Greetings everyone! I've recently released the 2100-2150 lore, but I'll also try to summarize all the good bits here in case you don't want to read all that. I'll also summarize the stuff from WW4 onwards, since that may not be perfectly well understood as well as the stuff from 2022 to 2068.
Here we go!
- After the devastating fallout of nuclear winter and great floods, the world huddles together and waits for the cold to clear up. Many more continue to die between famine, floods, and general devastation as many areas have fallen into anarchy.
- The Global Defense Coalition is set up as basically a slightly better United Nations, which has its own army, as well as the fact that most countries are now democracies help the GDC function better. Though currently it’s just a diplomatic forum.
- The Absurdist Era runs from roughly 2068 to 2080. It’s also known as the 2nd Progressive Era, where decades of repression lead to a few bright decades of reform. Politicians during this time include Alisha Crowder, who undid most of the religious nonsense of Cortez, though not all of it. She is the leader America needed, properly reconstructing democratic institutions after the Jackson administration had to cannibalize many of them to win the war without bureaucracy slowing things down. He was only half-done reconstructing everything before his term ran out, and elections came back. The USA could have legitimately fallen to autocracy when the next leader took power with only half restored checks and balances. But Crowder was the one who restored it, and she got the US back and running on democratic values. Later on she would be disillusioned with the United States, became an anarchist, and would be the only ex president to assassinate another ex president (Julia Land). This either is a sour ending for what was otherwise a great leader, or something that makes her even more unfathomably based.
- Many movements, such as Postsocialism (Neo-socialism), Postcapitalism (Hypercapitalism beyond corporations), and the Solarpunk movement would come out of the experimental vacuum that was the Absurdist Era.
- The “Progressive Three” are a group of countries that are well… Progressive when it comes to social change and “the new thing”. These are Dravidia Nadu, inventor of psychic autotranslators and a hotspot of linguistic diversity, the Argentine Confederation, center of the new Progressive Catholic Church that schismed from Rome, and the Union of South Africa, who have managed to make many races and cultures intermingle while aggressively addressing systemic oppression.
- In 2080, the Absurdist Era stopped due to expanding lifespans and healthspans of humanity, with the expanding lifespans greatly tipping the balance of power towards older generations, leading to a halt of progressive reforms, as reform stagnated.
- That said, it was still a time of great space colonization. Humanity’s energy primarily went towards space colonization and reconstructing the Earth. President Snowden (2084-2192) is basically Sundowner from Metal Gear Rising Revengence, singlehandedly destabilizing the entire world with PMCs and copious amounts of guns. He does however also fund space colonization and start the mass colonization of Mars.
- Bernie Sanders is elected in 2092, literally the only thing he does is pass free healthcare before collapsing on the Resolute Desk. Reed, his vice president would take office afterwards, and stop President Snowden’s PMC adventures. The reforms may have stagnated, but they haven’t stopped.
- The Century Message is a message received by Earth in the year 2100, telling humanity that they are loved. The intent and specifics behind the message remain a mystery, though it seems to come from the star of Vega.
- The Global Defense Coalition is empowered to be the face of Earth when it comes to aliens, and is given a lot more power to have its own spacefleet and be a force in its own right. This was done after fear of alien life was confirmed.
- The Noosphere is discovered in the same year. For now it’s an unknown other dimension, but it is later discovered it’s the realm of human thoughts, consciousness, and souls. It is almost like a cloud where the collective consciousness of mankind is stored, and where past information can be accessed. The Noosphere is the source of psychic powers, though for now it only allows people to read memories from written records.
- The Fatalist Twilight Wars is triggered when East Germany tries to reunite with West Fatalist Germany, which results in a war between FATES, the European Intermarium, Nigeria and Russia. The war sees the reunification of Russia, the reunification of Germany (including both Austria and the Rhineland), and France giving reparations to Africa. The European Intermarium is renamed to the European Commonwealth, as the banner of democracy flies over Europe once more.
- FATES escapes to the Metaverse, but it goes wrong, and his consciousness is shattered. A great hunt begins for his remaining pieces.
- In 2117, the Immortal Era begins, with aging being eradicated by Nigerian scientists. This change is quickly pushed on the entire population, and now those now living may never die. This starts a great decline in religion, with Irreligious people now making up 30% of the population, mostly in the Old World, with the Islamic countries and the New World remaining more religious.
- Healthcare spending drops immensely, and social security is abolished. Countries use the extra revenue to colonize space, build up their military, or fund generous social welfare programs.
- Uplifts are created where animals such as dogs and cats are given implants to reach around human-intelligence. They’re somewhere on the level of stupid humans but can now understand human language. These uplifts would eventually be integrated into society on a small scale, but much like disabled people the infrastructure was not designed for them, and they require special care. The uplifting of cattle creates a hypergenocidal race hellbent on destroying humanity for the sins of factory farming.
- 2120 to 2138 is the Golden Age of Mankind, and the peak of democracy on Earth. Nearly every grand power was a democracy, and nearly every human lived under a nation with liberal democratic values. The benefits of immortality led to a massive surge in productivity, which Earth channeled into colonizing the stars. The United States works on something called the “Martian Lifeseed”, a modified version of the Pyongstrocity organism that could slowly infect and partially terraform Mars. Though experimental, it accidentally became contaminated with Mars.
- The Eden Treaty is established between several nations to slowly terraform Mars with the Eden laser. America had to give up much of its land on Mars to other nations to get their cooperation to terraform Mars, but they still own somewhere around 60-70%.
- First contact would be made in 2138, marking the end of the Golden Age of Mankind. Miscommunication and misunderstandings would lead to the First Solar War, a massive war that would devastate the two greatest powers on Earth; Nigeria and the United States. 80% of the invasion force was sent to deal with Nigeria alone, while a contingent force was sent to try and destroy the United States. Nigeria would shatter, and Pax Africana would end, but not before taking out the might of an entire alien planet out with them. The surviving powers would create a new world order centered around Asia, and especially the city of Hong Kong. (Islam, ASEAN, India, China, the Asian Quadrilateral)
- The United States would unite with other countries in North America into the North American Federation to pay for reconstruction. The scorching of the Midwest horribly devastated its industrial sector, and much of the might of the United States had been broken. The Federation would represent democratic backsliding of the North American continent, as the government that replaced it was less egalitarian and far more militaristic than the old government.

I'm a little surprised by the volume of T5 slips I'm seeing NOT showing up when downloading client data. Using Represent A Client I note that the T5 slip is also not showing up in their portal.
They do, however, have a printed/mailed T5 slip in their tax packages. I've seen this for a few people from a series of different banks and credit unions already.
Wondering if something got particularly messed up in the CRA system this year?

I’m 30 and recently accepted into an International MBA program in Europe (I’m American). It is a “deferred-only” country for US federal student loans; which just means that while in graduate school, any undergrad loans are paused. (Doesn’t help me much, since they are paused anyway). It also means I cannot get a federal loan for this International program.
I’m trying to figure out if I should take out a personal/ private student loan to pay for the program or if I should try to swing it out-of-pocket?
After discounts - the program is €16k.
I currently owe 10k in fed undergrad loans which I’ve been making $250 payments on while the interest is 0.
I also owe around 6k in credit card debt, but I plan to pay it off before I begin grad school.
I have semi-passive income of $30k/yr from an investment. This will be my main income while in grad school + I can work 20hrs per week on my student visa + a paid internship.
I have a used SUV that is paid off, which I will sell before I move abroad (est $13-$16k).
I will also have rent of €800-€1300 per month.
I was originally thinking that it would be nice to have a loan because of the extra costs, but now, I’m wondering if I should just pay out of pocket or ask family for loans? I looked at private education loans and the total interest amounts scared me.
The school asks for various payments throughout the program, so it’s not all due at once.
*forgot to mention: I own a home worth 500k which I currently owe less than 200k on. I know a HELOC is an option, but I’m hesitant to do it because I’d never want to risk it. My equity is my only “savings”/retirement right now.

I’m wondering if you guys can help me out… here’s the deal I bought my current car (2019 Alfa Romeo Giulia) in August of last year with 24,000 miles and an amazing loan from my credit union at 3.9 percent iirc. It’s been great but I drive a lot and the warranty is about to run out (I’m up to 40,100 miles now it runs out at 50,000). The issue is my work situation has changed a lot in the last week and I am worried that I’m going to have a hard time getting into a new vehicle.
To cut a long story short this time last year I was stacking up loads of hours fixing boats for a sailboat charter company. Side note; I’m a marine mechanic I bought the Alfa because European sports cars are what I grew up with and all I’ve ever owned. In hindsight I should’ve bought a pickup. Then the winter came, things slowed down a ton and there are no indications of it picking back up (I didn’t realize how hilariously mismanaged my old company was till I heard we don’t have any bookings for the beginning of the summer).
The good news is I’ve made friends in the boat scene and I’ve been working on starting my own boat maintenance company but it’s going to have to be my primary source of income a lot sooner than I initially anticipated. The problem is, I don’t think I’ll have the income necessary to qualify for another loan for a truck. So my question to you guys is, is there a way out of this that doesn’t end with me upside down in debt or stuck with an out-of-warranty Alfa? Thanks for your help guys. I’ll freely acknowledge that I’ve made a few mistakes here I’m just looking for a way out now.

Born on the 21 September 1957, Kevin Rudd was born to a family of Country party officials. Despite his family's right-leaning positions, Kevin joined the Labor party at age 15. Being dux of Nambour State High School in 1974, and also the state winner of the "Youth Speaks for Australia" public speaking competition displayed his future political prowess. Rudd studied at the Australian National University in Canberra and graduated with a Bachelor of Arts (Asian Studies) with First-Class Honours. Later, he majored in Chinese language and Chinese history and became proficient in Mandarin. These relatively humble beginnings showed not a future Prime Minister, but a student going to study in China in the future, however, Kevin was different. From 1988 he rose to the rank of Chief of Staff to the opposition and then Premier of Queensland, Wayne Gross. After the loss of the Gross majority in Queensland, Kevin went up into federal politics, winning the seat of Griffin in 1996. Becoming Minster of Foreign Affairs, Kevin was constantly the subject of potential leadership spills, but he never obliged, instead remaining in his upper cabinet role. This was until 2006 when he finally decided to contest the leadership of Beazley and won. With polls showing Labor’s support doubling with Kevin Rudd, this was the right call. Kevin had now risen from the son of a Country Farmer to the new, charismatic Opposition Leader of the Labor Party walking into the 2007 election. Would he fizzle out, or would he continue his rise to Prime Ministership?

Let's look back at the Liberals and their leader for 10 years, Prime Minister John Howard. He had won a number of elections, winning 1996, 1998 (he should’ve lost; Bezely ALP won the 2PP but lost on seats), 2001 and 2004, however, this would be a tough election. Longtime governments were usually not reelected, and Howard made one huge mistake -- WorkChoices. WorkChoice was a piece of unpopular legislation that hugely impacted unions (one of Labor’s largest voting bases). Kevin Rudd ran hard on it in his 2007 campaign, which contributed to his landslide victory. Further reasons for his large win were his fiscal restraint-- removing the Liberal's “better economic managers” label--, charisma, smooth-talking in debates, and general appeal. All of these factors help Kevin Rudd bring a 5.44% (American 11%) swing on the 2PP, causing him to gain (and Liberals to lose) over 23 seats in the election. Not even John Howard himself could survive this wave, with Labor winning his seat. For the first time in over 2 decades, Labor had won a majority of seats in Queensland. This election was unprecedented. Riding on his wave of popularity, Kevin crushed his opposition leader 70-9 in preferred Prime Minister and polled close to 60-40 in the Federal vote. No way anyone or parties could get in the way of this. He was bringing massive change, bringing Labor spending, an Apology to the stolen generation of Aboriginals and working on climate change. He would be like his American compadre just elected, Barrack Obama and bring massive change. He would keep the Labor government in power for over 2 decades. He would be the red Menzies… right?

