked her to stop. Dad wants us to humor her, but she’s clearly resentful of the fact that she’s not hosting the wedding or being labeled “mother of the groom” in invitations.
Besides our baby boy, we also have Luke (4M), Jane’s paternal half brother. She got custody of him a few months into our relationship, after his parents died. I ended up moving in with them during the pandemic, and have been in Luke’s life since he was a baby. He doesn’t call me “dad”, and refers to us as “his sister and his OP”, but we love him like a son.
Stepmother, though, hates Luke. She accuses Jane of “baby-trapping her way into the family” (that accusation only got worse after our son was born). My dad gets along with Jane and adores the kids, but stepmother demands him to refuse babysitting Luke, so we don’t leave the kids with them often. Instead, Jane's brother and SIL usually watch the kids for us, as their children are close to ours in age.
We had a thing last Sunday, and my BIL was out of town with his family. Jane's other siblings live in different cities, as well as my mom and sister. My dad agreed to babysit at our place, and we left.
We came back to find both kids crying, stepmother screaming, and dad weakly trying to calm everyone down. Apparently, Luke had told stepmother that both he and our son were going to be our ring bearers, and she went ballistic. She screamed that she wasn’t going to allow that because he wasn’t family. She then made me need to include the trigger warning when he started crying. His lip is still split. She'd never gotten to this point before.
We immediately banned her from our house and from our wedding. Dad is fuming and has said he’s not going without her. He’s also convinced half of his side of the family (by severely downplaying what stepmother did) to boycott the wedding as well. This includes my stepbrother, who fully agrees with his mother no matter how many times I try to tell him the truth.
Me and Jane are refusing to budge, but many of my cousins who aren’t coming anymore are asking us to reconsider. Pretty much all of Jane’s family agrees with us, but one of her aunts has suggested that maybe stepmother is acting out because she doesn’t feel welcomed by my family.
I've honestly had it with my family enabling her behavior. I love my dad, and really want him at my wedding, but I am more than willing to go NC if it means protecting my family.

