2023.03.27 16:54 Purdue82 Litigation Capital Of America- The Athletic

Litigation Capital of America
The phrase “soccer capital of America” has been passed around like the common cold over the years. Poke around any newspaper archive and you’ll see it assigned to dozens of American cities. There are the obvious ones, like Kearny, NJ and Portland, OR, and then there are population centers whose claim on the title feels a bit more tenuous: Bloomington, IN. Clifton Park, NY. El Sobrante, CA.
The first mention of the phrase, though, comes in the mid-50s and appears in a small, Los Angeles-area newspaper. And it’s in reference to St. Louis, MO.
Dozens and dozens of times over the past 70 years, the city is referred to as America’s soccer capital, and for good reason. The city has produced 12 Open Cup champions and nearly as many college title winners. Five players from the city were on the 1950 World Cup squad that shocked England, and modern soccer is full of folks from the city as well, names like Taylor Twellman, Tim Ream and Becky Sauerbrunn. The city can even claim to have what was possibly the first-ever organized women’s league in the United States.
Back in 2021, the four St. Louis City SC fans who run the River City Ramble podcast were keenly aware of all of this when they named their then-new show the “Soccer Capitol Podcast.” That phrase — “soccer capital of America” did not feel owned by anybody, it felt like a part of the American soccer zeitgeist. Even if the phrase itself was trademarked, who was going to bat an eyelash at a quartet of random soccer fans running an unprofitable podcast from their collective bedrooms?
Sporting Kansas City, that’s who.
Unbeknownst to anyone, SKC thought that the place they call home had its own claim to the title. And for one reason or another, they applied for a trademark on the phrase in the summer of 2021, a couple of months after the River City Ramble guys broadcasted their first episode. A year later, in July of 2022, that trademark became registered.
“Then we see that (Sporting) puts out their own podcast, called ‘Soccer Capital of America,’ and I was like ‘uh oh, we’re in trouble,’” River City Ramble co-host Mike Turner told The Athletic last week. He had good reason to be suspicious. In February of this year, Sporting KC general counsel and vice president Andrea Kimball reached out to him. “Do you have time to chat on about the federally registered trademark (Soccer Capital of America), that our legal department believes is being infringed by the name of your podcast?,” she asked.
Turner and the rest of the River City Ramble crew did what anybody probably would’ve done in that situation, given the absurdity of it: they ignored the email. But a week later, Kimball got serious. “Will you change the name of your podcast or do we need to pursue legal remedies?” she asked in a follow-up. “If you have counsel, please send this correspondence to counsel and ask hehim to respond within three days.”
The podcasters did not have counsel. Nor were they prepared to go to war with an MLS team over the name of their podcast, which Turner says they were thinking of changing anyways. The hosts polled a few friends who had legal backgrounds and the consensus, among all of them, was that Sporting would have a strong case, if it came to that. And that’s when the Soccer Capitol Podcast became the River City Ramble.
Almost as an afterthought, the podcast put out a statement explaining the name change and referencing Sporting’s threats of legal action. Predictably, it went viral, at least in the small world of MLS Twitter. Within days, the hosts of the show had received a flood of supportive tweets. Independent kitmaker Olive and York even threw together a tribute kit, stating that they’d donate all proceeds from sales of the shirt to the podcast creators themselves.
“It’s the greatest thing to ever happen to us, frankly,” says Turner. “Our downloads have exploded in the past two days, our Twitter followers have almost doubled in two days. There’s been an outpouring of support from other local podcasters and also other independent creators out there across the nation, lending us their support. It’s been humbling and heartwarming to be honest.”
St. Louis City SC itself, with its record-setting 5-0-0 start, has added their own tiny chapter to St. Louis soccer history, a book that gets longer and longer by the day. Sporting KC, in the meantime, might want to learn a lesson from Seinfeld’s George Costanza. You can’t just call yourself T-Bone. Or the Soccer Capital of America. Someone else has to give you the title. And stop threatening to sue podcasters, please. –Pablo Maurer

2023.03.27 16:21 dead_drunk_and_naked Layout of the Studio/Set

Listen up fives. A ten is speaking.
You can find layouts of the sets for a bunch of different TV shows, such as The Office, Frajer, How I Met Your Mother, The Simpsons, and a ton of others, but I cannot find the same thing for 30 Rock.
Has anybody ever come across something, or made something like this for 30 Rock? I’m on what has to be my 150th watch of the show and I’m trying to piece the whole TGS studio together but if it already exists somewhere, that would be a lot easier than trying to do it myself.