2023.04.01 04:47 Adventurous-Plant419 Michael Alcock King, Joshua Myers, Andrew Cash, Mark Essick, with overt deliberate negligence on the part of the entire Board of Sonoma County Supervisors, stole 6 years of my life, after their employee Virgil Smith almost killed me and caused me serious injury.

I just want people to know that the Sonoma County government is corrupt. They spent 186 million dollars on a "new courthouse" that is 163k square feet, which works out to $1,100 per square foot, which is over double the second most expensive building I could find was, and over four times the average price per square foot of palaces and museums. And it's just going to look like a giant portable. This is to house some of the most corrupt people in this County, who all make $200-350+k per year (I am including their benefits in that, but not their pension). The entire DA's Office has a vendetta against Civil Rights in general, and will literally knowingly commit criminal violations of laws for the purpose of covering up serious criminal misconduct on the part of Sonoma County employees.
Lynda Hopkins took money from the law enforcement unions, and turns a willfully blind eye to it.
The County Office of Legal Counsel is literally a crime syndicate.
In 2015, the Sheriff's Office had a veritable torture ring in the jail.

This is just the tip of the iceberg. They lied about the existence of these videos, and "lost" the one where they gave one of the inmates internal bleeding, with a knee to their back.
There was a lawsuit about it. It was called the "Yard Counseling Case". There are news articles about it.
There was an official, written policy, called "Yard Counseling", later its name was changed to "Behavior Counseling" which dictated that for arbitrary punitive measures, Sheriff's Office personnel should extract inmates from their cells individually (which meant slamming their heads onto the door frames on the way out and other abuse), and isolate them, and putting them into "pain compliance" techniques (literally, by definition, torture) for extended periods of time while "counseling" them, which meant wearing no name tags, ski masks and riot gear, carrying a shotgun with them, and insulting them in explicit language for over 20 minutes.
This official written policy was acknowledged by Rob Giordano in a video, where he lies that no inmates where injured, uploaded to YouTube in 2018, when they finally addressed this official written policy, and the practice of torturing inmates without reasonable cause (leading exercise routines, for example).
In 2021, they saw one of the victims of this torture ring, who had sued them and had won, at a peaceful protest, and shot him with a grenade launcher while hiding on a rooftop in the face with a crowd control grenade, which exploded on impact and caused horrific injury that I don't care to describe.
In 2017, I was almost killed by application of a "carotid hold" / lateral vascular neck restraint, by a sheriff's deputy, for literally no reason. A knee was placed on my lower back while I was on the ground on my stomach as well, which caused a serious injury to my kidney, which was the worst injury of my life. I have also been diagnosed with an organic brain injury and cognitive impairment. I was tested for the same type of cognitive impairment before the incident and there is a marked difference, and I have about 30 pages describing the differences I've noticed / troubles I've had in my cognitive functioning. There was no probable cause to arrest me, and I was polite and compliant with all the instructions given to me, and this was confirmed by witnesses. I was punished for invoking my right to remain silent, then my arm was grabbed and yanked up behind me, and then a carotid hold was applied because my body pivoted after the deputy grabbed and yanked my arm.
This occurred UNDER A CAMERA and IN FRONT OF WITNESSES. I called the Sheriff's Office the next day said I want to "make an official complaint in writing". I was transferred to Captain of Internal Affairs, Captain Mark Essick. I repeated my request, verbatim. He responded, verbatim: "We don't do that. Why don't you tell me what happened." I did. I told him it happened right under a camera. He said "The camera can't record." I asked for confirmation. He said the cameras "Don't have recording technology installed."
I asked the County for a claim form. They ignored my request, and instructed me to report the incident to IOLERO. IOLERO requested I meet with Internal Affairs, and I said fine.
Sgt. Andy Cash called me and scheduled me for a meeting at the Sheriff's den. I was made to walk first and guided upstairs to a meeting room, and then patted down for weapons, and the interview was recorded. For 75 minutes I was deposed about happened. He asked me repeatedly about my mental state after the incident. I admitted that I was upset after the incident, and he acted like that justified the whole incident. He explicitly promised to interview the 4 deputies who witnessed the event in addition to the 2 deputies who participated, as well as the arresting officer (who I told him would confirm that I was polite and cooperative), which he agreed "would confirm [my] demeanor", and a bystander witness I told him about.
I complained to IOLERO director Jerry Threet. Mr. Threet agreed that that was inappropriate, then resigned without reviewing the investigation.
For about 4 years review of the investigation was put on hold because IOLERO staff quit, and when more staff was hired, they complained of being understaffed. They had a budget of over a million dollars but only had 2 employees. They only reviewed one case per four months. And they put off "backlogged" cases and focused on new cases. My complaint was finally reviewed by Interim Director Garrick Byers who clearly stated that the investigation was not conducted appropriately. I have the letter from him. That still has never been made public.
After the interview with Internal Affairs, I corresponded with Lynda Hopkins, and she refused to give her opinion on the matter. I specifically complained that the carotid hold was being used recklessly, and it is a dangerous technique. This was in 2018. She forwarded me to Janell Crane, who then had me meet with Kristi Schultz.
I contacted the DA's Office and spoke to Richard Celli (who made $346k in 2017, and has gunned down two unarmed people, and was convicted by a jury in one of the civil cases brought against him by one of the victim's family, but the sentence was overturned by a judge, while working for the SRPD). The first time I spoke to Mr. Celli, he told me that another law enforcement agency should take my case. After that first time, him and the rest of the DA's Office openly refused to comply with the Victims' Rights Laws (CA Con Art. 1 S. 28), and the "policies" (which are legally binding under CA Con Art 5 S. 13) of the Attorney General stating clearly that they are to take complaints from victims if it can't be resolved with the department.
After the first talk with Mr. Celli, I called Rohnert Park Police as I was instructed, and they 3-way called the Sheriff's office and then transferred me. I spent about 30 minutes reporting the incident to a deputy, and he asked me questions in a fair manner. I called RPPD back and talked to the arresting officer and he positively clearly confirmed that I was "polite, calm, compliant, and cooperative" (or something nearly verbatim, I can't remember exactly any more).
Andrew Cash called me the next day, at precisely 7:00 AM. He told me he was driving. He was extremely confrontational with me. He said "There were 6 deputies [referring to the two who used excessive force on me, and 4 witness deputies]. You were combative." This was false. He had only interviewed one of the 4 witness deputies, and the other 3 had provided written statements. They said that they had witnessed force being used, that they had not participated in the use of force to the best of their memory, and that I "did not appear to be resisting". But again, he had promised explicitly to interview the 4 deputy witnesses, and the arresting officer
Internal Affairs exonerated the officers. The letter was signed by Eddie Engram, captain of Internal Affairs. I called Mr. Engram, and had an hour long conversation with him, and he told me to contact Sgt. Cash after April 1st.
I filed a federal claim on the last day that it was due.
Mr. Cash referred me to Legal Counselor, Kara Abelson.
Ms. Abelson spent a year and a half refusing to comply with the Public Records Act, the Rules of Procedure, and the Rules of Professional Conduct. She refused to provide me documents that I was entitled to under law, including the incident report written by Deputies Jacquelin Fazzio and Virgil Smith, and the recorded interviews that he promised he would conduct, and stated pretty clearly that he had conducted.
Kara Abelson spent a year and a half trying to claim that my federal complaint was time barred by 1 day when it wasn't. The judge (Yvonne Gonzalez Rogers) entertained this and forced me to respond SEVEN TIMES, before she finally admitted that the "law wouldn't allow [her] to dismiss my complaint".
After a year and a half, Kara Abelson finally withdrew from the case after I started citing the Rules of Professional Conduct to her that require her to resign or withdraw from the case rather than defend a civil case where defense isn't warranted. Nobody had disputed any of the allegations I had made. In fact, Eddie Engram had confirmed that what I said happened was not disputed by the evidence.
At some point around this time, either before or after Ms. Abelson withdrew, the 2 incident reports written by the two deputies, the written statements by 3 of the 4 witness deputies, and the recorded interviews with me, the 2 deputies who assaulted me, and 1 of the eye witness deputies, were provided, along with various other records from the facility. In the recorded interview, and the incident report, the deputies admitted that Virgil Smith had applied the carotid hold.
I had also reported the incident to the State Attorney General Public Inquiry Unite (Lupe Zinzin). She had told me, over and over and over, that the local DA's are required to take complaints from civilians in these situations. She refused to call the DA's Office, though. The DA's Office (Richard Celli, Mark Azzouni, David Kahl) refused to take a complaint from me. They (including the receptionists) hung up on me every time I called after no more than 2 minutes, for no reason, transferred me to dead lines, never returned any voicemails I managed to leave, told me explicitly that if I send a complaint, they will throw it away, and didn't care, at all, what the laws were. The receptionists also refuse to provide their names. The Attorney General's Office told me to send them a complaint, so I did. The DA's Office acknowledged receiving the complaint. But later said that they did not have a record of it, meaning they threw it away.
The Attorney General's Office finally agreed to take a complaint from me. It sat on their desk for a year. I finally called them, concerned that evidence was being destroyed, and left a voicemail for Casey Hallinan requesting that they request copies of the physical evidence from the Sheriff's Office. Literally 2 days after that voicemail, a letter was sent to me signed by Sharon Loughner with Casey Hallinan CC'ed on the letter, stating that they would "take no action", and blamed the incident on me. I had not received the letter though, and called and spoke to Ms. Hallinan, who was extremely rude. After that, the Attorney General's Office hang up on me as soon as they find out it's me, for no reason. There has since been a bystander witness who saw the whole thing, and it has come to light that the cameras did record, that no upgrades were ever performed like Ms. Abelson alleged, the cameras do continuously record (as of 2019), and they just lied through their teeth about the camera for 4 straight years. The Attorney General's Office does not care. They violate the laws, and do not care what the laws are.
Sonoma County Office of Legal Counsel attorney Michael King took over after Ms. Abelson withdrew. Right off the bat, Mr. King told me that my motions were deficient - a contention he has repeated frequently, since then. I asked him how. He changed the subject, and to this day has NEVER given any explanation as to how any of my motions are deficient.
He continued to claim that my claim was time barred, filing frivolous motions, in blatant violation of the rules of professional conduct, after I cited the rules to him, constituting explicit legal misconduct.
As I said, the judge finally agreed to open Discovery after a year and a half of full time work trying to fight for my right to not be nearly murdered for no reason.
Lawyers do not take these cases unless there is undeniable proof of blatant guilt, along with undeniable proof of catastrophic injury. Multiple law firms have confirmed that it takes over a million dollars worth of legal work to get these cases to trial.
The judge also promised me a pro bono attorney "if you make it past summary judgment".
The judge scheduled us for Alternative Dispute Resolution hearing with a magistrate judge. Mr. King elicited an offer from me, which I spent about 2 weeks working on, trying to make it as agreeable as possible. But then for the hearing, his written offer was to waive charging me his attorneys fees. The judge confirmed that there was no legal basis for him to do that - it would be illegal. He had been ordered to participate in this hearing, and there was a legal obligation under the Rules of Procedure to try in good faith to settle the case. He violated the order and the rule of procedure (26 (f)).
All of my motions were completely ignored for no reason.
Mr. King / Defendant Virgil Smith lied about the cameras. They said "Denies the existence of cameras capable of recording in the vicinity", in writing, under oath. They never disputed that he put his knee on top of my back with all his weight on it.
Mr. King refused to comply with his Discovery obligations. I had to file about 4 different motions pertaining to their refusal to comply with the laws regarding disclosure of evidence.
Upon receiving an official Discovery request for records of camera equipment, I received a letter signed under by Mr. King (nearly 4 years after the incident) stating that the cameras CAN RECORD. But stating "tasks must be performed" to start the recording function, and stating that all records pertaining to the equipment that was installed at the time HAD BEEN DESTROYED (literally a federal and state crime, a civil tort violation, and a sanctionable act of legal misconduct).
Mr. King refused to schedule any of the witnesses for deposition, demanded MY deposition BEFORE he would even schedule the two deputies who assaulted me, even though I had been requesting depositions with other witnesses for over a month, and refused to schedule anyone else, he refused to answer interrogatories, he refused to provide copies of the policies from the time of the incident. He tried to pass off a weird spreadsheet with the word camera on it as proof that upgrades had been done to the cameras. He refused to provide complete training records for the deputies. He refused to provide details about the training. He refused to provide blueprints of the facility, refused to provide photos of the cameras at the location, refused to provide still images showing which direction the cameras were pointing, refused to provide photos of the deputies so I could schedule depositions efficiently.
The judge erroneously dismissed my Equal Protection claims, construing them as Due Process and Employment Discrimination claims, which are different types of claims than Equal Protection claims against a government actor. The government cannot arbitrarily treat anyone disparately. The Court also dismissed my "Monell" claim against the municipality for their "policies, customs, or practices", but left me leave to amend that claim. And she waited until Discovery opened over 1.5 years into litigation, to do this, forcing me to amend the complaint DURING DISCOVERY which was only open for a limited amount of time, instead of any point in the 1.5 years prior to that.