EDIT: I think I accidentally deleted the paragraph where I mentioned this, but we did press charges. We took Luke to the pediatrician the next day and gathered every piece of evidence we had. Not only did we have pictures of Luke's face, but by some miraculous strike of luck, we also had nanny cam footage. Some commenters were right to assume that my SM hadn't been invited to our house, but my dad hasn't really gone anywhere without her in years, so we took precautions. We didn't expect her to actually do anything this awful, but we've never trusted her with the kids. The physical attack happened off camera, but there is some footage of her screaming and Luke crying before and after the event. She now has a child abuse charge on her rap sheet. We wouldn't let her get away with this.
EDIT 2: There is a lot of additional info I want to add. I'll try to respond to at least some of the comments (I DID NOT expect the amount I've gotten so far), but all I'll add for now is that Luke is okay. The visit to the pediatrician happened the day after. He already had a counselor (Jane was pretty traumatized when her dad and stepmom died, and was worried it would rub off on him) and will continue treatment. We've been hugging and pampering him a little more than usual, too. He's still upset, but is already doing much better.
Update 5 days later
I want to thank everybody who took the time to read and/or comment on my previous post. It's been a tough week, but it's always great to know that people care. I haven't been able to reply to every comment, but I will try to address some in this update. This might get a little long.
I'll start off by saying that me and Jane are going NC with my dad and SM. We haven't really spoken to either of them since the incident, and I don't plan on being the one to reach out. Any communication between us is being handled by my younger sister. She's completely on our side, but will remain in low contact for the time being.
I've decided to adopt Jane's way of dealing with people she cares about: forgive what's apologized for, but never forget. Basically, if dad or SM ever truly understand what they did wrong and sincerely apologize, we're willing to forgive them, even if begrudgingly so. But we will never ignore (or let THEM forget) what they did to our family. And for the time being, neither of them will be allowed near Luke, our baby, and any other kids we may have in the future, even if we do forgive them.
As for the rest of my family: I read A LOT of comments suggesting that I post pictures of Luke's face, as well as the nanny cam footage. I'm not very active on social media, but even if I was, I'm not comfortable exposing my injured preschooler like that, especially given that nothing on the internet ever truly goes away. I also decided not to share the pictures with my family unless truly necessary.
I should probably mention that while my family adores my dad, most of them aren't very fond of SM. She had two failed marriages prior to meeting my father (the first of which resulted in my stepbrother), and he cheated on his then-girlfriend to be with her. My family loved that girlfriend, and disliked SM right away. Not only has she been controlling and manipulative since the beginning, she's also tried to force her way into the "family matriarch" role by any means possible. Taking over planning duties for every family event was her favorite way to do it, because of all the attention and compliments that come with it. The main reason why I hated these parties growing up was because she'd always find a way to make everything about her, including Christmas and mine and my sister's birthdays. The rest of the family felt neutral about it, but they never liked her.
With Luke, it was different. Most of my relatives didn't meet him until COVID restrictions got looser, and by then he was 2 years old. He's a bright and genuinely loveable kid, and there weren't really any other small children in the family, so everyone immediately started cooing over him. The way I see it, SM got upset that Jane and Luke were accepted by my family so easily compared to her experience, and that's why she resents them both, but I can't confirm that.
She was also mad that, aside from not being the planner, she would have absolutely no involvement in the wedding party. She tried to pressure us into letting her officiate (one of Jane's best friends was offered that role a year ago), making stepbrother my best man (he wasn't interested, and I'd already gotten my best friend) or asking her sister's daughter to be our flower girl (we'd promised Jane's 3-year-old niece, also her sister's daughter is fifteen and doesn't know us). She also tried to convince us to let my dad walk Jane down the aisle, since her father's gone, but her eldest brother (the BIL I mentioned in the first post) had already been enlisted. SM was disappointed that my family wasn't as involved in the wedding as Jane's, and kept making comments about how that "would never happen if we put her in charge".
All of that being said, there is NOTHING that can excuse being that awful to a child, especially if it really is the petty jealousy that I suspect.
Because I haven't spoken with my father, my sister has been keeping me updated on what he's been up to. As I found out through her, the story my dad and SM told the rest of the family completely erases Luke's injury and the abuse charges. It insinuates that me and Jane banned them because we got annoyed with SM and decided to take it out on my dad as well. Because most people already disliked SM, explaining what actually happened that night wasn't hard, and most of the relatives that I actually wanted at the wedding have apologized and are berating my dad as well.
The people that didn't believe us, as well as those saying we overreacted, have been told they are not welcome in our home anymore. Those are mostly people from my dad's generation, so I can't say I'm surprised. But the realization that they are so biased they're willing to protect a woman they hate (after she hurt a child) just to make my dad happy has reassured me that I don't need any of them in my life.
Stepbrother is still in denial. He refuses to believe his mother could hurt a child, even with all the evidence we have. I have to admit I understand, I love my mom too, but that doesn't mean I'd excuse his obliviousness. So he's banned too. It sucks, because we were close growing up, but I don't regret it. Besides, Jane has 3 other siblings besides Luke (the older BIL, a twin brother and a younger sister), and I'm closer to them than I ever was to him.
Speaking of Jane's family, they're all furious over what happened, and have been extremely supportive of us. Jane's maternal family basically adopted Luke after she got custody of him, and have called frequently to make sure he's okay. We did manage to save some money with everybody we uninvited, and have decided to use it to help Jane's cousin. She lives in a different country, and was previously unable to come to the wedding, so we're paying for her plane ticket.
Luke has gotten much better, and is almost completely back to being the sunny child he's always been. The split lip was shallow. It's healing slowly, but didn't require any stitches. We sat him down a few days ago, and explained that my dad and stepmonster wouldn't be around anymore. He really liked my dad, but understands that he and SM are attached at the hip. He's clearly scared of her, but we're doing our best to make him feel safe. Me and Jane have reassured him that he IS family, we love him, and no one will ever change that.
I'm not too worried about dad or SM trying to show up at the wedding, but we've alerted the venue and given them pictures just in case they try anything. Better safe than sorry.
Some people brought attention to the fact that SM is a hypocrite for saying Luke isn't family. I agree, for obvious reasons. Her main excuse for pretty much everything she does is that she doesn't feel like my family welcomes her. Dad has been guilting me to take part in everything she plans by reminding us of that for as long as I can remember. The way he continues to make excuses for her without realizing this is basically a case of the pot calling the kettle black (except Luke actually IS family) is what has made me accept that, while I will always love my dad, it's not healthy or safe for me and my family to be around him anymore. It hurts to know my son won't have his only remaining bio grandfather in his life, but he has two amazing step grandpas to make up for it.
For now, I'm sad, but satisfied with how things have turned out. I don't like to complain about my life. It's a mess, but a beautiful one. I love my fiancée, I love my kids, and I'm lucky enough to love my job. We're happy. I'm not letting anyone ruin that.
To whoever was annoyed at my censorship: when posting on AITA didn't work out, Jane suggested I make the writing less explicit. I'm not used to Reddit yet, so I might have overdone it a little bit.

The only reason why I know that this is the first time she's hit him is because this was the first (and last) time she was with the kids unsupervised. Me and Jane were around every previous time she saw Luke. She didn't want my dad to babysit him, and we'd only asked him to on a few occasions before. My sister was still living with them at the time, and has assured me that Luke was never out of her sight. I know and trust my sister enough to believe her.
First time or not, I will not give her a second chance. She'll never hurt either of my kids again.

We've actually had passwords with the vendors since day one. Some of the earlier ones we met actually recommended us to do it. SM did contact our planner a while back saying she had our approval to talk to our vendors. She didn't let her, and we got a bit more strict with passwords after that.

So is SM serving any jail time? If she attacked a child then and you guys pressed charges I would imagine she would have to be processed and eventually serve some time for her crime.

Start a file for SM. Keep any and all texts, voicemails and attempts of her communicating. Do the same with anyone who has taken her side because she could escalate and you may need that info. Those people are flying monkeys and she’s sent them to not only plead her case, but report back to her the things you may have told them so she can continue to play her victim card. You were great to have the nanny cam, but should also make sure to notify his daycare or school that she is not to be given info or access to him, get cameras hat have audio just in case she shows up at your house and password protect all of your wedding vendors and let them know not to give her any info and to notify you if she tries. Your dad may be harmless, but she’s not.

OP: That 2nd advice is something we've been pretty occupied with, actually. This past week has been mostly about the kids and collecting evidence. But I'll definitely check out the JNMIL sub.

Did you say that if your father and stepmonster apologize that you will allow them at your wedding? I wasn't quite sure what you were saying.

OP: ABSOLUTELY NOT. My father and SM are not welcome at the wedding, no matter the circumstances. They could offer me an island and I'd still refuse to let them come back into our lives right now.
I only plan to forgive anything far off in the future, and only if they apologize sincerely. Even then, they will have no access to the kids for years after that. Knowing SM, I highly doubt she'll ever feel sorry for what she did, so we're not counting on it anyway.