TORONTO, March 22, 2023 (GLOBE NEWSWIRE) -- Discovery Silver Corp. (TSX: DSV, OTCQX: DSVSF) (“Discovery” or the “Company”) is pleased to announce results from Feasibility Study drill holes on its flagship Cordero silver project (“Cordero” or “the Project”) located in Chihuahua State, Mexico. These holes consist of reserve and resource expansion drilling and will be incorporated in a Feasibility Study in conjunction with a resource update planned for the first half of 2024.
Highlight intercepts from this current set of drill holes include:
  • 32 m averaging 158 g/t AgEq 1 (77 g/t Ag, 0.16 g/t Au, 0.7% Pb and 1.3% Zn) from 108 m and 39 m averaging 241 g/t AgEq 1 (124 g/t Ag, 0.09 g/t Au, 1.2% Pb and 1.9% Zn) from 185 m within the reserves pit in the South Corridor in hole C22-677.
  • 36 m averaging 126 g/t AgEq 1 (35 g/t Ag, 0.06 g/t Au, 0.7% Pb and 1.7% Zn) from 481 m and 27 m averaging 133 g/t AgEq 1 (25 g/t Ag, 0.06 g/t Au, 0.6% Pb and 2.2% Zn) from 555 m in hole C22-687; these intervals were toward the bottom and beneath the reserves pit in an area previously modelled as waste.
  • 15 m averaging 370 g/t AgEq 1 (137 g/t Ag, 0.05 g/t Au, 3.1% Pb and 3.5% Zn) from 50 m and 23 m averaging 141 g/t AgEq 1 (55 g/t Ag, 0.04 g/t Au, 0.9% Pb and 1.5% Zn) from 143 m in hole C22-671; these intervals were approximately 1.5 km northeast of the reserves pit.
Tony Makuch, CEO, states: “Our recent Pre-Feasibility Study outlined the potential for Cordero to become a top three primary silver mine globally based on average annual production of 33 Moz AgEq over an 18-year mine life. Our follow up drilling since this study demonstrates there is further growth potential still to be realized within our upcoming Feasibility Study. Drilling has returned a number of higher-grade intercepts within and below the reserves pit in areas that were previously modeled as low-grade or waste demonstrating the potential to further lower the strip ratio through converting waste to ore within the pit and to expand the pit at depth.
We are also excited about the district-scale potential on our large land package. At Sanson, located 3.5 km northeast of Cordero, and Dos Mil Diez, 1.5 km to the southeast, we have identified large chargeability anomalies with similar intensity to the ore body at Cordero. Surface mapping at both targets has established intense alteration with anomalous levels of pathfinder elements. We look forward to the commencement of drilling at these targets over the coming months.”
DRILL RESULTS:
This current set of Feasibility Study drilling consists of 30 drill holes and was focused on two key areas: 1) expansion of reserves within and beneath the Pre-Feasibility Study open pit and 2) upgrading and expansion of the resource in the far northeast of the deposit. Supporting maps and sections, drill hole locations and full assay results can be found here: Plan map, sections & assays Press release with plan map & sections
Reserves Expansion Drilling
Drilling has been focused on expanding reserves through the conversion of waste to ore within the reserves pit and through the expansion at depth of the reserves pit. In the northeast of the deposit, C22-675 intercepted 83.7 m of 83 g/t AgEq 1 at the bottom of the reserves pit and 38.2 m of 64 g/t AgEq 1 approximately 50 m below the reserves pit. Also in the northeast, C22-683 intercepted 27.6 m of 148 g/t AgEq 1 approximately 100 m below the reserves pit. All three intervals were within areas predominantly modelled as waste.
In the central part of the deposit, C22-687 intercepted 35.6m of 126 g/t AgEq 1 toward the bottom of the reserves pit and 27.4 m of 133 g/t AgEq 1 directly beneath the pit in areas modelled as waste. In the southwest of the deposit, C22-677 intercepted 31.7m of 158 g/t AgEq 1 from 107.8 m and 38.5 m of 241 g/t AgEq 1 from 184.9 m. Both intervals were within the reserves pit in zones previously modeled as low to medium grade highlighting the potential to increase the grade profile in this part of the deposit.
Detailed drill highlights from the initial feasibility study drill holes are provided in the table below:
https://preview.redd.it/kgii8nc65aqa1.png?width=800&format=png&auto=webp&s=21b71e108a31d5a4fa7e4b1b409f439bb6313a99
1 See supporting technical disclosure underneath the second table below.
Far Northeast Drilling
Drilling in 2022 outlined low grade mineralization with a number of discrete high-grade zones in the far northeast of the deposit, more than 1 km beyond the limits of the reserves pit. Most of this mineralization is within 100 m of surface and is included within the resource pit constraint as part of the January 2023 resource update. 15 follow up drill holes have been completed testing the lateral depth and strike extent of mineralization within this zone.
Hole C22-671 returned intervals of 14.8 m of 370 AgEq 1 from 49.7 m and 23.1 m of 141 AgEq 1 from 142.7 m in hole C22-671. This hole was drilled on section approximately 60 m to the southeast of C22-611 that returned 36.4 m of 94 AgEq 1 from 142.7 m and 14.6 m of 124 AgEq 1 from 186.8 m representing the potential lateral expansion of this zone. C22-662 intercepted 10.4m of 94 AgEq 1 from 273.0 m. This represents the potential lateral expansion of the mineralization intercepted in C22-609 drilled on section approximately 60 m to the northwest that returned 33.1 m of 150 AgEq 1 from 233.7 m and 17.7 m of 115 AgEq 1 from 198.2 m (see July 13, 2022, press release).
The follow up drilling in the far northeast confirms the presence of a broad mineralized fracture system in the area. The orientation of mineralization does not appear to be consistent with the dominant northeast orientation evident in the main part of the Cordero deposit. A more detailed review of fracture orientation along with further drilling is required to develop a better understanding of the main controls of mineralization in this part of the deposit.
Detailed drill highlights from drilling in the far northeast include:
https://preview.redd.it/mosy0kq65aqa1.png?width=800&format=png&auto=webp&s=244403a940efeda006385a982bc83d2b2b39393e
1 All results in this news release are rounded. Assays are uncut and undiluted. Widths are drilled widths, not true widths, as a full interpretation of the actual orientation of mineralization is not complete. As a guideline, i ntervals with disseminated mineralization were chosen based on a 25 g/t AgEq cutoff with no more than 10 m of dilution . AgEq calculations are used as the basis for total metal content calculations given Ag is the dominant metal constituent as a percentage of AgEq value in approximately 70% of the Company’s mineralized intercepts. AgEq calculations for reported drill results are based on USD $ 22.00 /oz Ag, $1, 600 /oz Au, $ 1.00 /lb Pb, $1. 20 /lb Zn. The calculations assume 100% metallurgical recovery and are indicative of gross in-situ metal value at the indicated metal prices. Refer to Technical Notes below for metallurgical recoveries assumed in the 20 21 PEA completed on Cordero.
DRILL PROGRAM UPDATE:
The Company has now completed 39,000 m (131 holes) as part of its Feasibility Study drill program (since the data cut-off for the PFS study). Feasibility study drilling consists of engineering drilling, resource upgrade drilling and drilling targeting the expansion of the PFS open pit. An additional 12,000 m is still to be drilled in this drill program and will be ongoing in the first half of this year.
Significant target generation work on the Company’s large, highly-prospective land package was completed in 2022. In addition to mapping and sampling work, 125 line-km’s of induced polarization (IP) surveys were completed during 2022 and early 2023 at the Molino de Viento, La Perla, Sanson, Dos Mil Diez targets and at the site of the proposed tailings storage facility. The surveys identified large chargeability anomalies at Molino de Viento and in the eastern portion of Sanson. These anomalies reported a similar level of chargeability intensity to those in the main Cordero resource area. Drill testing of these anomalies is scheduled to commence in the middle of the year with initial drilling focused on Sanson. Currently, 9,000m of drilling is planned for property wide drilling in 2023. This program may be expanded depending on the results of the initial drilling.