In the recorded interview with Andrew Cash and one of the witness deputies, she spontaneously states that Mr. Cash instructed her to review the written statements made by the two deputies who assaulted me prior to the interview. Another deputy witness confirmed that Mr. Cash had instructed her to review the written reports by the two deputies who assaulted me prior to her providing Mr. Cash with a written statement as well.
The judge finally retaliated against me, without rational basis, for filing motions, which I had filed because I was being illegally obstructed from preserving evidence, by withdrawing leave to amend regarding the "Monell" claim (I had stated a clear Monell claim to begin with, but the judge literally has an aversion to reading, and relies on guessing, and is biased against pro se litigants; I am summarizing well over 100 pages, if not well over double that, of motions, objections, and replies and the judge's responsive orders).
She did however, finally schedule a hearing with a Discovery referee magistrate. All my motions (and the months of work I was required to do dictated by the various rules) was completely disregarded, and both me and Mr. King were given 2 pages each (double spaced) to go over discovery issues, even though I had filed about 4 different motions about various issues, and he hadn't filed ANY, at that time.
During conference I was required to do in accordance with the Rules, Mr. King repeatedly tried to establish that I had committed crimes during the course of conferring which was my legal obligation, without having any rational basis to believe what he was trying to establish. He demanded evidence that would exist, and he kept repeating every lie he could come up with to the judge. The judge would either get annoyed at me if I addressed any of Mr. King's baseless accusations, or take his statements at face value for being 100% true.
Mr. King finally "compromised" and agreed to schedule depositions with me (as long as Mr. King wanted to) and the two deputies who had assaulted me (for 25 minutes each or something) all simultaneously, but refused to schedule anyone else, even though this was grossly advantageous to him. One of the eye witness deputies later confirmed that he had "consulted" her over 4 times prior to the trial. During this deposition, Mr. King asked me where a family member of mine works. He had spent about 30-40 minutes trying to convince me that I can tell him anything, that the entire record was designated confidential, that I had nothing to worry about - and at a deposition, you are obligated to answer the questions unless they are harassing. Mr. King also requested contact information for counselors from over 10 years ago, and that was the only question I didn't answer - I told him to provide the request in writing. At some point after that, I told Mr. King to not contact my family member at her workplace, and Mr. King responded "unless you fully and completely cooperate" with his request for contact information for counselors from 10 years+ ago.
At the hearing, the Discovery Magistrate (Donna M. Ryu) discussed matters only with Mr. King, without including me. He told her that the 4 eye witness deputies "saw nothing" and "weren't there" (verbatim) trying to get her to deny me my request to take their deposition. She asked him if he would get them to sign fresh "sworn declarations", "under oath" (Judge Ryu's words, verbatim) stating this. Mr. King said yes, absolutely, he would. Judge Ryu asked me "Would that be okay?" I said "No." She started laughing, and asked me why, and I explained that I had explicitly described various interactions with them that had taken place while the carotid hold was still being applied to me, and that they had stated in their written statements that they had witnessed force being used, and that was "not resisting". She confirmed that this was all true with Mr. King and that he already knew all of this, and ordered him to cooperate with scheduling them for deposition.
After that, they went back to discussing matters only with eachother, and I was excluded from discussion. This was an hour long hearing, and at about the 45 minute mark, Mr. King was again lying to the magistrate judge, and when he had finished, I interjected, "That's not true". Judge Ryu shouted "Stop! Stop stop stop stop stop!" And then very assertively explained to me the importance of not interrupting people for the convenience of the court reporter / transcriber. I was excluded from the rest of the hearing.
At some point at either this hearing or the next one, I cited the legal requirement for the parties to disclose contact information for witnesses. I cited the rule of procedure. Judge Ryu responded, "Mr. King is a lawyer!" as if that alone justified his refusal to provide me contact information for witnesses.
Mr. King refused to provide both written statements from the eye witness deputies, and to schedule them for deposition, and stated that if he provided written statements, they would be copied and pasted versions of the same statements previously provided, signed under oath (nowhere saying that they "saw nothing" or "weren't there").
Mr. King kept threatening to go to my family member's workplace unless I provided him contact information for counselors from 10+ years ago, DURING a DEPOSITION, without him providing any written request for the information.
He also interfered with scheduling the witnesses for deposition, with the Court reporter that I had hired, disregarded the schedule that I had set, and set them each for 30 minutes, which raised the cost of deposition from an estimated about $700 to about $4,000, and said this was my one and only chance.
The Federal Pro Bono Project / the Justice & Diversity Center is an organization that receives seven million dollars a year in public funding and is under contract with the Federal District Court to work with the Court to provide legal consultation to pro se litigants. I had about 19 appointments with them, about 18 with Abby Herzberg, and 1 with Rosemarie Maliekel. Ms. Herzberg was precisely 15 minutes late to every single appointment, repeatedly gave me horrible advice ("just wait", do nothing, "don't file this", despite admitting that the entire motion was valid, directly causing excessive delay and the spoliation of crucial evidence). She also yelled at me aggressively on two occasions because I had brought up state laws, which were being currently violated against me, because the Court had dismissed my "state claims" because Sonoma County refused to supply with a state tort claim form when I first asked, reasoning that was not relevant to the state laws being currently violated against me. After Ms. Herzberg yelled at me the second time, I requested an appointment with Ms. Maliekel. Ms. Maliekel spent the entire appointment ranting at me about irrelevant issues, and kept talking over me and interrupting me. I was polite but eventually asked "can I finish what I was saying?" She responded "No!" and kept ranting at me.
I had repeatedly asked about how to properly get medical evidence, and about expert witnesses. Ms. Herzberg ignored my questions and spent nearly the entirety of almost every single appointment reading through the rules, without letting me speak at all, even to summarize the relevant sections of the rules that I had read.
On a video on their webpage (on the Court's website, because they are a "partner project" with the Court), Abby Herzberg explicitly demonstrates a clear understanding of the fact that the Court provides funding for expert witnesses, despite ignoring my questions about and spending nearly the entirety of almost every single appointment either reading rules or pretending to.
Discovery was closed.
Mr. King rehashed the legally baseless and frivolous "time barred" claim in a Motion for Summary Judgment. I was required to respond to it twice. I was required to answer all his "undisputed material facts" under threat of terminating my entire case, but he refused to answer mine. He lied over and over to the judges. As I said, the judge ruled that the laws "wouldn't allow her to" dismiss my entire case and rejected his Motion for Summary Judgement.
The Court ordered the Federal Pro Bono Project (FPBP) to put me on a list for attorneys seeking clients. Ms. Herzberg told me that if I filed any motions, that the FPBP would not cooperate with the Court's order, until 1 month before my trial, instead of 6 months before. She also said that a law firm had reached out to them about my case over a month prior to that, and that the staff at the FPBP had not followed up. My filing privileges were then revoked by the Court.
An attorney, David Ratner, reached out to me, and scheduled an initial consultation, over Zoom, at which he stated he "hates cops", and gave a showing of being enthusiastic. I explicitly told him that I wanted to make sure we were on the same page as far as what to "aim for". I told him that I had been working for FIVE YEARS, that I had almost died, that I had suffered two different extremely serious injuries. I told him that what I asked for was consistent with the most similar case (the Esa Wroth case of 2013) that I knew of (an ask of three million dollars). This was coincidental. I was not aware of the Esa Wroth case when I came up with that number. I agonized over that, and spent a lot of time trying to come up with a fair amount, and described the methods I used to come up with that number in detail in court documents. Mr. Ratner explicitly agreed to aim for that.
Mr. Ratner, and his partner, Shelley Mollineaux, who was set to represent me at trial under Mr. Ratner's supervision, then both went dark for over a month. They ignored my emails, voicemails, and messages that I left with their receptionists. There was a hearing, and then Mr. Ratner emailed me demanding "all the documents" that I had. I had over 50 gb of files across thousands of files, and spent about a month working with his paralegals sending them batches of files, and providing all the information they asked me for. Mr. Ratner forwarded me an email from Mr. King where King accused me of violating a court order regarding providing medical providers and the physical addresses of my entire family and my friends, which was false -- the Court had ordered me to provide him CONTACT information, at a second hearing, which wasn't significant, and I had fully and completely complied in good faith with all the Court's orders. Mr. Ratner accused me of not sending him "anything", after I had spent at least several weeks with his paralegals sending them batches of files and information, and he simultaneously threatened to ask the judge for leave to withdraw.
There had been major delays with medical evaluation due in large part to Covid, as well as delayed discovery of brain injury, which is very common, and other factors.
With trial set, Mr. Ratner forwarded me an offer from Defendants for $5,000. Upon discussion (which was 100% in email because he refused to talk over the phone and Ms. Mollineaux completely ignored me), he accused me of not doing Discovery right. I pointed him to the video I referred to earlier, which I had found since Mr. Ratner took my case, but wasn't aware of when I was interacting with the FPBP, where the FPBP (Abby Herzberg), and various District Judges from the Court I was litigating in, state that it is general policy (and it is official policy under the Court's General Order 25) to REOPEN DISCOVERY when a pro bono attorney comes onto the case, and to FUND DEPOSITION AND EXPERT WITNESS FEES.
Mr. Ratner stated he "won't file any motions" and ultimately elected to withdraw from the case over fulfill his legal obligations under the Rules of Professional Conduct. The Court thanked him and granted him permission to withdraw. The FPBP refused to put me back on the list. I was forced into trial BY MYSELF, at 1-2 months prior to trial, after 2-3 months of my time being completely wasted by Mr. Ratner and his law firm.
I went through the appropriate legal process to submit an expert witness. The Court, as usual, completely ignored my motions, but allowed me to use him after I went through the entire legal process, and paid him thousands of dollars without knowing if I would be granted permission or not, and provided the Court a report stating that the carotid hold was ILLEGAL unless the subject exhibited "assaultive behavior" and that Defendants had never alleged any behavior of mine that constituted "assaultive behavior" (under POST Basic). The expert was a Master level instructor at a police academy and former SWAT.
Mr. King provided his pre-trial disclosures, and it contained a document from Rohnert Park police department which had been extensively redacted on the copy that they had provided to me. The new copy contained the contact information for the bystander witness. I called him, and he confirmed that he saw the entire thing, that I had never yelled at the deputies before the first deputy grabbed my arm, and that I was not resisting at any point in time. I told the judge this. She had me call him at a hearing, and both me and Mr. King were allowed a couple of minutes to ask him questions, where he refused to admit that I was even "wiggling" when Mr. King badgered him.
The judge then refused to allow him to appear over Zoom, and refused to summon him to the trial.
At the trial, the Judge accused me falsely of firing my attorney, and explicitly prohibited me from telling the jury that the Defendants had LIED about the camera's ability to record. She explicitly prohibited me from submitting scientific evidence about the carotid hold. She allowed Mr. King to make extremely defamatory false remarks about me and my past which had a huge impact on the jury's perception of things. At a pretrial hearing, we had gone over about 110 documents that I wanted to present at the trial. She vetted about 40 as admissible at the hearing, but at the trial she only let me submit about 5. Defendants were allowed to submit a SECOND expert witness, both of whom worked for the Sonoma County Sheriff's Office. The first was Andrew Cash. The second was James Naugle who had been disclosed literally a week before trial, without a report, and without allowing me to take his deposition. She refused to allow me to ask Mr. Naugle about case laws, or about information pertaining to the carotid hold. The Court refused to summon any of my treating physicians, whom I had provided the names and contact information for in my disclosures at the end of Discovery and some in my initial disclosures, and I had complied with Mr. King's written requests for information or objected within the boundaries of the law, in good faith, and complied with the Court's orders, in good faith.
I had informed the Court that I was scheduled for medical evaluations for brain injury AFTER THE TRIAL. The Court completely ignored this.
So it was my word against theirs. 5 years, at the time of the mistrial, to get a mockery of a trial, and have the jurors' time completely wasted. The jury wrote me a letter thanking me or something, but awarded me nothing.
I was diagnosed with organic brain injury after the trial. I had a similar test prior to the incident and had absolutely no problems and answered every question with no trouble. I now score in the FOURTH PERCENTILE on those areas.
Despite its length, this has been a short summary of all the events over the past 6 years. Much has been summarized, and much has been left out. I tried my best to balance completeness with leaving out irrelevant details.
There is no record of any misconduct on the part of anyone involved in this that is available to any law enforcement agencies or to the public. Nobody has been disciplined. No investigation was ever conducted. I was almost killed and was seriously injured, under a camera, and in front of witnesses, and spent 6 years working with the government. The government has done precisely NOTHING.
The County now routinely retaliates against me whenever we interact, in blatant violation of various laws.