Sample analysis and QA/QC Program The true width of the veins is estimated to be approximately 70% of the drilled width. Assays are uncut except where indicated. All core assays are from HQ drill core unless stated otherwise. Drill core is logged and sampled in a secure core storage facility located at the project site 40km north of the city of Parral. Core samples from the program are cut in half, using a diamond cutting saw, and are sent to ALS Geochemistry-Mexico for preparation in Chihuahua City, Mexico, and subsequently pulps are sent to ALS Vancouver, Canada, which is an accredited mineral analysis laboratory, for analysis. All samples are prepared using a method whereby the entire sample is crushed to 70% passing -2mm, a split of 250g is taken and pulverized to better than 85% passing 75 microns. Samples are analyzed for gold using standard Fire Assay-AAS techniques (Au-AA24) from a 50g pulp. Over limits are analyzed by fire assay and gravimetric finish. Samples are also analyzed using thirty three-element inductively coupled plasma method (“ME-ICP61”). Over limit sample values are re-assayed for: (1) values of zinc > 1%; (2) values of lead > 1%; and (3) values of silver > 100 g/t. Samples are re-assayed using the ME-OG62 (high-grade material ICP-AES) analytical package. For values of silver greater than 1,500 g/t, samples are re-assayed using the Ag-CON01 analytical method, a standard 30 g fire assay with gravimetric finish. Certified standards and blanks are routinely inserted into all sample shipments to ensure integrity of the assay process. Selected samples are chosen for duplicate assay from the coarse reject and pulps of the original sample. No QAQC issues were noted with the results reported herein.

2023.03.27 03:09 dan7843292 multiple peers with the same allowed ips subnet in a single interface.

I downloaded several configs from a commercial vpn and I am was trying to test to see if i can add multiple peers to a single interface with different location.
example my vpn offers connections in nj and ny. so i downloaded a wireguard config of each city. created the interface and added the peers found in each config file to wg0 in my router.
interface: wg0 public key: 2LHKdfA.... private key: (hidden) listening port: 51751 peer: Orm/o/kO..... endpoint: 146.70.202.x:51820 allowed ips: 0.0.0.0/0 latest handshake: 1 minute, 25 seconds ago transfer: 1.09 GiB received, 287.17 MiB sent peer: kiVlibD... endpoint: 69.10.63.y:51820 allowed ips: (none)
both peers are configured with the same subnet as allowed ips (0.0.0.0/0). I understand that is not possible
so when the interface starts one of the peers is disabled right?
my question is how is the active peer determined? is it random? based on the end point ip?
if the wireguard service is restarted will always the same peer be activated? or ramdomly chosen?

2023.03.27 01:58 RufusTheDufus15 NJ divorce advice to calm my nerves

Came here looking for some advice to help settle my nerves. NJ divorce questions.
TLDR: 30 years of marriage - father is a severe alcoholic, mother wants divorce. funds are tight, father is abusive and hasn’t worked in 10 years. Is my mom’s lawyer giving her correct information and going about this divorce the right way.
My parents have been married for over 30 years. They both did not come from a lot and had to work hard for what they have, which isn’t a lot.
My father was kicked out of the house at 17. He has severe alcoholism to the point where he lost his job in 2015 due to drinking on the job and his health (physical and mental) has seriously declined. He has always been a functional alcoholic since I could remember. Anyway he has not worked since and he has become very verbally abusive over the years and completely intolerable when he’s drunk - Yelling, falling over, seizures etc, has gone to the hospital 3 times for being too drunk and dehydrated. He refuses to go to rehab even after I offered to pay.
He cashed in his pension around 2016 and hasn’t contributed to any bills since being fired. My mom works her fingers to the bone and has many health ailments (MS to name one).
My point is, that they don’t have a lot in the financial department. I pay bills and groceries at home, I paid for their COBRA without paying for my own health insurance for the 2 years after he was fired, this was $2,000 a month. My mom was then able to get insurance to cover them which continues to be around $1500 a month, not including her prescriptions. I have paid about $70,000 to their bills for the last 10 years and I just paid off the rest of their mortgage $30,000 so that they didn’t go into foreclosure. We went to the bank and this was a notarized loan. (Originally the divorce lawyer told my mom to stop paying the mortgage - “if father drove drunk and hurt someone they could take the house” lawyer’s words)
I still live home to help with the bills, however it has truly become unbearable with him still living there (I work full time and work a side job as well). Somehow he gets money doing odd jobs for people and is buying alcohol and honestly driving drunk.
The divorce process has started and it took forever to get him served to the point where my mom had to pay for a private person to come and serve him. I had to sign for it since I live there and am impartial- he refused to come out/leave the house with the sherif trying to serve him the 3 previous times.
So far the divorce has gone uncontested since my father cannot pay for a lawyer. My moms divorce attorney does not seem aggressive enough and keeps reminding my mom that this isn’t for a trial. We have questions and don’t want to get screwed here.
My worry is that my mom wants the house but they both have co-signed for my college parent plus loan ~$150,000. Due to paying their bills, I have been unable to contribute to those loans. In the previous meetings her lawyer told her that she could keep the house if she keeps the debt but now she’s saying, “no that’s not how it works.” Her lawyer also told her she could write a letter to the judge about how my father technically could work and hasn’t tried to hold a job (he does not have an alcoholism diagnosis since he gets signed out of the hospital and refuses rehab) and everything she has paid for in the last 10 years as well as describing what she thinks is fair. Now her lawyer is saying this isn’t true. This house needs a lot of work - a roof, the tub is leaking just to name a few. Apparently my mom keeps hearing that this divorce will be split 50/50 because it’s NJ and that’s how her lawyer keeps presenting it now.
Police have come to our house numerous times and refused to take him to detox/commit him even when he is so gone that he claims people are breaking into the house or there are burglars in the home (psychotic episode due to drinking- called 911 himself). He has seizures I’m sure due to withdrawal and we still cannot commit him ourselves. NJ sucks.
I told my mom to go get a second opinion at this point but money is tight. She is finishing up the divorce packet and is ready to submit it to her lawyer.
Any advice would be welcome. I have a very supportive bf who is understanding. I’m ready to move out with him but I cannot leave my mother until the divorce is finalized. My anxiety has been so bad for the last few years with this divorce situation.

2023.03.26 15:02 ThatDoodch Post Winter Rescue Tour Discussion Thread

What a freakin' tour huh?! It all started in Wrightsville Beach, included an insane 10-date stretch with the wonderful Hayley Jane (complete with more than a few debuts/FTPs) and finished on the big stage at The Cap. I can't claim to be an OG fan, but being around since early last year... this tour truly felt like a changing of the guard. There's no stopping this train now.
Here are my personal highlights:
2/15/23 - Wrightsville Beach - Exactly what you can imagine it to be if you weren't there. A tried and true beach show at a beachside venue. Lots of locals. GREAT sound. FTP on No Quarter (Sam mentioned before the song that they didn't really know how to play it fully yet... safe to say, it was a success). Great Samba > Fenway > Samba sandwich. I don't believe I'll ever see the guys at a place this chill and small again... so I'll cherish this one! Also, $2 beers! WHAT?! Long live The Palm Room.
3/4/23 - Chicago - A marathon run of a night in which the very talented local act Lunar Ticks opened. Someone gave Mr. Tooker a bubble gun. Getting Chicago moving with a funky People Say > Craig and Pat combo. Way To Be first set closer ripper. Second set Apple song combo (I can't tell you enough how much I love Applesauce) and a Phishy encore — Julius!
3/5/23 - Kalamazoo - Jimmy Law's birthday! 24 years young, but already a rising guitar legend, Michigan showed Jimmy some Midwest love. Great versions of Feel Like A Stranger, Look Johnny, Bent Strange. Samba for Sam all-timer.
3/8/23 - Covington - First night with Hayley Jane! Four debuts with Hayley. She explained on stage that she visited the guys in NJ and spent some time with all of them to write songs. The songs came together quickly and organically. And it definitely showed from the first note. Favorites include Jungle Foot (Hayley/Joey song), Little Bird (Hayley/Brian song) and Paper Fly (Hayley/Jimmy song). Crazy Fingers FTP with Jimmy sounding almost *too* much like Jerry. Goosebumps. Four-song encore to complete a ripping night in Northern Kentucky.
3/9/23 - Lakewood - Second night with Hayley. Hayley let the Dogs in on one of her old tunes Cosmic Katrina. A fun poppy, quirky and even heavy (at times) song. This Woman (Hayley/Jeremy song) debut. Intense and a special song to Hayley personally — she later mentioned at another date (think it was Pembroke) how empowering it was to write and perform. CHARLIE. Out of the 13 dates that I attended on the tour, this still stands out as the best jam I saw. Those that were there were left speechless. The roar following the jam from the Cleveland crowd was thunderous. A flawless Samba > Pedro > Samba sandwich. The Dogs certainly gained a whole slew of new fans in Ohio.
3/10/23 - Ann Arbor - Any Led Zeppelin fans in here? FTP (w/ Hayley) on Trampled Under Foot > Long Train Runnin' (Doobie Bros) > Trampled. Brand New Key > Hey Pocky A-Way played for the third straight night w/ Hayley, but this is an amazing thing. Such a great cover to get the crowd grooving. Bent Strange monster — similar crowd reaction as the Lakewood Charlie. El Sonidito dance party > Thriller 161 show bustout!
3/15/23 - Rochester - Upstate NY came to get down! This was a sellout. Packed room in an old-school club. Bubble lit the space on fire and they didn't let up for the next few hours. In contention for one of my favorite Dogs shows attended. Excellent crowd vibes. Other highlights include Applesauce, Blues for Brian, Back to the Start (love the placement), G Song, Nicolette debut... pretty much the entire show. Just head to bandcamp and take a listen for yourself.
3/17/23 - Saratoga Springs - Another sellout! Another birthday! This time, sir Sam Lucid turned 25. It sounds redundant given what I said about Rochester, but this is also a contender for my top-attended Dogs show ever. Wire-to-wire fire. Cats Under the Stars all-timer. Ben Pinnola (from "Benny had a bugle on his shelf") joined them for a few tunes including an intense Bugle on the Shelf that had an amazing high-energy finishing section. FTP on Steely Dan's Deacon Blues (birthday boy Sam on vocals) and New York State of Mind (Jeremy on vocals). Say Something to close out St. (Craig and) Patrick's Day in epic style.
What are your favorite memories from this tour? Where did you see the Dogs? Where will you see them next?!