I just want people to know that the Sonoma County government is corrupt. They spent 186 million dollars on a "new courthouse" that is 163k square feet, which works out to $1,100 per square foot, which is over double the second most expensive building I could find was, and over four times the average price per square foot of palaces and museums. And it's just going to look like a giant portable. This is to house some of the most corrupt people in this County, who all make $200-350+k per year (I am including their benefits in that, but not their pension). The entire DA's Office has a vendetta against Civil Rights in general, and will literally knowingly commit criminal violations of laws for the purpose of covering up serious criminal misconduct on the part of Sonoma County employees.
Lynda Hopkins took money from the law enforcement unions, and turns a willfully blind eye to it.
The County Office of Legal Counsel is literally a crime syndicate.
In 2015, the Sheriff's Office had a veritable torture ring in the jail.

This is just the tip of the iceberg. They lied about the existence of these videos, and "lost" the one where they gave one of the inmates internal bleeding, with a knee to their back.
There was a lawsuit about it. It was called the "Yard Counseling Case". There are news articles about it.
There was an official, written policy, called "Yard Counseling", later its name was changed to "Behavior Counseling" which dictated that for arbitrary punitive measures, Sheriff's Office personnel should extract inmates from their cells individually (which meant slamming their heads onto the door frames on the way out and other abuse), and isolate them, and putting them into "pain compliance" techniques (literally, by definition, torture) for extended periods of time while "counseling" them, which meant wearing no name tags, ski masks and riot gear, carrying a shotgun with them, and insulting them in explicit language for over 20 minutes.
This official written policy was acknowledged by Rob Giordano in a video, where he lies that no inmates where injured, uploaded to YouTube in 2018, when they finally addressed this official written policy, and the practice of torturing inmates without reasonable cause (leading exercise routines, for example).
In 2021, they saw one of the victims of this torture ring, who had sued them and had won, at a peaceful protest, and shot him with a grenade launcher while hiding on a rooftop in the face with a crowd control grenade, which exploded on impact and caused horrific injury that I don't care to describe.
In 2017, I was almost killed by application of a "carotid hold" / lateral vascular neck restraint, by a sheriff's deputy, for literally no reason. A knee was placed on my lower back while I was on the ground on my stomach as well, which caused a serious injury to my kidney, which was the worst injury of my life. I have also been diagnosed with an organic brain injury and cognitive impairment. I was tested for the same type of cognitive impairment before the incident and there is a marked difference, and I have about 30 pages describing the differences I've noticed / troubles I've had in my cognitive functioning. There was no probable cause to arrest me, and I was polite and compliant with all the instructions given to me, and this was confirmed by witnesses. I was punished for invoking my right to remain silent, then my arm was grabbed and yanked up behind me, and then a carotid hold was applied because my body pivoted after the deputy grabbed and yanked my arm.
This occurred UNDER A CAMERA and IN FRONT OF WITNESSES. I called the Sheriff's Office the next day said I want to "make an official complaint in writing". I was transferred to Captain of Internal Affairs, Captain Mark Essick. I repeated my request, verbatim. He responded, verbatim: "We don't do that. Why don't you tell me what happened." I did. I told him it happened right under a camera. He said "The camera can't record." I asked for confirmation. He said the cameras "Don't have recording technology installed."
I asked the County for a claim form. They ignored my request, and instructed me to report the incident to IOLERO. IOLERO requested I meet with Internal Affairs, and I said fine.
Sgt. Andy Cash called me and scheduled me for a meeting at the Sheriff's den. I was made to walk first and guided upstairs to a meeting room, and then patted down for weapons, and the interview was recorded. For 75 minutes I was deposed about happened. He asked me repeatedly about my mental state after the incident. I admitted that I was upset after the incident, and he acted like that justified the whole incident. He explicitly promised to interview the 4 deputies who witnessed the event in addition to the 2 deputies who participated, as well as the arresting officer (who I told him would confirm that I was polite and cooperative), which he agreed "would confirm [my] demeanor", and a bystander witness I told him about.
I complained to IOLERO director Jerry Threet. Mr. Threet agreed that that was inappropriate, then resigned without reviewing the investigation.
For about 4 years review of the investigation was put on hold because IOLERO staff quit, and when more staff was hired, they complained of being understaffed. They had a budget of over a million dollars but only had 2 employees. They only reviewed one case per four months. And they put off "backlogged" cases and focused on new cases. My complaint was finally reviewed by Interim Director Garrick Byers who clearly stated that the investigation was not conducted appropriately. I have the letter from him. That still has never been made public.
After the interview with Internal Affairs, I corresponded with Lynda Hopkins, and she refused to give her opinion on the matter. I specifically complained that the carotid hold was being used recklessly, and it is a dangerous technique. This was in 2018. She forwarded me to Janell Crane, who then had me meet with Kristi Schultz.
I contacted the DA's Office and spoke to Richard Celli (who made $346k in 2017, and has gunned down two unarmed people, and was convicted by a jury in one of the civil cases brought against him by one of the victim's family, but the sentence was overturned by a judge, while working for the SRPD). The first time I spoke to Mr. Celli, he told me that another law enforcement agency should take my case. After that first time, him and the rest of the DA's Office openly refused to comply with the Victims' Rights Laws (CA Con Art. 1 S. 28), and the "policies" (which are legally binding under CA Con Art 5 S. 13) of the Attorney General stating clearly that they are to take complaints from victims if it can't be resolved with the department.
After the first talk with Mr. Celli, I called Rohnert Park Police as I was instructed, and they 3-way called the Sheriff's office and then transferred me. I spent about 30 minutes reporting the incident to a deputy, and he asked me questions in a fair manner. I called RPPD back and talked to the arresting officer and he positively clearly confirmed that I was "polite, calm, compliant, and cooperative" (or something nearly verbatim, I can't remember exactly any more).
Andrew Cash called me the next day, at precisely 7:00 AM. He told me he was driving. He was extremely confrontational with me. He said "There were 6 deputies [referring to the two who used excessive force on me, and 4 witness deputies]. You were combative." This was false. He had only interviewed one of the 4 witness deputies, and the other 3 had provided written statements. They said that they had witnessed force being used, that they had not participated in the use of force to the best of their memory, and that I "did not appear to be resisting". But again, he had promised explicitly to interview the 4 deputy witnesses, and the arresting officer
Internal Affairs exonerated the officers. The letter was signed by Eddie Engram, captain of Internal Affairs. I called Mr. Engram, and had an hour long conversation with him, and he told me to contact Sgt. Cash after April 1st.
I filed a federal claim on the last day that it was due.
Mr. Cash referred me to Legal Counselor, Kara Abelson.
Ms. Abelson spent a year and a half refusing to comply with the Public Records Act, the Rules of Procedure, and the Rules of Professional Conduct. She refused to provide me documents that I was entitled to under law, including the incident report written by Deputies Jacquelin Fazzio and Virgil Smith, and the recorded interviews that he promised he would conduct, and stated pretty clearly that he had conducted.
Kara Abelson spent a year and a half trying to claim that my federal complaint was time barred by 1 day when it wasn't. The judge (Yvonne Gonzalez Rogers) entertained this and forced me to respond SEVEN TIMES, before she finally admitted that the "law wouldn't allow [her] to dismiss my complaint".
After a year and a half, Kara Abelson finally withdrew from the case after I started citing the Rules of Professional Conduct to her that require her to resign or withdraw from the case rather than defend a civil case where defense isn't warranted. Nobody had disputed any of the allegations I had made. In fact, Eddie Engram had confirmed that what I said happened was not disputed by the evidence.
At some point around this time, either before or after Ms. Abelson withdrew, the 2 incident reports written by the two deputies, the written statements by 3 of the 4 witness deputies, and the recorded interviews with me, the 2 deputies who assaulted me, and 1 of the eye witness deputies, were provided, along with various other records from the facility. In the recorded interview, and the incident report, the deputies admitted that Virgil Smith had applied the carotid hold.
I had also reported the incident to the State Attorney General Public Inquiry Unite (Lupe Zinzin). She had told me, over and over and over, that the local DA's are required to take complaints from civilians in these situations. She refused to call the DA's Office, though. The DA's Office (Richard Celli, Mark Azzouni, David Kahl) refused to take a complaint from me. They (including the receptionists) hung up on me every time I called after no more than 2 minutes, for no reason, transferred me to dead lines, never returned any voicemails I managed to leave, told me explicitly that if I send a complaint, they will throw it away, and didn't care, at all, what the laws were. The receptionists also refuse to provide their names. The Attorney General's Office told me to send them a complaint, so I did. The DA's Office acknowledged receiving the complaint. But later said that they did not have a record of it, meaning they threw it away.
The Attorney General's Office finally agreed to take a complaint from me. It sat on their desk for a year. I finally called them, concerned that evidence was being destroyed, and left a voicemail for Casey Hallinan requesting that they request copies of the physical evidence from the Sheriff's Office. Literally 2 days after that voicemail, a letter was sent to me signed by Sharon Loughner with Casey Hallinan CC'ed on the letter, stating that they would "take no action", and blamed the incident on me. I had not received the letter though, and called and spoke to Ms. Hallinan, who was extremely rude. After that, the Attorney General's Office hang up on me as soon as they find out it's me, for no reason. There has since been a bystander witness who saw the whole thing, and it has come to light that the cameras did record, that no upgrades were ever performed like Ms. Abelson alleged, the cameras do continuously record (as of 2019), and they just lied through their teeth about the camera for 4 straight years. The Attorney General's Office does not care. They violate the laws, and do not care what the laws are.
Sonoma County Office of Legal Counsel attorney Michael King took over after Ms. Abelson withdrew. Right off the bat, Mr. King told me that my motions were deficient - a contention he has repeated frequently, since then. I asked him how. He changed the subject, and to this day has NEVER given any explanation as to how any of my motions are deficient.
He continued to claim that my claim was time barred, filing frivolous motions, in blatant violation of the rules of professional conduct, after I cited the rules to him, constituting explicit legal misconduct.
As I said, the judge finally agreed to open Discovery after a year and a half of full time work trying to fight for my right to not be nearly murdered for no reason.
Lawyers do not take these cases unless there is undeniable proof of blatant guilt, along with undeniable proof of catastrophic injury. Multiple law firms have confirmed that it takes over a million dollars worth of legal work to get these cases to trial.
The judge also promised me a pro bono attorney "if you make it past summary judgment".
The judge scheduled us for Alternative Dispute Resolution hearing with a magistrate judge. Mr. King elicited an offer from me, which I spent about 2 weeks working on, trying to make it as agreeable as possible. But then for the hearing, his written offer was to waive charging me his attorneys fees. The judge confirmed that there was no legal basis for him to do that - it would be illegal. He had been ordered to participate in this hearing, and there was a legal obligation under the Rules of Procedure to try in good faith to settle the case. He violated the order and the rule of procedure (26 (f)).
All of my motions were completely ignored for no reason.
Mr. King / Defendant Virgil Smith lied about the cameras. They said "Denies the existence of cameras capable of recording in the vicinity", in writing, under oath. They never disputed that he put his knee on top of my back with all his weight on it.
Mr. King refused to comply with his Discovery obligations. I had to file about 4 different motions pertaining to their refusal to comply with the laws regarding disclosure of evidence.
Upon receiving an official Discovery request for records of camera equipment, I received a letter signed under by Mr. King (nearly 4 years after the incident) stating that the cameras CAN RECORD. But stating "tasks must be performed" to start the recording function, and stating that all records pertaining to the equipment that was installed at the time HAD BEEN DESTROYED (literally a federal and state crime, a civil tort violation, and a sanctionable act of legal misconduct).
Mr. King refused to schedule any of the witnesses for deposition, demanded MY deposition BEFORE he would even schedule the two deputies who assaulted me, even though I had been requesting depositions with other witnesses for over a month, and refused to schedule anyone else, he refused to answer interrogatories, he refused to provide copies of the policies from the time of the incident. He tried to pass off a weird spreadsheet with the word camera on it as proof that upgrades had been done to the cameras. He refused to provide complete training records for the deputies. He refused to provide details about the training. He refused to provide blueprints of the facility, refused to provide photos of the cameras at the location, refused to provide still images showing which direction the cameras were pointing, refused to provide photos of the deputies so I could schedule depositions efficiently.
The judge erroneously dismissed my Equal Protection claims, construing them as Due Process and Employment Discrimination claims, which are different types of claims than Equal Protection claims against a government actor. The government cannot arbitrarily treat anyone disparately. The Court also dismissed my "Monell" claim against the municipality for their "policies, customs, or practices", but left me leave to amend that claim. And she waited until Discovery opened over 1.5 years into litigation, to do this, forcing me to amend the complaint DURING DISCOVERY which was only open for a limited amount of time, instead of any point in the 1.5 years prior to that.