Not really looking for any trades. My keeper library pretty much has everything I want. Unless you have a copy of Comet Gain’s Casino Classics, Kent's Isola, Hot Cakes by The Darkness, a copy of the bootleg record of And All That Could Have Been - Still by Nine Inch Nails, or the 20th anniversary edition of Suede's Coming Up (with the B-sides bonus record) you’d want to trade. These are pretty much the only albums on my want list.
Happy to provide any pics if you like. Just ask.
I also have a bunch of unusual band shirts and a couple T-shirts that had been cut down to become back patches that I’m selling. (Bands like Mono, Battles, Graveyard, and more traditional stuff like Metallica). As this is a sub for records, I won’t list them individually as part of the post, but if you want a list and prices, comment or dm me for that. If it's okay by the mods, I'll list them in a comment.

I thought I would get into a couple more targets and I'm not really happy with my results so far. The only reason I applied to NEU was cus there was no supplement but idk now. I was really hoping for Hamilton or CWRU but I guess its not happening anymore. NYU is my dream school but with the results i've been getting so far it doesn't seem like its going to happen. Im guessing some of the schools I got waitlisted to did it because of yeild protection, I didn't really show much intrest in Hamilton, UMiami, or BU so that could be the reason. Other than that, hoping I get into NYU, Umich, or Emory but it will most likely not happen.

2023.03.26 00:34 jewfromphilly Lakewood Slumlords Buying Up Philly!

Haredim from Lakewood NJ are buying up dozens of apartment complexes in the Philly and the surrounding counties, and the surrounding states of NJ, DE, and MD, so they can gouge the tenants for rent. After buying the units, they spike the rent 50% or 60% to drive people out. Then they truck in migrant labor to renovate the vacated apartments, so they can fill them to capacity with large families willing to pay double what the previous owners were charging, and as many kids as they can find to run on the hardwood floors.
I’m told the undocumented workers they use to repair the units are driven from NJ to Philly—60 miles each way—and they speak no English. It’s also possible they’re not paying city wage tax, which would violate the law.
Many of the victims are elderly, disabled, and people of color—which I know for a fact, because I know the victims, some of them living in the same apartments for years under the previous owners—and their goal is to drive them into the street. Of course, they do other things to make your life miserable after the huge rent spike, because it's just their nature.
So if you're looking to blame "white supremacy" for the high Black eviction rates in Philly, I can provide the names of the Lakewood companies, and their owners, so you can ask them for reparations.
I have no idea what portion of rental income goes into the coffers of the Haredi community, but you don’t want to support them. My understanding is that many of the men don’t work, and instead spend their days studying Tamlud at the Lakewood Govoha school, while defrauding the welfare system to support their wife and kids. And they have large families, probably much bigger than yours!
If you don’t want to be bled dry supporting these people, don’t rent from anybody in Lakewood, or any company run by this cult. And if you're not sure, do a Google search to see if they're from Lakewood before you sign any lease. Then go elsewhere. Not only will they gouge you, but they'll make your a living hell while you're there!

2023.03.25 19:24 Naijagyal999 My Eye-Opening Experience as a Juror in a Criminal Case (The State of New Jersey v. William and Beverly Ong)