In the recorded interview with Andrew Cash and one of the witness deputies, she spontaneously states that Mr. Cash instructed her to review the written statements made by the two deputies who assaulted me prior to the interview. Another deputy witness confirmed that Mr. Cash had instructed her to review the written reports by the two deputies who assaulted me prior to her providing Mr. Cash with a written statement as well.
The judge finally retaliated against me, without rational basis, for filing motions, which I had filed because I was being illegally obstructed from preserving evidence, by withdrawing leave to amend regarding the "Monell" claim (I had stated a clear Monell claim to begin with, but the judge literally has an aversion to reading, and relies on guessing, and is biased against pro se litigants; I am summarizing well over 100 pages, if not well over double that, of motions, objections, and replies and the judge's responsive orders).
She did however, finally schedule a hearing with a Discovery referee magistrate. All my motions (and the months of work I was required to do dictated by the various rules) was completely disregarded, and both me and Mr. King were given 2 pages each (double spaced) to go over discovery issues, even though I had filed about 4 different motions about various issues, and he hadn't filed ANY, at that time.
During conference I was required to do in accordance with the Rules, Mr. King repeatedly tried to establish that I had committed crimes during the course of conferring which was my legal obligation, without having any rational basis to believe what he was trying to establish. He demanded evidence that would exist, and he kept repeating every lie he could come up with to the judge. The judge would either get annoyed at me if I addressed any of Mr. King's baseless accusations, or take his statements at face value for being 100% true.
Mr. King finally "compromised" and agreed to schedule depositions with me (as long as Mr. King wanted to) and the two deputies who had assaulted me (for 25 minutes each or something) all simultaneously, but refused to schedule anyone else, even though this was grossly advantageous to him. One of the eye witness deputies later confirmed that he had "consulted" her over 4 times prior to the trial. During this deposition, Mr. King asked me where a family member of mine works. He had spent about 30-40 minutes trying to convince me that I can tell him anything, that the entire record was designated confidential, that I had nothing to worry about - and at a deposition, you are obligated to answer the questions unless they are harassing. Mr. King also requested contact information for counselors from over 10 years ago, and that was the only question I didn't answer - I told him to provide the request in writing. At some point after that, I told Mr. King to not contact my family member at her workplace, and Mr. King responded "unless you fully and completely cooperate" with his request for contact information for counselors from 10 years+ ago.
At the hearing, the Discovery Magistrate (Donna M. Ryu) discussed matters only with Mr. King, without including me. He told her that the 4 eye witness deputies "saw nothing" and "weren't there" (verbatim) trying to get her to deny me my request to take their deposition. She asked him if he would get them to sign fresh "sworn declarations", "under oath" (Judge Ryu's words, verbatim) stating this. Mr. King said yes, absolutely, he would. Judge Ryu asked me "Would that be okay?" I said "No." She started laughing, and asked me why, and I explained that I had explicitly described various interactions with them that had taken place while the carotid hold was still being applied to me, and that they had stated in their written statements that they had witnessed force being used, and that was "not resisting". She confirmed that this was all true with Mr. King and that he already knew all of this, and ordered him to cooperate with scheduling them for deposition.
After that, they went back to discussing matters only with eachother, and I was excluded from discussion. This was an hour long hearing, and at about the 45 minute mark, Mr. King was again lying to the magistrate judge, and when he had finished, I interjected, "That's not true". Judge Ryu shouted "Stop! Stop stop stop stop stop!" And then very assertively explained to me the importance of not interrupting people for the convenience of the court reporter / transcriber. I was excluded from the rest of the hearing.
At some point at either this hearing or the next one, I cited the legal requirement for the parties to disclose contact information for witnesses. I cited the rule of procedure. Judge Ryu responded, "Mr. King is a lawyer!" as if that alone justified his refusal to provide me contact information for witnesses.
Mr. King refused to provide both written statements from the eye witness deputies, and to schedule them for deposition, and stated that if he provided written statements, they would be copied and pasted versions of the same statements previously provided, signed under oath (nowhere saying that they "saw nothing" or "weren't there").
Mr. King kept threatening to go to my family member's workplace unless I provided him contact information for counselors from 10+ years ago, DURING a DEPOSITION, without him providing any written request for the information.
He also interfered with scheduling the witnesses for deposition, with the Court reporter that I had hired, disregarded the schedule that I had set, and set them each for 30 minutes, which raised the cost of deposition from an estimated about $700 to about $4,000, and said this was my one and only chance.
The Federal Pro Bono Project / the Justice & Diversity Center is an organization that receives seven million dollars a year in public funding and is under contract with the Federal District Court to work with the Court to provide legal consultation to pro se litigants. I had about 19 appointments with them, about 18 with Abby Herzberg, and 1 with Rosemarie Maliekel. Ms. Herzberg was precisely 15 minutes late to every single appointment, repeatedly gave me horrible advice ("just wait", do nothing, "don't file this", despite admitting that the entire motion was valid, directly causing excessive delay and the spoliation of crucial evidence). She also yelled at me aggressively on two occasions because I had brought up state laws, which were being currently violated against me, because the Court had dismissed my "state claims" because Sonoma County refused to supply with a state tort claim form when I first asked, reasoning that was not relevant to the state laws being currently violated against me. After Ms. Herzberg yelled at me the second time, I requested an appointment with Ms. Maliekel. Ms. Maliekel spent the entire appointment ranting at me about irrelevant issues, and kept talking over me and interrupting me. I was polite but eventually asked "can I finish what I was saying?" She responded "No!" and kept ranting at me.
I had repeatedly asked about how to properly get medical evidence, and about expert witnesses. Ms. Herzberg ignored my questions and spent nearly the entirety of almost every single appointment reading through the rules, without letting me speak at all, even to summarize the relevant sections of the rules that I had read.
On a video on their webpage (on the Court's website, because they are a "partner project" with the Court), Abby Herzberg explicitly demonstrates a clear understanding of the fact that the Court provides funding for expert witnesses, despite ignoring my questions about and spending nearly the entirety of almost every single appointment either reading rules or pretending to.
Discovery was closed.
Mr. King rehashed the legally baseless and frivolous "time barred" claim in a Motion for Summary Judgment. I was required to respond to it twice. I was required to answer all his "undisputed material facts" under threat of terminating my entire case, but he refused to answer mine. He lied over and over to the judges. As I said, the judge ruled that the laws "wouldn't allow her to" dismiss my entire case and rejected his Motion for Summary Judgement.
The Court ordered the Federal Pro Bono Project (FPBP) to put me on a list for attorneys seeking clients. Ms. Herzberg told me that if I filed any motions, that the FPBP would not cooperate with the Court's order, until 1 month before my trial, instead of 6 months before. She also said that a law firm had reached out to them about my case over a month prior to that, and that the staff at the FPBP had not followed up. My filing privileges were then revoked by the Court.
An attorney, David Ratner, reached out to me, and scheduled an initial consultation, over Zoom, at which he stated he "hates cops", and gave a showing of being enthusiastic. I explicitly told him that I wanted to make sure we were on the same page as far as what to "aim for". I told him that I had been working for FIVE YEARS, that I had almost died, that I had suffered two different extremely serious injuries. I told him that what I asked for was consistent with the most similar case (the Esa Wroth case of 2013) that I knew of (an ask of three million dollars). This was coincidental. I was not aware of the Esa Wroth case when I came up with that number. I agonized over that, and spent a lot of time trying to come up with a fair amount, and described the methods I used to come up with that number in detail in court documents. Mr. Ratner explicitly agreed to aim for that.
Mr. Ratner, and his partner, Shelley Mollineaux, who was set to represent me at trial under Mr. Ratner's supervision, then both went dark for over a month. They ignored my emails, voicemails, and messages that I left with their receptionists. There was a hearing, and then Mr. Ratner emailed me demanding "all the documents" that I had. I had over 50 gb of files across thousands of files, and spent about a month working with his paralegals sending them batches of files, and providing all the information they asked me for. Mr. Ratner forwarded me an email from Mr. King where King accused me of violating a court order regarding providing medical providers and the physical addresses of my entire family and my friends, which was false -- the Court had ordered me to provide him CONTACT information, at a second hearing, which wasn't significant, and I had fully and completely complied in good faith with all the Court's orders. Mr. Ratner accused me of not sending him "anything", after I had spent at least several weeks with his paralegals sending them batches of files and information, and he simultaneously threatened to ask the judge for leave to withdraw.
There had been major delays with medical evaluation due in large part to Covid, as well as delayed discovery of brain injury, which is very common, and other factors.
With trial set, Mr. Ratner forwarded me an offer from Defendants for $5,000. Upon discussion (which was 100% in email because he refused to talk over the phone and Ms. Mollineaux completely ignored me), he accused me of not doing Discovery right. I pointed him to the video I referred to earlier, which I had found since Mr. Ratner took my case, but wasn't aware of when I was interacting with the FPBP, where the FPBP (Abby Herzberg), and various District Judges from the Court I was litigating in, state that it is general policy (and it is official policy under the Court's General Order 25) to REOPEN DISCOVERY when a pro bono attorney comes onto the case, and to FUND DEPOSITION AND EXPERT WITNESS FEES.
Mr. Ratner stated he "won't file any motions" and ultimately elected to withdraw from the case over fulfill his legal obligations under the Rules of Professional Conduct. The Court thanked him and granted him permission to withdraw. The FPBP refused to put me back on the list. I was forced into trial BY MYSELF, at 1-2 months prior to trial, after 2-3 months of my time being completely wasted by Mr. Ratner and his law firm.
I went through the appropriate legal process to submit an expert witness. The Court, as usual, completely ignored my motions, but allowed me to use him after I went through the entire legal process, and paid him thousands of dollars without knowing if I would be granted permission or not, and provided the Court a report stating that the carotid hold was ILLEGAL unless the subject exhibited "assaultive behavior" and that Defendants had never alleged any behavior of mine that constituted "assaultive behavior" (under POST Basic). The expert was a Master level instructor at a police academy and former SWAT.
Mr. King provided his pre-trial disclosures, and it contained a document from Rohnert Park police department which had been extensively redacted on the copy that they had provided to me. The new copy contained the contact information for the bystander witness. I called him, and he confirmed that he saw the entire thing, that I had never yelled at the deputies before the first deputy grabbed my arm, and that I was not resisting at any point in time. I told the judge this. She had me call him at a hearing, and both me and Mr. King were allowed a couple of minutes to ask him questions, where he refused to admit that I was even "wiggling" when Mr. King badgered him.
The judge then refused to allow him to appear over Zoom, and refused to summon him to the trial.
At the trial, the Judge accused me falsely of firing my attorney, and explicitly prohibited me from telling the jury that the Defendants had LIED about the camera's ability to record. She explicitly prohibited me from submitting scientific evidence about the carotid hold. She allowed Mr. King to make extremely defamatory false remarks about me and my past which had a huge impact on the jury's perception of things. At a pretrial hearing, we had gone over about 110 documents that I wanted to present at the trial. She vetted about 40 as admissible at the hearing, but at the trial she only let me submit about 5. Defendants were allowed to submit a SECOND expert witness, both of whom worked for the Sonoma County Sheriff's Office. The first was Andrew Cash. The second was James Naugle who had been disclosed literally a week before trial, without a report, and without allowing me to take his deposition. She refused to allow me to ask Mr. Naugle about case laws, or about information pertaining to the carotid hold. The Court refused to summon any of my treating physicians, whom I had provided the names and contact information for in my disclosures at the end of Discovery and some in my initial disclosures, and I had complied with Mr. King's written requests for information or objected within the boundaries of the law, in good faith, and complied with the Court's orders, in good faith.
I had informed the Court that I was scheduled for medical evaluations for brain injury AFTER THE TRIAL. The Court completely ignored this.
So it was my word against theirs. 5 years, at the time of the mistrial, to get a mockery of a trial, and have the jurors' time completely wasted. The jury wrote me a letter thanking me or something, but awarded me nothing.
I was diagnosed with organic brain injury after the trial. I had a similar test prior to the incident and had absolutely no problems and answered every question with no trouble. I now score in the FOURTH PERCENTILE on those areas.
Despite its length, this has been a short summary of all the events over the past 6 years. Much has been summarized, and much has been left out. I tried my best to balance completeness with leaving out irrelevant details.
There is no record of any misconduct on the part of anyone involved in this that is available to any law enforcement agencies or to the public. Nobody has been disciplined. No investigation was ever conducted. I was almost killed and was seriously injured, under a camera, and in front of witnesses, and spent 6 years working with the government. The government has done precisely NOTHING.
The County now routinely retaliates against me whenever we interact, in blatant violation of various laws.

Cabinet approves military-technical cooperation agreement with Czech Republic

The Government of Armenia on March 30 approved the agreement on military-technical cooperation with Czech Republic which was signed in 2019.
The agreement envisages cooperation in military education, defense industry, military history and museology, as well as participation in peacekeeping missions abroad. It will be sent to the Constitutional Court to determine its compliance with the constitution, and in the event of receiving a positive response the agreement will be submitted to parliament for ratification.

Azerbaijan has advanced troops 100 to 300 meters in five points, Armenia’s National Security Service says

I have a short credit history (3 years) and my score has been hovering around 770-780 FICO for the past 2 years. I've never had late payments, always paid bills in full, and low 10% utilization. But I've have never broken 780. I'm thinking about buying a house soon and want to maximize my score as much as I can to get the best mortgage interest rates.
This are the reasons TransUnion gave that negatively affected my score:
  1. Length of time accounts have been established
FICO® Scores consider the age of a person's oldest account and or the average age of accounts. Your score was impacted by the relatively low age of your oldest account and/or the average age of your accounts.
  1. Lack of recent installment loan information
FICO® Scores consider recent non-mortgage installment loans (such as auto or student loans) information on a person's credit report. Your score was impacted because your credit report shows no recent non-mortgage installment loans or insufficient recent information about your loans.
Obviously, for credit history, there's nothing I can do except wait it out.
I have no installment loans. I never had student loans, and I'm financially comfortable enough to pay a car in full to avoid interest. (I'm looking to buy a car.) But I realize that I might be able to save a lot more money from mortgage payments if my score was higher, and having interest payments for a car loan might be worth it, even if I can pay for the car upfront. (i.e, pay hundreds in interest now so that I can save tens of thousands of interest later).
What boost in credit score can I anticipate if I were to get an auto loan, and what increase in mortgage interest rates can I anticipate?

I sit in a small wheelchair in the cockpit of the medical ship. It took a long back and forth between me and the Doctor before he caved. Admittedly I felt a bit bad about it, he caved the moment I raised my voice, obviously out of fear. The pilot doesn’t acknowledge my presence as I stare out of the viewport. Entering and leaving hyperspace was a glittering assault on the senses. The waves of light compress into a large array of colors, though it only lasts a small moment before hovering around a deep purple. We’re only a few more jumps from Sogun. As the light slowly unravels into realspace, I hear the pilot talk into their headset, I overhear that we’re going to couple with the cargo ship before the final jump to Sogun. The maneuver takes very little time due to our proximity and the Doctor enters the cockpit.
“Mr. West.” I turn towards him, “You’ll be returning to the cargo ship as we dock at Sogun. Your rib should be fine, and you’ll be able to do light activity without worry. However, that doesn’t mean you’ve fully recovered from the surgery. Don’t push yourself.”
“Alright, thanks again for fixing me. Sorry I got upset earlier.” I stand up and he turns back out of the cockpit, I follow.
“Don’t worry about it, I was merely worried about how the crew would react.”
I turn a corner to see Tsanma standing at the coupler port. She dips her head at the doctor's arrival and he gives her a few slips of paper. We turn to walk into the ship.
“Alright, you’re released but, again, no rough activity for at least a week.”
“Got it.” I give a firm nod to the doctor, he turns away and so do I. As I walk with Tsanma she asks,
“How do you feel Ryan?”
“Fine, I mean, it’s amazing I can walk fine after only a couple days of rest. Though I’m a bit sad that hospitals having horrible food is a trend even in space.” I’d eaten gruel 3 meals a day.
“Well, you’ll be excited to know that you’ll be meeting my supervisor over food soon after we arrive. you’ll be discussing your contract in the face of new circumstances.”
“That’s usually not a good sign.” We both finally reach the cockpit, she sits in the pilot seat and I to the passenger seat to her left.
“It’s nothing bad, just that our ties with the Federation have, well, completely ended. They were our reason for hiring you off the record. With the formalization of the UN coalition, there’s nothing stopping us from having you as an official agent.”
“Then why the sit down?”
“My superiors are apprehensive. All they see on their desk is a human contracted for his involvement in crime, they want a formal interview. They’ll be treating you like they would any other security hire. You’ve already proven your willingness to fight, you’ll do fine.”
“That’s good to hear, to be frank, I love doing this. Even with these injuries, not an ounce of me wants to stop.”
“Good, keep that attitude going into it.” She navigates the ship’s terminal and we begin to enter hyperspace.