DISCLAIMER: This criminal trial ended in April 2022, and I am allowed to discuss my experience with the media/online. This post is intended to shed light on juror conduct behind closed doors. NO REAL NAMES OF JURORS WERE USED. The only real names used are the plaintiffs and defendants in the case, whose names are public information. This post is for readers who want the REAL nitty-gritty about juror deliberations and juror conduct.
I was a juror in a NJ criminal case involving an Iranian-American man named Babak Pasdar, who claimed that an elderly, Asian-American couple named William and Beverly Ong, made discriminatory remarks and terroristic threats toward him, such as saying “F***ing Muslim!” and “Trump is going to get you!” to him, making a gun and slit throat motion towards him and his family, flying an Israeli flag to allegedly antagonize him, etc. The actual trial (opening and closing statements, and witness testimonies) was completed in one day because there was NO PHYSICAL EVIDENCE- no pictures, video, independent/unbiased witness testimonies, and no police reports were provided to the prosecution. I thought the case was cut and dry-there was no evidence, so we could not prove, beyond a reasonable doubt, that the Ongs were guilty of what they were being accused of.
Juror #3, Jen (a dumb, rude and condescending 20-something year-old Caucasian woman with a blonde, messy top knot bun) and juror #7, Pat (a 70-something year-old Caucasian woman with an equally mean and condescending attitude) dominated the entire conversation, saying how they “just feel” that Mr. Pasdar is telling the truth, and that the Ongs are guilty solely based off of Mr. Pasdar’s mannerisms/body language and “emotion” at the witness stand. Jen said that she didn’t like how Mr. and Mrs. Ong were whispering to each other, how Mr. Ong was shaking his head and mumbling under his breath, that their lawyer was nudging them to be quiet, and therefore, because of mannerisms/body language, they are guilty. I responded by saying that he may have been shaking his head because he felt that he was being lied on. One juror wondered out loud why Mr. Pasdar’s wife, Clara, (who is a former prosecutor herself), would corroborate Mr. Pasdar’s claims about the terroristic threats if she wasn’t actually there when it happened. I told the group that maybe he told his wife about what happened and she is just regurgitating what he told her, or maybe she could be flat-out lying and fabricating the story, being that we don’t know her personally or her morals-anything was possible in my mind. Suddenly, Pat gasped and yelled at me, “You think she is lying?!” I responded, “Maybe! You never know what someone is willing to say to defend their spouse”. She immediately responded with arrogance and defensiveness in her tone, “No, I don’t believe that! She is a lawyer and is held by the court of law to tell the truth and I just don’t believe at all that she would lie” (as if lawyers are always truthful *sarcasm*). The other jurors brought up topics that were unrelated to the case, were focused on details of the case that didn’t matter (i.e. the position of the house security cameras in the evidence pictures when this didn’t matter because there were no images and/or videos provided), were not paying attention to the legal standard of ‘beyond a reasonable doubt’, and were allowing jurors, like Pat and Jen, to bully them into abandoning their own beliefs or doubts about the case so that they can agree with them, giving the jury room a schoolyard vibe- if one didn’t want to be an outcast, join Pat, or else she would belittle and embarrass others into being quiet and questioning their own reasoning.
Some jurors didn’t speak at all, like one guy who constantly sat in the back of the room quietly, but voted “guilty” with no reasoning provided, probably because he had no backbone to make a dissenting decision. Mr. Pasdar on day 1, said that he had images, videos, and police reports, yet none were provided. The dummy Pat even said that his police reports “must be on file somewhere”. For all we know, he could be lying about the alleged “50-60 police reports”. They also asked, “Why would Mr. Pasdar go through the trouble of filing false police reports?”. Well #1- we have no proof of these reports, and #2- we know that he had some type of conflict with the Ongs’ daughter, Johanna, and maybe he is filing the lawsuit to spite them-just a possibility. There have been many plaintiffs who were in the right, and others whose lawsuits were frivolous and/or had no evidence to corroborate the claims. It is truly sad and disheartening when you have low-vibrational people with no legal training, or even basic understanding of the law, making long-lasting decisions that can affect someone’s life. Jen insinuated that the defense was trying to hide the “fact” that the Ongs did anything. Another juror, Ginger, interpreted Mr. Pasdar’s defensiveness about his own charges as “just being nervous about his innocence”-how gullible. It also shows how much people want to find the plaintiff innocent and the defendant guilty on anything no matter what. Ginger even said that “if we can’t find him/her guilty on this charge, maybe we can find him/her guilty on this other charge...”. I was floored-why such a desperation to find someone guilty? A not guilty verdict does not mean that the Ongs didn’t do anything, it just means that based on the extreme lack of evidence, we cannot find them guilty beyond a reasonable doubt- which is OKAY! A hung jury/mistrial is OKAY as well! Kevin noted the lack of evidence, only for Pat, Shirley, and Bertha to yell at him and scare him into being quiet. The defendants (contrary to what the slow jurors thought) have no obligation to defend themselves like the judge said MULTIPLE times. Just because they have been formally charged/indicted does not mean that they are guilty, like the judge said MULTIPLE times. The bullying continued from that day forward- jurors like Pat, Jen, and Shirley would gaslight and try to belittle an intelligent person like me, who was knowledgeable about the case, and I knew what I was talking about.
We all agreed on a not guilty verdict for the terrorism/terroristic threats charge-we agreed on the definition of terrorism/terrorize (which for some reason slow-minded Bertha did not understand it), and that Mr. Ong using the slit throat and gun motions did not constitute a terroristic threat conviction because we did not believe that Mr. Ong would actually cause bodily harm to Mr. Pasdar (produce an actual gun or slit his throat in real life). We did not believe that the hand gestures meant that Mr. Ong would reasonably cause serious fear of death for Mr. Pasdar or that it would be carried out. Since we believed that this threat was simply made to alarm, we all agreed on the not guilty verdict. The other two charges were contingent on this charge, so these were N/A. I then went on my lunch break thinking we would stick to our hung jury on the first charge. However, after the break, very quickly the foreman and Kevin caved. One of the jurors kept trying to rush through the day by continuously asking us to do a re-vote multiple times. Around 2 pm, the vote was now 11-1: I was the holdout. At this point, the Drab 4 (Pat, Jen, Shirley and Bertha) and I were going back and forth on whether the bias claim (“Isis”, “Taliban”) was true. The Drab 4 wrongly said that we must assume that all witness testimony is true- WRONG! I didn’t see this in the law handbook that we were provided. I asked the foreman to ask the judge to if we can assume that witness testimony is true unless refuted. I already knew that the answer was no, which is common sense, but common sense isn't so common amongst low-vibrational jurors. We walked back into the courtroom to hear the judge’s answer “No”, and lo and behold, I was correct! Still, this did not make a difference in their minds, nor did anyone apologize for saying that I was wrong in questioning the truthfulness of witness testimony.