We unravel into realspace and the image of Sogun appears, overtaking most of the viewport. Snaky continents cover its landmass, an iridescent blue star peers from behind its horizon. A deep red cluster of asteroids sit above the planet where, despite the distance, a sprawling network of buildings can be seen. Without fail, seeing a life sustaining planet fills me with awe. Even if it was for work my mind couldn’t help but race over the fauna and flora, how would they look? Would they be similar to those on earth?
“We’ll be stopping at Akta, the asteroid field, before we hit the planetside. We’ll be dropping off the Countess there while you meet with my supervisor. I’ve forwarded some basic etiquette to your holopad for you to look over.” I grab my holopad from my back pocket and skim over the document, it’s huge.
“This is way too much to memorize, what’s most important to keep in mind?” I say as I put down the holopad
“It’s polite to greet with a dip of the head. Don’t merely swivel your head, it's a sign of aggression, bend forward slightly as you do it. The food is an old tradition, harking back to the Compact of the Three Clans. Basically, if negotiations are to be had between different parties, there’s food. ‘Breaking bread’ is a term I believe you’re familiar with.”
The red asteroid field slowly grows closer as we round the orbit of Sogun. I leave for the kitchen, I notice the multiple dents in the walls from the firefight that was but a few days ago. I walk through the open doorway, and see the Countess sitting at the eating table as the servant girl cooks something. I open the fridge and remove a can of soda water, the noise causing the servant girl to look towards me.
“Hey.” her ears turn down and her breathing gets noticeably shallow. Reossa begins to speak,
“Maylak, we talked about this.” Such simple words seem to instill her with some courage. She calms down.
“Maylak, eh? That’s your name?” I crack open the soda and sit at the table.
“Yes. That’s my name.” Her voice wavers slightly, “Nice to, properly meet you, Ryan.” I take a sip of cold white noise.
“It’s nice to meet you as well.” She doesn’t say anything back for a moment. She seems as though she’s about to speak before she gives a sudden whimper. I look at her, she holds a paw with the other, a pained look on her face. As quickly as I think to see what’s wrong, Reossa dashes to her side and asks,
“What’s wrong?” Maylak holds up a paw, light pink blood rolls over her cream fur.
“I’m sorry my Lady, cooking has never been my strong suit.” Reossa grabs Maylak’s paw and closely inspects a small cut. Maylak’s ears flick rapidly as she does, “My Lady that’s,” she tries to pull her paw back “you don’t need to,” Reossa licks the small trail of blood off Maylak’s fur.
I suddenly cough into the can, sending the fizz across my chin and on the table. They both quickly swivel their heads to me as I cough up a bit of the water,
“Ok, I’ll get the liquid bandage.” I quickly open the small, wall mounted first aid box and grab the small vial. I underhand toss it to Neossa after quickly deciding to not approach Maylak as she’s bleeding. After quickly wiping up the table, I leave for the cockpit again.
The red asteroid field has become quite larger in the small time I was gone. Tsanma speaks to a dark furred fissan on screen.
“Ah, there he is now.” The fissan turns to me, “Hello Mr. West. It’s good to see you.” I dip my head like Tsanma explained earlier,
“Hello, and you are?”
“I am Felis, Tsanma’s supervisor. I wanted to see you before our meeting. It seems you’re in fine health.”
“Yes, your doctor took good care of me.” Technically true, only the nurse let her fear influence her performance, “I’m cleared for light activity.”
“Well that’s good, we’ll have a lot to discuss, including your valiant defense against a boarding party.” I couldn’t tell if that was sarcasm or a mere exaggeration, I take the safe route and treat it as genuine.
“Thank you sir, I look forward to our meeting.”

“‘Your actions have strained diplomatic relations’, GARBAGE.” I kicked my desk hard, cratering the wood. The moment it became risky she bailed, passed the blame to me! “Hello Volssa.” She gives, her face and tail neutral. I look upon her with malice and my temper quickly raises.
“What are you here for, to gloat!? I can’t believe you’d wash your hands of me so quickly. If you did your job right there’d be no evidence! But you didn’t!” She keeps her neutral appearance.
“Volssa, I have no idea what you’re talking about.” I jump at her, claws bared. A large armored guard sprints past her and I’m slammed to the ground by the neck.
“I’m here because you’re under arrest for your incompetent use of power.” I try to yell but the hold on my neck produces only gagging, “While we’re at it, let's add the attempted assault of a prefect.”

My insurance company has sent approval of coverage to my surgeon for a medical procedure. This surgeon only works with insurance if they additionally provide a letter of agreement. Essentially saying, “Yeah, we already said we cover this and will, but now we are legally promising that we WILL cover this.”
My insurance company (Anthem BCBS) despite sending an official approval of coverage for the procedures, has said they will not provide a letter of agreement?
The fees required are 46,000 USD, so obviously securing an unsecured loan of this size is going to be a challenge, and I wonder what the best way to go about this would be. Would it help to go to a credit union in person and explain and show them all of this?
In anticipation of some financial advice I imagine I’m about to receive in response to this post, yes, I’m aware insurance may fight tooth and nail and deny reimbursement even though it’s eligible for reimbursement. I’m aware there’s a chance I get stuck with the monthly payment. I could take the monthly payment on a 5-7 year loan of this size, I’m also aware that even if I’m reimbursed swiftly I’ll probably end up personally paying between 5 and 10 thousand in interest.

I’m a real estate agent working all over the entire Richmond area. I’ve been involved in real estate over ten years in one form or another and am in the top 5% of agents in my company nationwide. With my boring whack ass credentials out of the way welcome to my Q2 real estate update where I want to look back on how far we've come in the last three months. We’ll do a quick primer on the current banking crisis that’s been making headlines and what that means for the coming economic collapse (lololol). I also want to walk you through what it’s been like on the ground with some buyers of mine and highlight some events during the course of finding them a home. We’re also going to have some guest commentary by /rva’s resident lender u/gracetw22 with her take on the mortgage side of the business.
 
I’d like to apologize a head of time because I’m going to be jumping into and out of things as I’m writing all of this so the main thread of the post is going to zig zag a bit. Just think of it more like a journey > destination type thing. I’ll try to make this as guided as I can but will probably spend more time fucking with reddit post formatting than drawing up a proper outline so uhhh let's jump in.
 

Days of Whine and Roses

For those joining us for the first time here is the post I made at the start of the year. This covers a lot of basics about where we have come from, answers some FAQs about appraisal gaps/cash buyers/home prices skyrocketing, and is generally just a good starting point for everything I’m going to discuss in this post. Much of this is still valid today and I have been told this is an extremely pro click:

Housing has been in a recession since June/July of last year. The increase in mortgage rates have really put a damper on the market. In some ways that’s a good thing. Things were getting a little too crazy. It sucks for affordability, but homes were flying on and off the market way too fast. Many people couldn’t afford them even because so many people had cash on hand to bid over asking, which is different from an all-cash sale (see my previous post for a more detailed explainer on this), and the list price of a home doesn’t mean shit if it sells for an entirely different and much higher price.
 
The price of the home is what the invisible hand of the market doing jerk off motions says the price is. You can list a trash heap with no central air in Highland Springs for a million but that doesn’t mean you will get it. Conversely you can list some gorgeous updated home in the near west end for a ridiculous amount under recent comps in the last 90 days and pretend like you’re the hero when it falls in line with everything else as it goes under contract. Guess what real estate agents absolutely love doing to artificially boost their credibility?
 
Side note: occasionally in real estate posts someone on here will share a Zillow link to a home pending for like I dunno 350k that looks absolutely magnificent and almost every single time that happens I inevitably look it up, pull comps, and go “yeah this is underpriced by 50-100k.” Ya’ll please stop allowing yourself to be catfished. It’s a deliberate ploy and agents have been shamelessly doing it for the past 2 years. If it looks too good to be true, it more than likely is. Here is an example that caught everyone’s eye listed at 349k closed at 405k: 8016 Burrundie Drive
 

Nobody move there’s blood on the floor

Anywho I mentioned the R word and by that I mean a recession in housing. What you have to remember is that if you’re going to pack your shit up and sell your home you are almost always going to become a buyer unless you’re also being packed up in a coffin or urn on your way out in which case you don’t care where you go. If you’re looking to sell you are looking at what you think you’re going to net for your home as well as what your all-in and monthly payment is going to be on your next home. A lot of sellers are sitting pretty right now flush with equity. The vast majority are holding onto rates of 4.5% or lower. Why give that up unless you absolutely have to? Keep in mind a metric fuck ton of people refinanced in 2020 when rates cratered. Yeah you can bend a buyer over a barrel and get top dollar for your place now, but for many it’s a wash because they’ll have to pay that much more for their next place, go through what they just did to Mr and Mrs Buyer, and end up paying way more for the same thing they just gave up. When rates were low this was easier to stomach, but when they started skimming 7% the value proposition just wasn’t there. This caused a pretty substantial drop in inventory nationally because everyone stayed put. The issue of inventory has been the main driver of why housing sucks the last few years so even though we have less of it there is still upward pressure on pricing just due to the fact that there isn’t enough to go around.
 
Fewer homes being listed means fewer buying opportunities for everyone. The whole system kind of seized up. That being said there are still a lot of renters and first time home buyers trying to break into the market because the rental market fuckin’ suuuuuuucks regardless of what rates are doing. I got a text from someone who I didn’t really expect to hear from until later this year tell me his rent is being jacked up 17% because “reasons” according to his landlord. When people are faced with that kind of increase suddenly purchasing becomes a lot more enticing. You aren’t at the whims of the rental market, you can bank some equity, and you can (mostly) do what you want where you live.
 
If you go back to 2018-2019 which were the last time the world looked ::finger quotes:: “normal” you would see inventory was pretty flat until late Feb and then rose to a peak in the summer. This year has followed the same pattern we’ve had in 2021 and 2022 except we still aren’t seeing the flatline into growth we should be seeing right now. Inventory continues to fall and if that tracks we may not see “peak” inventory until August. There is no hard and fast rule on what the new normal is so this is something I’m going to continue to keep a close eye on city wide and will try to update everyone that’s interested accordingly. For now (In an Extremely Kai Rysdall Voice) let’s do the numbers.
 
Active listings around this time last year hovered around 351k total available units nationwide. It was 438k in March of 2021 and 934k units in 2020. Currently it is at 562k-ish. If your memory is hazy I’ll just point out that March of 2020 was really before COVID hit the US and went gangbusters which is when inventory dropped like a rock and everyone thought housing was going to crash. This week last year we had 93k new listings but substantially higher numbers of immediate sales. Those are homes that go on the market and go under contract within a day or two. We have 68k new listings now with around half as many immediate sales. Again all of this is nationwide so take it with a grain of salt when trying to draw a conclusion using those numbers and comparing them to Richmond. We’re a different market than San Francisco or Denver and what is happening locally here vs there isn’t reflected in this data. Some parts of the country are seeing big increases in inventory and considerably higher vacancy rates on rentals that we don’t have here. I’m just sharing this because it’s interesting from a birds eye perspective.
I think this is a pretty good time to point out the obvious that there is a lot going on in the world feeding into this that isn’t housing specific. It’s as good a time as any to segue into how dumb and bad Silicon Valley bank was at being a bank so let’s fuckin go.
 

Do Re Mi, ABC, SVB baby u and me

Silicon Valley Bank mostly served VCs and the tech sector. That’s been their bread and butter for a while now. Banks typically like to keep portions of their investments tied to relatively safe assets or securities like bonds. If you are watching JP at the fed turn the dial on rates up those bonds you now hold are not worth as much. A good bank will diversify the types of bonds (ie a bond ladder) they hold so that they can let some of them grow to maturity while cash out others but not at SVB. So as the rates went up their bonds became worthless right around the time a lot of VCs and tech companies were feeling the pinch and in need of more cash. SVB said they were going to sell some assets at a loss, people got spooked and there was a run on the bank. Within a short time SVB was toast. Luckily there was a bailout that lots of people are claiming was not a bail out because SVB executives weren’t being saved (there was a bailout) so most depositors will be made whole. Since then Janet Yellen has been going “Wow there certainly a lot of questions about my ‘the banking system is sound and secure’ t shirt I’ve been wearing all week”.
 
There were other banks and institutions that have bit the dust or been on shaky ground like Silvergate with their disproportionate exposure to dogecoine or whatever the fuck crypto nonsense they were up to. Credit Suisse had some shitty fund management issues going back years and some absolutely insane storylines involving the Belgian gang cocaine money laundering, the Saudi’s refusing to back it on reports of mismanagement, etc. The point is this is a crisis in the ability of some banks to do very basic bank things. It’s not the same thing as Lehman Brothers, CDS, AIG, credit availability to the average consumer with a pulse being approved for “sky is the limit” loans without asset verification. This is a case of some banks screwed up how they hold bonds which is one of the most boring things to fuck up in that world. They didn’t get struck by a moving vehicle out of nowhere. They put their car in neutral on a .05 degree decline, laid down 20 feet away, and let it roll over them at a snails pace.
 