I said that I have seen cases where people swear on the Bible and still lied, and Pat and I got into a very heated disagreement, and I could tell she was very irritated with me for not bowing down to her. I also didn’t remember there being any mention of bias statements in the police reports from my recollection of Mr. Pasdar’s testimony, but in true ganging-up-on-me fashion, the Drab 4 said that it was mentioned in the police reports, which I don’t believe is true because the defense team stated that the anti-Muslim statements were never noted in the police reports, but at this I point I started to shut down because everything I said would just go in one ear and out the other. Also, when I mentioned my knowledge of other people lying in witness testimonies and having innocent people be punished, Shirley then wrongly and angrily accused me of using my “personal beliefs” and my “opinions of other cases” to influence this case, and that what I was doing was not appropriate. I simply reiterated that “it’s not about personal beliefs, it’s just that I have seen other cases where people lie!”. The other jurors asked if there was anything that would change my mind- I said “No, I’m not sure I can”. Jen, in the nastiest, most condescending tone ever, said to me, “If you had these biases, you should have told the judge and the lawyers so that you would be deemed unfit to serve on the jury!”. Since when is knowing that someone may lie a bias?! Saying someone could lie is a personally belief?! I sarcastically retorted, “During voir dire questioning, I was never asked if questioning someone’s truthfulness is a bias, so I don’t know what you are referring to.” Being unsure about which verdict to give doesn’t mean that I am unwilling to see the other side and change my mind. Jen also previously made a comment about us not-guilty voters being “confused” and when I said that I would have preferred an unbiased, independent witness, before I could finish my statement, she rudely interrupted saying “well it doesn’t matter what your preference is...”. I even gave them an example of me lying about someone using a racial slur against me and taking them to court, and they still did not care.
The polite foreman tried to understand where I was coming from by referring me to the two clauses in the witness credibility section of the law handbook that he believed I was referring to, one of them mentioning bias. Ginger begrudgingly said that she could see where I was coming from regarding bias (which she wrongly pronounced as “BYE-YAZ”, showing that she didn’t know what bias was or even heard of the word before) from them being married, but in an exasperated tone, she said that she still didn’t believe that they were lying and didn’t understand me. Jen and a few others also agreed that witness testimonies are important or else we would never need witness testimonies in court. Jen yelled “Why have witness testimonies if we are assuming that they are not true?! Then we would never have witness testimonies! There would be no point in having them!”. I literally wanted to pull my hair out- we don’t assume testimonies are true or false right off the bat-we look at the witness’s credibility (which was in the law handbook) and then decide if we take their testimony as truth or not.
The jurors also got angry with me for stating the obvious- the interpretation of mannerisms/body language to determine credibility and truth in testimonies is subjective! Jen was mocking me, in a sarcastic tone, because she didn’t like that I was using them being married as a means of potential bias and them possibly consulting with each other on the case. I half-jokingly said that it is possible that they consulted with other on the case “at the dinner table”, and they all audibly groaned at my comment, as if what I said is impossible. Jen kept asking me if I would believe an ex-wife, or a stranger- not because she genuinely wanted me to give my answer, but because she wanted to find holes/lapses in my logic. They initially got excited when I said that I was willing to give a guilty verdict if the judge says that testimonies are assumed to be true (which I knew he would NOT say), but when the judge said that this is not the case, they reverted to demeaning and belittling me.
As the hours went by and 4 pm drew closer, the more irritable, impatient, tired, and nasty they became towards me. Voices were raised at me, people talked to me and questioned me with clear impatience and frustration in their voices (including the quiet guy in the back of the room, who almost never spoke, questioning my reasoning with an attitude). Last, but certainly not least, Pat yelled at me, in front of everyone, “WHAT’S THE F**KING HOLDOUT?!”. I immediately turned to her and calmly said, “Excuse me?! Don’t do that. Don’t ever curse at me again”. Embarrassed, she immediately apologized, saying she was sorry for cursing at me (on our way out of the building, going down the elevator, she tapped me on the shoulder and apologized for cursing at me a second time. I simply responded to her, in a monotone voice, “I understand you are passionate”, turned around and walked away). Kevin, the youngest one yet more mature than the others, came to my defense saying “Guys, don’t pressure her”. I told the entire room, “I will not be pressured into anything by anyone. We will listen to everyone’s opinions. Everyone’s opinion matters.” Pat then made a comment about me keeping 11 other people from going about their lives, and I responded that I and everyone else is entitled to take as much time as they need to come to a verdict that they believe is correct and can stand by. I will not rush through my decision or just go along with most of the group so that we can simply go home faster, or so that Jen can “pick up her kid from daycare on time”. This was not me being callous or inconsiderate-it was the truth! If coming in on subsequent days was going to be a problem or that they would be unavailable, then they, particularly Jen, should’ve spoken up and said this during the voir dire questioning-sounds familiar, Jen? As a juror, I wanted to examine both possibilities, Pasdar and Henderson lying, or them telling the truth. I wanted to remain impartial because that’s what you must do when you are on a jury-weigh both sides and not be biased, contrary to what Jen wrongly accused me of. Impartiality is why we were chosen to be on the jury in the first place- to make a sound verdict, the right decision. If I had an unwavering bias, why would I not want to get out of jury duty?
Before Thursday, April 14, we were at 8 guilty, 4 not guilty. On the penultimate day of jury duty, April 14, I became the infamous lone, holdout juror. Once we established the lack of evidence, we learned that witness testimony counts as evidence by law. Now this is where things got VERY HEATED. I will admit, it was and still is, a hard concept for me to grasp that by law, witness testimony can be used solely to convict. I and the other four not-guilty voters did not believe the witness testimony was enough. At this moment, Shirley, Jen, Pat, and Ginger got angry with us for not “agreeing with the laaaawwww”, as Jen put it in her irritating, Valley girl voice. Jen thought that she was so smart and slick by continuously asking us not-guilty voters in an aggressive manner, “So you guys are saying that Mr. Pasdar and his wife, who is an officer of the court, is committing PERJURY?! So that is what you are saying?! Yes or no?!”. Kevin and I said numerous times that we don’t know if they are lying or if they are telling the truth, and that is why we’re saying not guilty, because we cannot say beyond a reasonable doubt that Mr. Pasdar and his wife are being honest. We simply thought that there may be a possibility that they already have a contentious relationship with the Ongs and are just throwing the bias accusation into their lawsuit-just a possibility. We kept getting belittled for our viewpoints and made to seem as if we were crazy and not making any sense.
With my own independent thought process, I deeply examined why I was questioning their credibility, and I couldn’t find a reason as to why Mr. Pasdar would lie about these accusations and keep up the lie for six years- that just seemed absurd if they really were lying. They could’ve just filed a lawsuit for harassment and easily won the case (especially with the preponderance of the reports, minus the context of the report)-why would they add the bias charge if it weren’t true? Although I am not quite sure if this is the defense’s responsibility or not, I don’t believe that the defense did a good job at refuting the bias claims or diminishing Pasdar’s credibility (despite the mentioning of the false police report pending charge, which we had to remove from the record and could not consider in our deliberations).
Since I was the holdout vote, we came in on Tuesday, what would be our last deliberation day. The dummy Bertha asked “So is there anyone that has anything to say, or did anyone change their mind?”. I don’t know if she was addressing everyone, or specifically me, but I responded “At first, I said not guilty because I wanted to weigh both possibilities- them telling the truth or lying about the bias accusations, but then I thought to myself, how plausible or likely is it that they would make up these accusations and stand by the lie for the past 4-6 years? Also, the defense did not do an adequate job in refuting the bias claims or credibility of the witness. So based on MY OWN reasoning, I changed my vote to guilty”. Everyone let out a collective breath of relief that we were now unanimous, and people that had been nasty to me before were speaking to me kindly all of a sudden because I agreed with them- Ginger turned and happily said to me “Yeah, you’re reasoning makes sense because I just don’t think they would lie about that”. Pat turned to me and shadily said, “Well that’s what I had been saying all along. Why would they lie...”-I tuned her out. The foreman gave the guilty verdict for the bias/intimidation charge, then each juror confirmed the verdict, and we went home. A few months later, through the NJ Courts public Access site, I learned that Beverly Ong was sentenced to 2 days in jail with 1 year of probation- keep in mind that I told the jurors multiple times that we need to be mindful of our deliberations and verdict, which could possibly put the Ongs in jail, but Shirley and others constantly blew me off, saying “That’s not going to happen. I doubt they will serve jail time”. I also learned that Beverly and her daughter Johanna had been convicted of a similar crime (with Pasdar also) back in 2012! I sometimes wonder if the jurors broke the rules and looked up their previous conviction during the deliberations, but this is merely my own speculation-it may or may not be true.
This juror experience has been not only an eye-opening experience, but an extremely disappointing one in the sense that I have lost any small bit of faith that I had left in the 12-juror system. Having graduated with a minor in Psychology, I went into jury deliberations fully aware that peer pressure and groupthink were going to occur, yet it upset me to see grown adults, all ranging from their 20s to 70s, bully and peer pressure people into a particular verdict so that they could go home, disregard the judge’s instructions and the law booklet provided to us (I was the only one who thoroughly read it), make a verdict based off of feelings/emotions instead of logic, and in Jen’s case, rush out of there to pick up their child from daycare and avoid a lateness fee. Jen had the nerve to try to lecture me on juror conduct, yet she was seated in the front row of the court constantly using her phone and drinking water from her bottle, which we were told many times was not allowed. I wanted my verdict to be made on my own accord and reasoning, and for it to be a verdict that I could stand by, not because I was weak-minded and gave into peer pressure, which unfortunately was the case for a few jurors. I guess the lawyers did a good job in finding jurors who are easily manipulated, don’t follow direction well, and some who are clearly uneducated and have never done critical thinking in their lives, even at their old ages. It’s a shame that we jurors in our 20s had more couth and critical thinking skills than the 60–70-year-olds on the jury. These dummies constantly tried to gaslight me about certain facts of the case and got upset that it didn’t work on me. It also didn’t help that the spread-out dates of the trial contributed to jurors not recalling details of the case correctly (the trial lasted 5 days, but these 5 days were spread out over 4 weeks- March 29, April 6, 7, 14, and 19. I guess they can thank me for the extra $40 for coming in on April 19 *sarcasm*. Pat and Jen stupidly made themselves look like aggressors during the deliberation- they were exasperated because their condescension did not phase me one bit! I have my Master's degree from Columbia University and am well-versed in many topics and have common sense-something that Jen was lacking. When a few of the jurors asked why the Ongs did not go to the stand to defend themselves, I informed them that the defendants are not obligated to go to the stand because they could incriminate themselves (which the judge said multiple times, and I know this from my knowledge of previous court cases). Pat once again questioned my intelligence by rudely asking, “How do you know that?”. Knowing Beverly and her daughter were convicted of similar charges in 2012 adds credence to our verdict for this case and gives me a bit more comfort with our verdict, but not the way in which the other jurors came to the verdict.
Juror anonymity is a double-edged sword- it allows for confidentiality of deliberations, which is crucial for people to feel comfortable to state their opinions, but some jurors, like Jen and Pat, hide behind their anonymity, and the judge not being present in the room, to bully other jurors, and they never have the same energy when confronted-in front of the judge, they became mute. Also, after we agreed on the verdict, Kevin made a comment (not in connection to the verdict) about how he, as an Asian-American himself, knows “a lot of old Asian people that are racist” and some people in the room nodded along- this comment is highly inappropriate! It amazed me that no one pushed back on this racist anecdote, yet when I mentioned that there are people who are wrongly accused of crimes (which is 100% true), I was told, with an attitude, that I was bringing in “personal beliefs”. They didn’t like that I “had my mind made up”, but they had made their minds up also. The jurors would also pick and choose when to follow the judge’s instructions (i.e., Pat using her phone to look up the definition of words, although we were strictly told not to use our phones during deliberations).
Some readers may wonder why I am posting this a year after the trial ended- 1. I have other responsibilities/activities that I prefer to do, and I was contemplating just keeping these deliberations private (and my already-written post private), but keeping them private enables bullying and poor behavior in the deliberation room and would be a disservice to people like myself who are curious about juror deliberation conduct. Some readers may also wonder why I did not tell the judge or court clerk about my experience in the deliberation room- 1. He most likely would have told me to just brush it off and keep deliberating, and I say this because there was a point where we as a jury thought that it may be a mistrial, but he still pushed us to keep deliberating (which I think contributes to peer pressure, mental exhaustion, bullies having increased irritation with us jurors who stand our ground, etc.).
I’m posting my experience to see if any of you have had a similar experience while being in a jury, or disagreed with my reasoning for the verdict, experience, emotions, etc. Jury duty is not like the movie 12 Angry Men- even if I changed one person’s mind, what about the other 10? The world needs to know that this is the unacceptable behavior that goes on behind the scenes during jury deliberations. I hope this post can be the catalyst to discussions on proper juror deliberation conduct, which I do not feel was emphasized enough by the judge. If I am chosen for another jury in the future, I hope it is for a civil case, where only the majority vote matters, not unanimous.
Also, what do you think about the law of witness credibility being used to determine the verdict?
TLDR: Rude and inept jurors tried to peer pressure me to come to a verdict quickly so that they could “pick up their kids from daycare”, and I was not having it. This is my experience with poor juror deliberation conduct in a criminal case. Has anyone else had a similar experience as a petit juror?