Fun fact: the CEO of SVB was actually the CFO of Lehman Brothers in the 2008 GFC so lol man oh man talk about falling up.
 
“But gowhatyourself, what does this have to do with housing in Richmond?” You know I’m glad you asked that question Rhetorical Device thank you. It doesn’t directly, but it has introduced a degree of volatility to the bond market and in turn interest rates that, again, has given sellers pause and some lucky buyers a great opportunity to get in at lower rates as they time the fluctuations. I have more to say on that later on.
Markets do not like volatility. Line must go up and in the absence of “up” it must stay flat or decline in a predictable way so that there is enough breathing room to make money on the way down. The house always comes out ahead but when conditions are uncertain things get dicey. That’s part of why SVB went under. The house (Peter Thiel) coordinated a bank run. The economy, just like real estate, is often governed by “vibes”.
 

You get a good job with more pay and you're okay

“So what are the vibes in Richmond gowhatyourself? Home prices are declining! I saw they dropped precipitously in Sacramento!” Yes no kind of not really. Much like politics real estate is both national and hyper local. Trends in inventory and home prices can be looked at broadly as a measure of what the economy is going through as a whole, but it lacks context. Prices have fallen in areas with a lot of tech exposure which have seen layoffs and slow downs so people aren’t paying the same premiums they once were. Again though, it’s context dependent. We didn’t experience the same price shock as some other metro areas. We didn’t see the absolutely bonkers price increases you saw in Austin or Des Moines for example. We also aren’t seeing the same type of correction either. Our home prices have actually stayed relatively flat or have even gone up in some areas of town since last summer. I’m still regularly seeing homes go for some pretty eye watering prices in the fan and near west end, but not so much in say Moseley. Short Pump still has some wild shit happen from time to time too. I, much like many others, cannot for the life of me figure out why 12 Westham Parkway went for 400k over asking.

Again, context matters. Scarcity matters. Buyer appetite and their motivations matter.
The motivation matters because some buyers aren’t entirely on board with getting the process started, but have their hand forced because landlords think they can squeeze more out of their tenants. I cannot count the number of people I’ve spoken to in the last month that have told me their rent is being raised by some obscene amount with landlords giving the excuse of “Oh yeah my costs are rising”. Buddy your costs to do what refuse to replace air filters or something because you aren’t doing shit in the best of times? Buyers just take a deep breath hold their nose and start making the necessary moves to purchase a home. Landlords don’t care because they can and will raise rent even more if those people bail so it’s a win for them regardless. At least for now until vacancy rates start to rise like they are in other parts of the country where people decided that building more housing was a thoughtful prudent thing to do.
 
I know landlords read these real estate threads and I’m not trying to paint you all with the same brush I’m kind of sure that not all of you are blood sucking sociopaths. AirBnB owners can get fucked though.

At this point I’d like to walk you through the process for one of my buyers (With their permission!) that started their journey back in December. I think it took a rather interesting arc that illustrates a lot of trends going on in real estate right now. When we first spoke they gave me their list of wants and needs so I did the usual thing of sending them things to look over and then put them on an automated search that went out daily. I was still checking on the portal every day and tweaking things here and there (“Hmm what if we go back a few years on the build date or look a little more east…” that kind of thing). We were casting an extremely wide net. South of the river from 288 all the way down to around Courthouse Road at 288 out west to about the Richmond Zoo. 500k or less built in the last 25 years. That is an absolutely massive area. They had certain preferences for what they wanted in the home of course. Some natural light, a halfway decent kitchen, and some square footage to spread out in but there was nothing they told me that was so hyper specific that it should have been difficult to find anything. Boy I was wrong.
 
We would go weeks without seeing anything come on the market. I think we only went out maybe once in January because there was just nothing and even then what we toured wasn’t worth the drive for either of us. When something did go live we’d go take a look at it and jointly agree that it just wasn’t even worth offering on. Usually it was because the home had not been kept up with which is something you find more often than you’d think. People buy/build new homes then assume they don’t need to do anything to it so they never change their air filters, clean the gutters, etc. There was one home we saw that was built in 2017 and I swear to god I don’t think they had ever changed the air filters anywhere. The HVAC system sounded it like it had been chain smoking Marlboro reds for the last 5 years and when I popped open the air return dust and dirt had completely caked over causing a near total blockage of air flow. Sometimes we’d go and find out a home had solar panels that had not or would not be paid off at closing. What buyer is going to cover $40k worth of solar panels at closing? The point is they weren’t being picky or anything there just wasn’t anything that really worked.
 
Weeks and months went by with nothing to really put an offer on, but at the same time we also weren’t losing out on anything either. Homes were still going under contract quickly we just didn’t see a reason to bite on any of them. The week SVB went under I started watching the 10 year bond dip and poking around just outside the MLS area they had been looking at because I felt if there was ever a time to stretch the parameters it’s now if rates drop abruptly over the weekend. Bingo. I found something that checked almost all of their boxes. We toured the home. They loved it. I hit up their lender to see where rates were and if he was seeing movement trending down. Between the beginning of the week and when we went under contract their rate had gone down almost a full percentage point. After months of wandering the stars aligned and we were set. No escalation clauses, no waiving inspections or waiving the appraisal. Just a fair purchase price on a cleanly written offer and a 30 day close.
 
The listing agent tried to do the whole “My sellers are out of town and need to review in two days” and I just went “nah lady you used Authentisign for the DPOR form you can present this now thanks.” So she caved and she did. For the record it was almost impossible to bully sellers like this last year. They’d just tell you to pound sand and get in line.
 
Some of what I mentioned above wasn’t really the case a few years ago. There was a lot more competition and even though right now the data was clearly showing there were more homes being listed nationally than there had been in previous years we just weren’t seeing it where we were looking. That whole part of town either locked in their purchase around 3% or they re-financed and planned on staying put. That’s just how the burbs be sometimes.
 
The point of all of this isn’t to say “WoooOOOwww I’m SUCH a good agent” it’s that the market is doing really funky things and ultimately it’s possible to get into something you want if you are patient and strategic. Plan accordingly! If you are thinking of doing something this year get your ducks in a row now so that when opportunities like that present themselves you know what you want and you can act decisively. Talk to Grace and sort out what your financing is going to be. Figure out if you want to break a lease early and if there are any penalties or if you’re free and clear with 60 days notice. Confirm with your soulless middle manager at cap one that you are locked into WFH so you can shop south of 288 without fear of reprisals via shit traffic engineering.
 
One last thing I want to cover before I turn things over to Grace is what happened with new construction following my last post in January. At the time what we were seeing in the industry were home builders struggling to make their numbers because longer lead times vs resale were hampering their ability to keep fidgety buyers watching rates rise under contract. Homes were being cancelled and people were backing out at alarming rates. So here I have to hand it to the builders. They saw where they had leverage and pounced in some pretty creative ways. Many builders have in house financing (NVR Mortgage and Ryan Homes for example) so some of them started doing things like aggressively offering free rate buy downs, or holding steady on pricing and offering deep incentives like hey sign now and you get 15k in free kitchen upgrades (at 2k cost to us). I saw home builders offering free trips to resorts to agents who brought them a buyer who signed on the dotted line. Commission offerings from builders went up. They pulled all the right levers and captured a lot of people who had been sitting on the sidelines through the winter. Some builders found that fairly mild price cuts were all you needed to do to get people through the door again. The builders just have leverage in ways traditional sellers either are unwilling to take advantage of or simply cannot compete with.

Just some quick thoughts for where I see mortgages moving:
  1. After the most recent federal reserve meeting, Jerome Powell’s comments seemed to indicate that they were slowing down the rate of federal funds increases, and believes that the current amount of credit tightening is more than the current inflation data shows, so the fed intends to wait to see what the current changes cause before continuing on. The fed indicates to expect one additional rate increase this year and expects slightly lower rates next year. This does NOT directly impact your mortgage rate, but it does tend to follow similar patterns to what DOES impact your mortgage rate. Love to hear it.
  2. Getting MUCH less press but what will be MUCH more impactful to your mortgage rate is the strong stance the federal government is taking in policy as it pertains to mortgages. Remember, the only reason that a 30 year fixed rate mortgage exists is BECAUSE of the secondary market for them and the government entities that manage that. Private loans that are not sold on these markets are historically 2-3% higher. The federal housing finance agency and house finance committees have made a number of decisions lately that signal the government is moving their policy on mortgages away from a risk based model: the riskier the loan, the more expensive, and more toward a social service type model: the less help you need from us, the more expensive. As of right now, someone making less than 80% of the area median income is getting the same rate that someone with an 800 score and 50% down would receive REGARDLESS of credit score, down payment, property type, etc. Someone with a 740 score who makes over that 80% limit is paying a higher rate comparatively than they were 2 months ago. Higher earners are going to increasingly have the best available rates from banks that are lending their own money or brokers that run with very minimal overhead.

Ancient married man (60yo) with heart issues - I have put $10K into a credit union for the explicit purpose of burning my body at the cheapest place - no frills, no special event etc, should I not wake up in the near future. The credit union pay 0% interest. Is their anything out there that would allow immediate access/withdraw up to the total sum (as needed) by my immediate family, but pays anything/something for letting it sit around for a while, be it short or hopefully, long term?

2023.04.01 02:37 mspantaloon How do I get a student loan and etc

I got accepted to BU, and it is about the same cost as the state schools that accepted me, so I'm going. They're offering 63k off and 10k in federal loans, 3600 of which is work-study so I guess that's not a loan lol. I'd have to find 13k ish after that point. I plan to pay that 13k through a part time job while at college so I can hopefully graduate with under 40k in debt. Can I take the 13k out with a loan and just start paying it off immediately? Like with each paycheck? Should I borrow 50k ish instead to cover all four years with one loan? Where do I even get that loan? I'm getting a job literally ASAP so I can pay the enrollment deposit and save up a few grand over the summer, but I don't have credit or anything to show I'm good at paying things back. Do I have to put down a deposit on a loan?
Also, my dad got laid off. He's non custodial, so it only affects child support, but he's paying less than half of what he was. Is that something I could tell the financial aid office?

2023.04.01 02:32 MaveDustaine Wildly different interest rates between local credit union, direct local lender, and wholesale mortgage lender

So we just went under contract and I have three options in front of me, the choice seems obvious, but I need to know if I’m missing something because the difference in rates is almost a full 2%
Lender 1:
Direct lender that was recommended by realtor
Interest rate is 7.5% with no points, and high~ish closing costs
Lender 2:
Found through Bankrate, I think it’s a broker who deals with a wholesale mortgage lender
Interest rate is 5.999% no points, lowest closing costs
Lender 3:
Local credit union
Interest rate is 5.65% no points, closing costs a bit higher than opt 2
Now I’m leaning for lenders 2 and 3, simply because they did give me an actual loan estimate (the template on the cfpb website) whereas lender 1 is adamant that i don’t need that estimate and their pdf is more detailed, i don’t feel comfortable with that.
What’s the catch here? Why is the credit union 5.65 whereas the direct lender 7.5?
The loan across all lenders is the same, 30 year conventional fixed rate, with a 20% downpayment.

Reddit really needs to improve their formatting capabilities as well, single line spacing without making everthing look like code and columnar arranging too.
